25A Supervision condition when offence committed as young
person
(a) a condition is imposed on the grant of bail to an accused person
under section 25 (4) (e); and
(b) the accused person is at least 18 years old but less than 21 years
old; and
(c) the accused person was under 18 years old when the offence to
which the grant of bail relates was committed.
(2) The director-general responsible for this Act and the director-general
responsible for the Children and Young People Act 2008 must decide
which of them is to be the responsible director-general for matters
relating to the supervision of the accused person.
(3) If the responsible director-general for matters relating to the
supervision of an accused person is the director-general responsible
for the Children and Young People Act 2008, the accused person must
be supervised as a person under 18 years old.
(4) If the responsible director-general for matters relating to the
supervision of an accused person is the director-general responsible
for this Act, the accused person must be supervised as an adult.
