What it does
This Act provides three narrow, mechanical functions. First, it sets its short title: the Aviation Transport Security (Consequential Amendments and Transitional Provisions) Act 2004 (s 1). Second, it declares commencement arrangements for its own provisions and for Schedules that amend other Acts, by reference to a commencement table inserted in s 2(1). The table records that sections 1 to 3 and anything in the Act not elsewhere covered by the table commenced on the day of Royal Assent, 10 March 2004, and that Schedules 1, 2 and 3 commence at the same time as section 3 of the Aviation Transport Security Act 2004, recorded as 10 March 2005 (s 2(1) and the commencement table). Third, it confirms the legal operation of the Schedules: each Act specified in a Schedule is amended or repealed as set out in the applicable items in that Schedule, and any other item in a Schedule has effect according to its terms (s 3).
Mechanically, therefore, the Act does not itself set out policy detail or operational rules; it operates as a consequential and transitional instrument. The Schedules (not reproduced here) are the operative instruments that change other statutes; this Act supplies the enactment vehicle and the timing mechanism. The Act also includes two enactment-adjacent notes recorded beneath the table. One note states the table relates only to provisions as originally passed and will not be expanded to deal with provisions inserted after assent. The other, s 2(2), records that column 3 of the table is for additional information that is not part of the Act but may be included in published versions. Those notes shape how practitioners should treat the commencement table as an evidentiary and publishing artefact.
Read together, the Act fixes (a) the short title, (b) the timing for its internal provisions and the Schedules, and (c) the legal effect of items in the Schedules in amending or repealing other Acts. It leaves the content of those amendments to the Schedules and ties Schedules 1 to 3 to the timing of a specific section of the Aviation Transport Security Act 2004, rather than to the Act’s own date of Royal Assent.
