What it does
This Determination, made under subsection 9(1) of the Australian Transaction Reports and Analysis Centre Industry Contribution Act 2011 (the Act), prescribes the method for calculating the amount of the instalment of the industry contribution levy payable by leviable entities for the financial year beginning 1 July 2016. It is a legislative instrument that operationalises the levy framework for that single year only. The Determination defines two components that are added together to arrive at the instalment amount: an earnings component, which is a percentage of the entity’s profit before tax (PBTDA or EBITDA depending on the type of entity), and a transaction reporting component, which is a fee per report plus a percentage of the value of each report given under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act). The instrument then layers a series of thresholds, caps, and exemptions that can reduce or eliminate the amount payable. A payment threshold of $1,000 means that if the calculated amount is less than $1,000, the instalment is nil. An earnings component threshold of $100 million means entities with earnings below that level have a nil earnings component. Separate exemptions apply to entities that only provide designated services as a remittance affiliate, to Market Generators under the National Electricity Rules, and to bodies corporate established for a public purpose by a Commonwealth Act. For the largest entities - those with earnings exceeding $5 billion - the total instalment is capped at $9,926,801.15, with a special formula for groups to divide that cap among the members. The Determination also contains rules for groups of leviable entities, foreign companies, and acquired entities. Mechanically, the instrument replaces any earlier determination for previous years, but the text itself does not refer to prior instruments. Its practical effect is to impose a formula-based levy on Australia’s reporting entities under the AML/CTF Act, raising revenue to fund the operations of AUSTRAC. The compliance burden falls on those entities to calculate, report, and pay the instalment accurately by the due date set out in the Act.
