What it does
This instrument, the Autonomous Sanctions (Designated and Declared Persons - Ukraine) List 2019, registers a set of designations and declarations that operate under the Autonomous Sanctions Regulations 2011. It is made by the Minister for Foreign Affairs and dated 15 March 2019 (instrument header and signature). The instrument commences on the day after it is registered (section 2). Its legal basis is subregulation 6(1) of the Autonomous Sanctions Regulations 2011 (section 3). Section 4 states the operative legal effect: for regulation 6 of the Autonomous Sanctions Regulations 2011, each person named in Schedule 1 is taken to be responsible for, or complicit in, the threat to the sovereignty and territorial integrity of Ukraine, and each such person is designated as a "designated person" and declared as a "declared person" for Ukraine (section 4). Section 5 directs that Schedule 2 amends the Autonomous Sanctions (Designated Persons and Entities and Declared Persons - Ukraine) List 2014 (section 5).
Mechanically, the instrument operates in two linked ways. First, Schedule 1 lists ten named individuals with identifying particulars (name variants, dates of birth and, in some entries, place of birth). Those entries are the persons whose designation and declaration are stated to "have effect" for regulation 6 (section 4; Schedule 1). Second, Schedule 2 effects an amendment to the 2014 consolidated list by inserting corresponding entries into Part 1, after item 153 (Schedule 2, item [1]). The Schedule 2 table inserts these individuals as items 154-163 in Part 1 of Schedule 1 of the 2014 list (Schedule 2). The instrument therefore both makes a contemporaneous declaration (Schedule 1) and updates the maintained list that the Regulations reference (Schedule 2).
The instrument contains no standalone statement of penalties or operative prohibitions in its text; instead it creates or confirms a status (designated/declared) which is tied back to regulation 6 of the Autonomous Sanctions Regulations 2011 (sections 3-4). The instrument attributes responsibility or complicity for the perceived threat to the sovereignty and territorial integrity of Ukraine to the listed individuals; that attribution is the criterion used to declare and designate them under regulation 6 (section 4). The legal consequences that attach to the statuses of "designated person" and "declared person" therefore flow from the Regulations and the maintained list that this instrument amends (section 5), not from additional operative provisions contained in this instrument itself.
