What it does
This instrument, formally titled the Australian Prudential Regulation Authority instrument fixing charges No. 2 of 2020, is a legislative instrument made by a delegate of the Australian Prudential Regulation Authority under paragraphs 51(1)(a) and (b) of the Australian Prudential Regulation Authority Act 1998. It fixes the charges payable by authorised deposit-taking institutions (ADIs) for two specific categories of service provided by APRA during the 2019 calendar year: the review of applications made under paragraph 17 of Attachment A to Prudential Standard APS 210 - Liquidity, and the review of applications made under paragraph 19 of that same attachment. Both services involve APRA’s assessment and determination of the appropriate size of the Committed Liquidity Facility (CLF) that an ADI sought from the Reserve Bank of Australia, and the amount of the CLF that may be recognised for Liquidity Coverage Ratio (LCR) purposes.
The instrument creates a tiered charging structure that varies according to APRA’s own estimate of how many “APRA days” it will take to assess a particular application. For each of the two service categories, four charge bands apply: $11,000 when the estimated days are 10 or fewer; $16,500 when the estimate is between 11 and 15 inclusive; $33,000 between 16 and 30 inclusive; and $88,000 between 31 and 80 inclusive. All amounts are stated to be inclusive of GST, charged per entity, and non-refundable regardless of whether the ADI ultimately obtains approval. The charge becomes payable 14 days after the ADI receives APRA’s invoice, and the invoice may be issued at any time after the instrument commences (which is the date of registration on the Federal Register of Legislation). The instrument itself is a cost-recovery mechanism under APRA’s general charging power rather than a prudential standard or a policy change. It does not amend any primary legislation, create new regulatory obligations, or alter the substantive test for CLF approval. Its sole mechanical effect is to impose a fixed dollar liability on ADIs that had applied for CLF determinations in 2019, based on APRA’s unilateral estimate of assessment effort, and to make that liability immediately enforceable by invoice.
