#### 73 Discretionary grounds to refuse to hear bail application 73 Discretionary grounds to refuse to hear bail application > > (1) A court may refuse to hear a bail application if satisfied that— > > > > > (a) the application is frivolous or vexatious, or > > > > > (b) the application is without substance or otherwise has no reasonable prospect of success. > > > (2) A court (other than the Local Court) may refuse to hear a bail application if satisfied that the application could be dealt with as a variation application by the Local Court or an authorised justice. > > > (3) This section does not apply to a release application or a variation application made by an accused person on a first appearance in substantive proceedings for the offence.
