What it does
This instrument, Australian Prudential Regulation Authority (confidentiality) determination No.12 of 2015 (the determination), is a delegate-made determination under the Australian Prudential Regulation Authority Act 1998 (the APRA Act). The delegate exercises powers under section 57 of the APRA Act and paragraph 57(2)(b) to revoke an earlier determination (No.26 of 2013) and to declare that specified reporting documents, and specified parts of reporting documents, “does not and do not contain confidential information” (the operative declaration). The determination takes effect on registration on the Federal Register of Legislative Instruments (the instrument itself records the commencement mechanism).
Mechanically, the instrument does three things:
- It revokes APRA (confidentiality) determination No.26 of 2013 (the earlier instrument). The revocation is expressed in terms of paragraph (a) of the opening operative paragraph.
- It specifies, by reference to schedules, the reporting documents (Part 1) and parts of reporting documents (Part 2) that are declared not to contain confidential information for the purposes of APRA’s confidentiality regime (paragraph (b) of the opening operative paragraph).
- It records that the effect of the instrument is to make non-confidential information (other than personal information within the meaning of the Privacy Act 1988) available for publication under subsection 56(5C) of the APRA Act (the Note in the instrument).
The scope of the determination is explicitly limited. It applies to information provided to APRA by life insurers and friendly societies in reporting forms required by particular Reporting Standards (LRS-series reporting standards). Application is subject to a timing condition: the determination applies where “a period of at least 14 days has elapsed from the date the life insurer or friendly society was required to provide the information required under the reporting standards in accordance with paragraph 5 of Reporting Standard LRS 001 Reporting Requirements.” The Schedule lists current reporting standards (those effective from 1 January 2013) and a range of superseded reporting standards (effective in earlier periods). The Schedule is divided into Part 1 (which reporting documents the determination covers) and Part 2 (which parts of reporting documents are non-confidential), with detailed line items showing whether “all data items” or “total amount only” or particular sections are covered.
