Aviation Transport Security (Prohibited cargo –Afghanistan) Instrument 2022

The instrument is short and conceptually focused. Four main concepts determine its operation.

1. Prohibition tied to origin or transit: The central legal trigger is cargo that "has originated in or transited through Afghanistan" (s 4(1)). That formulation captures both primary origin and onward carriage following transit.

2. Aviation industry participant as duty-holder: The duty not to bring such cargo into Australian territory is placed on "an aviation industry participant" (s 4(1)). The term is not defined within the instrument itself; the instrument's note points to the definition section of the Aviation Transport Security Act 2004 for that expression (s 3 note).

3. Exhaustive categories of exempt cargo: The instrument lists specific categories of cargo that are excluded from the prohibition, including letter products, small items, live animals (with packaging), human remains, specified biological tissue, certain dangerous goods carried under section 23 of the Civil Aviation Act 1988, government articles, and diplomatic bags (s 4(2)). Each exempt category is defined with precise criteria, for example letter product dimensions and weight (s 3 definitions), and human remains requires the sender to be a funeral director and the airline to have sighted the death certificate (s 3 definitions).

4. Permitted examination pathways and approved last port airports: The instrument allows a route back into Australia only where specified security controls have been applied at a listed "last port of call airport" after the cargo's origin or transit through Afghanistan (s 4(3)-(4)). The acceptable examination methods are (a) X-ray observation equipment meeting stated technical capabilities, (b) ETD equipment, or (c) physical examination following a mandated deconsolidation and systematic, layer-by-layer inspection (s 4(4)-(5); s 3 definitions for X-ray observation equipment and ETD equipment).

These concepts work together: the prohibition is broad but subject to discrete exemptions; where exemptions do not apply, a cargo item may still enter Australian territory provided it has been subjected to prescribed screening at one of the named airports. The instrument therefore operates by defining a default ban and then creating specific, administratively verifiable pathways to compliance via equipment standards and procedural detail for physical inspection.

The primary legal actor to whom the instrument speaks is "an aviation industry participant", who is obliged not to bring, or cause to be brought, into Australian territory cargo originating in or transiting through Afghanistan (s 4(1)). The instrument itself refers readers to the Aviation Transport Security Act 2004 for that term’s statutory meaning (s 3 note). Practically, the phrase will encompass entities in the aviation supply chain that have the legal capacity to bring cargo into Australia, including air carriers, freight forwarders, ground handlers, and similar regulated participants, because they are the actors able to cause cargo to be brought into territory.

Secondary parties affected include senders and shippers of cargo, consignees, and terminal operators, because the exemption and examination regimes require particular documentation, packaging, and handling procedures. For example, the definition of human remains requires the sender to be a funeral director and the airline transporting the item to have sighted a copy of the death certificate (s 3 definition of "human remains"). Likewise, the exemption for "government article" requires the item to be sent by the Commonwealth or an authority of the Commonwealth and to bear a security classification referred to in the protective security policy applicable to the Australian Government when the article is sent (s 3 definition of "government article"). These definitions allocate evidential and procedural responsibilities to non-airline actors as well.

Countries and airports named in the instrument are operationally central. The table of acceptable last port of call airports fixes which foreign airports are acceptable locations at which the specified examinations can lawfully occur to trigger the conditional exemption (s 4(3)). The instrument therefore affects operators and authorities at those airports to the extent they are required, or requested, to carry out the defined examinations; it also affects airlines routing cargo through alternate airports because a cargo item examined at a non-listed airport will not qualify for the conditional exemption.

Finally, the instrument affects consignors and shippers of goods from Afghanistan or that have transited Afghanistan because the default prohibition in s 4(1) will bar their cargo from entry into Australia unless it falls within an exemption or has been appropriately screened at a listed airport. Small exporters or humanitarian actors dealing with biological tissue, human remains, diplomatic bags or government articles will encounter bespoke definitions and documentary requirements embedded in the instrument (s 3; s 4(2)).

The instrument imposes discrete duties and creates definitional thresholds that give rise to rights to carry particular cargo. The fundamental duty is statutory: an aviation industry participant must not bring, or cause to be brought, into Australian territory cargo that has originated in, or transited through, Afghanistan (s 4(1)). The instrument does not itself set out exceptions to who may enforce this duty; it simply prescribes the duty-holder and the conduct proscribed.

The principal rights created are the exemptions and conditional pathways to lawful entry. If cargo falls into any of the enumerated categories in s 4(2), the prohibition in s 4(1) does not apply. These exempt categories are strictly defined in s 3. Rights flowing from specific definitions include:

• Letter product exemption: An item meeting all the dimensional and weight criteria in the "letter product" definition,500 g or less, longest dimension 360 mm or less, second-longest 260 mm or less, shortest 20 mm or less, and comprising only flexible items, may be brought into Australian territory despite the origin/transit trigger (s 3; s 4(2)(a)).

• Small item exemption: Items weighing 250 g or less and 5 mm or less in the shortest dimension are exempt (s 3; s 4(2)(b)).

• Human remains: An item that consists only of human remains with necessary packaging is exempt, provided the sender is a funeral director and the transporting airline has sighted the death certificate (s 3; s 4(2)(d)).

• Biological tissue: Defined narrowly as biological matter consisting of aggregates of cells, biological substances or samples, with necessary packaging, and exempted (s 3; s 4(2)(e)).

• Dangerous goods exemption: Dangerous goods that are permitted under s 23 of the Civil Aviation Act 1988 and packaged appropriately are exempt (s 4(2)(f)), creating a cross-reference to another legislative regime.

• Government articles and diplomatic bags: Government articles meeting the definition and diplomatic bags are exempt (s 3; s 4(2)(g)-(h)).

The conditional right to bring cargo that would otherwise be prohibited is available when, after originating from or transiting through Afghanistan, the cargo has been "examined under security controls" at one of the named last port of call airports (s 4(3)). "Examined under security controls" is expressly defined to include screening by X-ray observation equipment with specified capabilities, ETD equipment, or a physical examination that meets detailed procedural standards including deconsolidation and systematic opening and search (s 4(4)-(5); s 3 definitions).

Practical duties implied by the definitions include documentary and evidentiary obligations. For example, an airline transporting human remains must have sighted a copy of the death certificate (s 3). A government article must bear a security classification referred to in the applicable protective security policy when sent and be sent by the Commonwealth or an authority of the Commonwealth (s 3). These provisions allocate particular fact-finding and verification duties to carriers and senders where the exemptions are invoked.

The instrument does not articulate rights to compensation, review, or administrative discretion with respect to the prohibition. It is primarily a regulatory delineation of permitted and prohibited cargo movements, with duties and conditional rights expressed through the definitions and screening requirements set out in ss 3-5.

The instrument establishes prohibitions and procedural requirements but contains no express penalty provisions, infringement notices, civil sanctions, or enforcement mechanisms within its text. The operative prohibition is stated as a duty on an aviation industry participant not to bring, or cause to be brought, into Australian territory cargo that has originated in or transited through Afghanistan (s 4(1)). The instrument does not, however, specify the consequences of non‑compliance, the enforcement authority, inspection powers, or administrative processes such as notice or review.

The instrument is made under subsection 65B(1) of the Aviation Transport Security Act 2004 (instrument preamble). That enabling statement indicates the instrument is subordinate legislation enacted under the Act, but the instrument itself does not reproduce the parent Act’s enforcement or penalty provisions, if any. As a result, the text leaves operational enforcement questions open: it does not tell the reader which agency will detect non-compliance, what powers that agency will exercise, whether breaches attract criminal liability, civil penalties, administrative sanctions, or whether any remedial directions can be issued under the instrument itself.

Given the absence of intrumental enforcement language, aviation industry participants and other affected parties must look beyond the instrument to ascertain enforcement consequences. The instrument’s silence on enforcement increases the significance of the duty it imposes because practical compliance will depend on how the duty is enforced in practice under the wider statutory and administrative framework referenced by the enabling provision. The instrument sets out technical screening and documentary requirements to establish a defence or exemption, but it does not state who will verify compliance at the border, what records must be retained, or what evidentiary standard suffices to show an item was "examined under security controls" at a listed last port of call airport (s 4(3)-(5)).

For operational compliance and risk management, this has two consequences grounded in the instrument itself. First, because the instrument predicates the conditional exemption on a specified examination at a listed airport, carriers and shippers will need to obtain and, where relevant, preserve proof that the specified examinations occurred and were conducted using the methods and equipment defined in the instrument (s 4(3)-(5); s 3 definitions). Second, any party unable to demonstrate that an examination meeting the instrument’s standards occurred will lack the statutory exemption and therefore be subject to the instrument’s prohibition (s 4(1)-(3)). The instrument’s text therefore makes evidential burden and inspection procedures central to the practical enforcement regime, even though it does not specify enforcement mechanisms or penalties in statutory terms.

The instrument explicitly cross-references other statutory materials and policy instruments in two ways. First, it is made under subsection 65B(1) of the Aviation Transport Security Act 2004, which it cites in the making clause (instrument preamble). That reference establishes the instrument as subordinate legislation under the Act, and as such the instrument must be read and applied in the legal context created by the parent Act. The instrument itself, however, does not reproduce or restate the parent Act’s operative definitions for some terms; instead, it directs readers to the definition section of the Aviation Transport Security Act 2004 for the meanings of expressions such as Australian territory, aviation industry participant, and cargo (s 3 note). That cross-reference integrates the instrument into the wider statutory architecture governing aviation transport security.

Second, the instrument cross-references the Civil Aviation Act 1988. The exemption for certain dangerous goods is explicitly conditional on those goods being "permitted, under section 23 of the Civil Aviation Act 1988, to be carried on board an aircraft and the necessary packaging to ship the goods" (s 4(2)(f)). This creates an inter-legislative dependency: whether a dangerous good is exempt under the instrument depends on its status under another statute that regulates carriage of dangerous goods. Users of the instrument must therefore consult the Civil Aviation Act for the substantive criteria and permission regime that determine that exemption.

The instrument also incorporates by reference standards and policies through its own definitions. The definition of "government article" requires the security classification to be "referred to in the protective security policy applicable to the Australian Government when the article is sent" (s 3). That language ties the instrument’s operation to the Commonwealth’s protective security policy, an external policy instrument. As a result, an item's exemption as a government article depends on an external policy classification removed from the instrument’s text.

At an operational level, the instrument’s screening standards reference technical capability criteria for equipment. "X-ray observation equipment" is defined by threat image projection capability, material differentiation between organic and inorganic, and the capacity to display metals, inorganic and organic materials in distinct colours (s 3). "ETD equipment" is defined as equipment that detects explosive trace by audible or visual alarm (s 3). Where the conditional exemption is claimed because screening was carried out at a named last port airport, the screening must have used equipment that meets those definitions (s 4(3)-(4)). The instrument therefore creates a technical overlay on top of other regulatory regimes, making certain technology standards a practical part of compliance.

Finally, the instrument’s references to "last port of call airports" draws external interstate and international actors into the compliance chain by naming specific foreign airports where required screening may be performed (s 4(3)). The instrument does not itself modify foreign law, but it conditions Australian entry on conduct taken at those overseas airports. That creates an extraterritorial compliance interface, where the legal sufficiency of an inspection depends on equipment capabilities and procedures described in the instrument and executed in a foreign jurisdiction.

The instrument identifies itself as LIN 22/043 and records its making date as 31 March 2022 (instrument heading; p 1). It states the instrument is the Aviation Transport Security (Prohibited cargo,Afghanistan) Instrument 2022 (s 1), and it specifies commencement as the day after registration (s 2). The instrument contains no internal amendment or repeal provisions, and it does not indicate any prior versions, revocations, or saving clauses. The text supplied is a single, standalone instrument with an initial making date.

Because the instrument is subordinate legislation under the Aviation Transport Security Act 2004 (instrument preamble), any amendment history will be recorded through subsequent legislative instruments or amendments published under the parent Act’s enabling power. The instrument itself does not indicate that it replaces an earlier instrument, nor does it contain any transitional or retrospective clauses. The only internal historical reference is to the Acts Interpretation Act 1901, paragraph 23(b), as a statutory interpretive norm that singular terms include the plural and vice versa (s 3 note). No later amending instrument or variation is included in the text supplied.

Practitioners relying on the instrument should therefore treat the supplied text as the 2022 original instrument and check the official legislative instruments register for any subsequent disallowance, amendment, replacement, or repeal. The instrument’s commencement clause, day after registration, means it is intended for immediate operational effect from the moment of registration (s 2). The instrument does not provide sunset dates or automatic expiry clauses.

The instrument as supplied contains no litigation history, no footnotes or annotations referring to case law, and no section setting out any dispute resolution or review mechanism. There are no judicial decisions cited or referenced within the instrument text. The instrument does not mention adjudicative routes, merits review bodies, or precedent interpreting its provisions.

That absence does not foreclose future litigation; the instrument’s text creates discrete factual and definitional thresholds that could give rise to disputes. For example, whether cargo "originated in or transited through Afghanistan" (s 4(1)) is a factual question that could be litigated in a dispute about whether a particular item falls within the prohibition. Similarly, the conditional exemption in s 4(3) turns on whether the cargo "has been examined under security controls" at one of the listed airports; the instrument defines the permissible examination methods, including a detailed physical examination protocol (s 4(4)-(5)), and disagreements could arise about whether an examination satisfied those criteria. The definitions of "letter product" and "small item" include precise dimensional and weight thresholds (s 3); disputes over measurement or packaging could also generate litigation.

The instrument’s cross-references to external standards and legislation create additional potential litigation vectors. The exemption for dangerous goods depends on permission under s 23 of the Civil Aviation Act 1988 (s 4(2)(f); s 3), and whether goods qualify will require resort to that separate statute and any interpretive case law applying it. The "government article" exemption depends on the item bearing a security classification "referred to in the protective security policy applicable to the Australian Government when the article is sent" (s 3); disputes might arise about whether a particular classification meets that description.

Because the instrument does not contain enforcement or penalty clauses, litigation could also arise over remedy and remedy scope if administrative action is taken under the parent Act to enforce the instrument. The instrument’s silence on administrative process and sanctions could itself be a ground of procedural or administrative challenge in a future case. The instrument supplies no litigation outcomes; practitioners should therefore treat the text as creating factual gates likely to be litigated in the event of enforcement action, but no reported decisions interpreting the instrument are contained within the instrument itself.

The instrument contains several technical drafting features and evidentiary thresholds that may create operational pitfalls.

• Origin and transit language: The prohibition applies to cargo that "has originated in or transited through Afghanistan" (s 4(1)). The instrument does not define "originated in" or "transited through" within its text, so practical disputes may arise about whether stopovers, technical stops, transhipments, or multimodal movements fall within those phrases. The absence of a definition within the instrument itself (s 3 contains other definitions but not these phrases) means parties will need to determine applicability on a case‑by‑case basis and retain documentary evidence of routing.

• Narrowness of airport list: The conditional exemption requires examination at one of the specifically listed "last port of call airports" (s 4(3)). Cargo screened at any other international airport, even if screened to equivalent standards, will not meet this instrument’s conditional exemption unless one of the listed airports performed the screening after the cargo left Afghanistan (s 4(3)-(4)). That produces routing constraints: carriers and shippers planning to rely on the conditional exemption must ensure the cargo’s last international departure before arrival in Australia is one of the listed airports, and that the required examination occurred there.

• Technical equipment requirements: The instrument defines "X-ray observation equipment" by features: threat image projection capability, ability to differentiate between organic and inorganic material, and the capacity to display metals, inorganic and organic materials in distinct colours (s 3). Not all screening equipment will meet these criteria; where a carrier or handler relies on X-ray screening to meet the conditional exemption, they must ensure the equipment used at the specified last port meets the instrument’s technical definition.

• Stringent physical examination protocol: The physical examination option requires deconsolidation into the smallest packing unit, systematic opening and searching of each unit, and a layer-by-layer search that ensures every area and all contents are thoroughly inspected (s 4(5)). For consolidated shipments, this will impose time and labour costs, and could be operationally infeasible for some categories of cargo without prior planning.

• Documentary evidentiary requirements not stated but implied: To claim the conditional exemption under s 4(3), a party will need to show that the item "has been examined under security controls" at a named airport. The instrument does not state what documentation suffices. Practitioners should note the instrument’s requirement is fact-based; absent documentary proof of the required examination, the exemption will be difficult to establish in practice.

• Tight definitions for humanitarian or small shipments: The exemption for "letter product" and "small item" relies on strict dimensional and weight thresholds (s 3). A small error in packaging that adds rigidity or a marginal excess in weight or dimension will remove the exemption. The instrument’s note on flexible items indicates thick cardboard qualifies as flexible but gives examples of rigid items such as pens, keys, USBs and CDs (s 3); those examples should be used cautiously but signal how narrowly the instrument treats rigidity.

• Human remains requirements: Human remains are exempt only if the sender is a funeral director and the transporting airline has sighted a copy of the death certificate (s 3 definition). That places documentary verification burden on airlines before they can rely on the exemption.

• Government article and protective security policy linkage: The instrument exempts "government article" only where a Commonwealth sender and an applicable security classification under the protective security policy are present (s 3). This means that pieces shipped by other governmental entities not constituting "an authority of the Commonwealth", or those lacking the relevant classification, will not be exempt.

• Diplomatic bag: The instrument retains diplomatic bag exemption (s 4(2)(h)); reliance on that exemption will still require compliance with international diplomatic conventions and procedural norms, none of which are set out in the instrument.

• No enforcement text: The lack of penalty or enforcement detail in the instrument itself is a procedural gotcha: parties cannot rely on the instrument’s text to explain how breaches will be detected or sanctioned (instrument overall; s 4). Operational compliance therefore requires consultation with the relevant enforcement authorities or with the Aviation Transport Security Act 2004 to understand enforcement risk.

Compliance under the instrument requires a combination of route planning, operational screening, documentary verification, and packaging discipline, in line with the instrument’s text.

1. Preventive routing and rejection: Aviation industry participants should ensure that cargo originating in or transiting through Afghanistan is not brought into Australian territory unless it falls within an explicit exemption or satisfies the conditional exemption. The prohibition is absolute unless an exception applies (s 4(1)-(3)). Practically, this means carriers and freight handlers must screen consignment routing documentation and bills of lading to detect origin/transit through Afghanistan.

2. Use the exemptions where appropriate: If cargo meets any of the s 4(2) exempt categories, it may be brought in. For each exempt class, confirm the corresponding definitional criteria in s 3 are met:

• For letter products, confirm weight and all three dimensional thresholds and that contents are only flexible items (s 3; s 4(2)(a)).

• For small items, confirm weight and shortest dimension thresholds (s 3; s 4(2)(b)).

• For live animals, ensure necessary packaging and that the item is genuinely a live animal (s 4(2)(c)).

• For human remains, ensure sender is a funeral director and the airline has sighted the death certificate (s 3; s 4(2)(d)).

• For biological tissue, ensure the cargo consists of biological matter as defined, and is accompanied by necessary packaging (s 3; s 4(2)(e)).

• For dangerous goods, confirm permission under section 23 of the Civil Aviation Act 1988 and compliance with packaging rules (s 4(2)(f)).

• For government articles, confirm the sender is the Commonwealth or an authority of the Commonwealth and that the article bears an applicable protective security policy classification (s 3; s 4(2)(g)).

• For diplomatic bags, confirm the item qualifies as a diplomatic bag under international practice and the instrument’s exemption (s 4(2)(h)).

3. If the exemption does not apply, use the conditional pathway: To rely on the conditional exemption in s 4(3), ensure that, after originating from or transiting through Afghanistan and before arrival in Australian territory, the cargo is examined under security controls at one of the listed last port of call airports. That requires:

• Routing the cargo so its last international departure before Australia is one of the named airports in the table (s 4(3)).

• Ensuring the examination at that airport used one of the accepted methods: X-ray observation equipment meeting the instrument’s technical criteria, ETD equipment, or a physical examination complying with the deconsolidation and systematic layer-by-layer search procedures described in s 4(4)-(5) and s 3 definitions.

4. Ensure equipment and procedural standards are met: Where X-ray is used, confirm that the machine has threat image projection capability; differentiates between organic and inorganic material; and can display metals, inorganic and organic materials in separate colours (s 3). Where ETD is used, the equipment must detect and indicate the presence of explosive material by audible or visual alarm (s 3). Where physical inspection is used, follow the prescribed steps: full deconsolidation to smallest packing units; checking for hidden compartments and tamper signs; opening and searching all interior areas; and conducting a sequenced, layer-by-layer search to ensure every area and content is inspected (s 4(5)).

5. Obtain and keep verifiable evidence: Although the instrument does not specify documentary form, the conditional exemption depends on a factual showing that an examination meeting the instrument’s standards occurred at a listed airport (s 4(3)-(5)). To be able to demonstrate compliance, obtain contemporaneous records from the examining authority or handling agent at the last port of call, including equipment used, signatures, timestamps, and any inspection reports. For human remains, retain the death certificate sighted by the airline (s 3). For government articles, retain evidence of sender identity and classification under the relevant protective security policy (s 3).

6. Packaging and consolidation management: Because physical inspection requires deconsolidation into smallest units (s 4(5)(a)), plan packaging and consolidation procedures so that required inspections can be performed without damaging goods or breaking contractual packing requirements. Where shipments are likely to require inspection, consider separate handling or packaging that allows efficient deconsolidation and re-sealing.

7. Train staff and update procedures: Ensure that staff tasked with routing and screening understand the weight and dimension thresholds, the equipment capabilities required for X-ray screening, and the procedural steps for physical examinations (s 3; s 4(4)-(5)). Allocate responsibility for confirmation that the last port of call inspection has occurred at one of the listed airports, and for maintaining the records required to demonstrate that fact.

8. Review cross-referenced statutory permissions: For dangerous goods claiming the exemption, verify permission under s 23 of the Civil Aviation Act 1988 and ensure necessary packaging is in place (s 4(2)(f)). For government articles, confirm compliance with the relevant protective security policy classification at the time of sending (s 3).

9. Risk management and contingency planning: Because the instrument’s exemption routes are narrow and the instrument contains no internal enforcement detail, build operational contingencies for rejected consignments, including return routing, storage, or destruction procedures where cargo cannot legally enter Australia. Ensure contractual parties understand routing constraints and evidentiary burdens so that liability for non-compliance is allocated in contracts of carriage.

Following these steps aligns operational practice with the instrument’s text and the defined screening and documentary criteria set out in ss 3-5.
