What it does
This instrument, the Autonomous Sanctions (Sanction Law) Declaration 2012, performs a single, specific legal function: it designates particular provisions of two existing Commonwealth instruments as “sanction laws” for the purposes of section 6 of the Autonomous Sanctions Act 2011. That designation is effected by section 3 of the Declaration, which states that each provision mentioned in an item in Schedule 1, “being a provision of a law of the Commonwealth mentioned in that item, is specified as a sanction law” for the Act (section 3; Schedule 1).
Mechanically, the Declaration:
- is itself an instrument made under section 6 of the Autonomous Sanctions Act 2011 (see instrument header);
- commences “on the day after it is registered” (section 2);
- lists in Schedule 1 the precise cross‑references that are to be treated as sanction laws (Schedule 1, items 1-2).
Schedule 1 names two source instruments and specific regulation numbers within them:
- Autonomous Sanctions Regulations 2011: Regulations 12, 12A, 13, 13A, 14, 15 and 16 (Schedule 1, item 1);
- Customs (Prohibited Exports) Regulations 1958: Regulations 11, 11A, 11B and 13E (Schedule 1, item 2).
The compilation notes record the instrument’s registration and commencement dates and that it was amended by the Autonomous Sanctions (Sanction Law) Amendment Declaration 2012 (No. 1), which was registered on 24 August 2012 and commenced on 25 August 2012. The compilation was prepared on 28 August 2012 and takes account of that amendment (Notes; Table of Instruments).
In short, the Declaration does not itself create new substantive prohibitions or penalties. Its legal effect is to attach, for the purposes of the Autonomous Sanctions Act 2011, the listed provisions from those two Commonwealth subordinate instruments as “sanction laws”. Any operational or compliance effects for third parties therefore arise through the content and application of the listed provisions in their parent instruments together with the Autonomous Sanctions Act 2011, not from the Declaration’s text alone (see section 3 and Schedule 1).
