#### 10B Formation of Foundation (1) The Minister may arrange for the formation of a company limited by guarantee, where: (a) all the interests and rights of the members in or in relation to the company are beneficially owned by the Commonwealth; and (b) the purpose of the company is to raise money to support: (i) research relating to the use of drugs in sport; and (ii) initiatives that increase the skills and knowledge of people about matters relating to the use of drugs in sport. (2) Subsection 9(6) applies to the activities of the company in a corresponding way to the way in which that subsection applies to the functions of the Agency. (3) Subsection (1) does not, by implication, limit the Agency’s powers.
