44 APS employees to be engaged on probation
(1) Subject to subsection (2), an Agency Head engaging an APS employee (other than an employee engaged for duties that are irregular or intermittent) must ensure that the employee is engaged on probation.
Note: Subsection 22(6) of the Act allows the engagement of an APS employee to be made subject to conditions dealing with probation.
(2) The Agency Head may waive the requirement under subsection (1) if the Agency Head is satisfied that there are reasonable circumstances justifying the waiver. (3) If an APS employee is engaged on a period of probation by an Agency Head to perform specified duties, the Agency Head must ensure that, during that period, processes are in place to assess the suitability of the APS employee to perform those duties.
Note: The Commissioner may, from time to time, issue guidance on matters relating to probation.
