What it does
This instrument, Australian Prudential Regulation Authority (confidentiality) determination No. 3 of 2015, is a delegated APRA decision under section 57 of the Australian Prudential Regulation Authority Act 1998. It identifies a class of reporting documents that are treated as not containing confidential information, subject to a specific list of items which remain confidential. The reporting documents covered are those provided to APRA under Reporting Standard ARS 320.0 Statement of Financial Position (Domestic Books), or a substantially similar replacement, made under section 13 of the Financial Sector (Collection of Data) Act 2001. Coverage is limited to documents received by APRA in the period after the date of the last determination made under section 57 in respect of ARS 320.0 and before the date of this determination. The documents must relate to a locally‑incorporated bank or a foreign Authorised Deposit‑taking Institution, as defined by the Reporting Standard; those documents that meet all the Schedule conditions are covered.
Mechanically, the determination does two things. First, it declares that the reporting document described in Part 1 of the Schedule does not contain confidential information. Second, it creates a carve‑out: the specific items listed in Part 2 of the Schedule remain confidential. The instrument states that its effect is to enable publication of the non‑confidential information under subsection 56(5C) of the APRA Act. The determination has effect from the date of registration on the Federal Register of Legislative Instruments under the Legislative Instruments Act 2003. It is signed and dated by a delegate of APRA, Juanita Hoare, Senior Manager, Analysis & Publications, Statistics, Policy, Statistics & International, dated 19 February 2015.
The practical legal effect is that APRA treats covered ARS 320.0 reporting documents as largely non‑confidential for publication purposes, with a narrow set of balance sheet and equity items retained as confidential. The statutory bases cited in the instrument are section 57 of the APRA Act, for making the determination, section 13 of the Financial Sector (Collection of Data) Act 2001 for the underlying reporting standard, and subsection 56(5C) of the APRA Act as the route by which APRA may publish non‑confidential information.
