What it does
This Act imposes an annual supervisory levy on authorised deposit‑taking institutions, and sets the framework for how that levy is determined, indexed and imposed. The levy is imposed by reference to the collection machinery in the Financial Institutions Supervisory Levies Collection Act 1998, with the amount payable by each ADI worked out as the sum of two components, a restricted levy component and an unrestricted levy component (s6; s7(1)). The Treasurer is given primary administrative power to determine key numeric and methodological parameters by legislative instrument: the restricted levy percentage, unrestricted levy percentage, maximum and minimum restricted levy amounts, and how an ADI’s levy base is to be worked out (s7(3)). The Treasurer’s determination of the maximum restricted levy amount is constrained by a statutory upper limit for each financial year, which for the 2020 financial year is specified at $10,000,000 and for later years is indexed by an indexation factor (s5 statutory upper limit; s7(4)).
Mechanically, the Act: defines who is an ADI by reference to the Banking Act 1959 (s5); defines the relevant timing concepts such as levy imposition day and index number to be used for indexation (s5); sets out pro‑rata treatment where an entity becomes an ADI part‑way through a financial year using a formula (s7(2)); prescribes how to calculate the indexation factor used to index the statutory upper limit, including the CPI quarters to use and a 3.0 percentage point uplift incorporated into the indexation factor (s8). The Act binds the Crown (s3) and extends to external Territories (s4). It contains commencement rules including an automatic commencement if not proclaimed within 24 months and a power for regulations to specify modifications where the Act commences during a financial year (s2).
The Act leaves key magnitude, aggregation and timing choices to the Treasurer’s subsequent legislative instruments and to regulations for certain commencement year adjustments (s7(3); s2(3); s9). Collection and enforcement of the levy are routed to the Financial Institutions Supervisory Levies Collection Act 1998 by s6; the present Act does not itself set out collection procedures or penalties.
