#### 5.1 Request for reconsideration of decision by Secretary (1) If the Secretary makes a decision of a kind mentioned in regulation 5.3 or 5.6, the Secretary must give the person affected by the decision notice in writing of the decision setting out the reasons for the decision. (2) The notice must include a statement to the effect that: (a) if the person is dissatisfied with the decision, the person may request a reconsideration of the decision by the Secretary; and (b) if the person is dissatisfied with a decision made by the Secretary on that reconsideration confirming or varying the first decision, the person, subject to the Administrative Appeals Tribunal Act 1975, may apply to the Administrative Appeals Tribunal for a review of the decision. (3) If the person affected by a decision of the Secretary is dissatisfied with the decision, the person may request the Secretary to reconsider the decision. (4) A request must: (a) be in writing; and (b) set out the reasons for the request; and (c) be given to the Secretary within 30 days after the person is notified of the decision or within such further period as the Secretary allows.
