52 Contravention of Act by police officers (1) If a police officer contravenes a provision of this Act that is applicable to him or her as a police officer or as an authorised officer, the contravention is not punishable as an offence unless a penalty is expressly provided by this Act in relation to the contravention. (2) Subsection (1) does not apply to prevent a contravention of a provision of this Act by a police officer from— (a) being dealt with under the— (i) Australian Federal Police Act 1979 (Cwlth), part 5; or (ii) National Anti-Corruption Commission Act 2022 (Cwlth); or (iii) Ombudsman Act 1976 (Cwlth); or (b) constituting grounds for the institution of civil proceedings.
