71Delegation by the Chief Executive

#### 71 Delegation by the Chief Executive (1) The Chief Executive may, by instrument in writing, delegate to an employee of the Agency all or any of the Chief Executive’s powers under this Act. (2) The Chief Executive must not delegate powers under subsection (1) to an employee of the Agency unless the Agency has, by resolution, determined that it is desirable, for the efficient running of the Agency, that powers of the Chief Executive be delegated under this section to the person holding the office or position in the Agency that the employee holds. (3) The delegate is, in the exercise of a power so delegated, subject to any directions given by the Chief Executive.
