#### 97 Proceedings for offences 97 Proceedings for offences > > (1) Proceedings for an offence under this Act or the regulations, other than an offence for which a maximum penalty on indictment is specified, are to be dealt with summarily before the Local Court. > > > (2) Chapter 5 of the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209) applies to an offence under this Act for which a maximum penalty on indictment is specified. > > > (3) This section does not apply to proceedings for an offence under this Act for a fail to appear offence.
