What it does
This instrument, the Automatic Mutual Recognition (Tasmania) (Exemptions,One-Year) Declaration 2022, excludes certain classes of registration from the automatic deemed registration mechanism under the Commonwealth Mutual Recognition Act 1992 for a specified one-year period in Tasmania. The declaration was made by the Treasurer (Tasmania), Michael Ferguson, and is expressly made under section 42S of the Mutual Recognition Act 1992 (see s 3 of the instrument and the signature block). It commences on 1 July 2022 (s 2) and is explicitly time-limited: section 6(4) provides that section 6 is repealed at the end of 30 June 2023. The simplified outline in section 4 sets out the instrument’s purpose as exempting registrations for one year from the automatic deemed registration provisions of the Mutual Recognition Act, and notes the instrument has effect only in relation to Tasmania.
Mechanically, the instrument operates by listing specific registrations that, for the period, are "excluded from the operation of automatic deemed registration in Tasmania" (s 6(1)). The exclusions are set out in the table in s 6(3). For each listed registration, s 6(2) contains a statutory statement of the particular risk that, according to the instrument, justifies the exclusion; those statements reference risks to consumer protection, the environment, animal welfare, and the health or safety of workers or the public. The registrations listed are specific categories under Tasmanian statutes: Licensed Conveyancer under the Conveyancing Act 2004 (s 6(3) Item 1); four classes of Licensed Builder under the Occupational Licensing Act 2005 (s 6(3) Items 2 to 5); and Licensed Real Estate Agent, Licensed Property Manager, Licensed General Auctioneer and Licensed Property Representative under the Property Agents and Land Transactions Act 2016 (s 6(3) Items 6 to 9).
