Australian Passports (Application Fees) Act 2005

The Act revolves around a small set of statutory concepts that determine its operation and legal character. Those concepts are defined or created in the Act and are necessary to understand the legal mechanics.

Application fee. The Act defines the term narrowly as a fee imposed by section 4 (s 3(1)). Section 4 is the operative imposition clause, and it authorises the Minister’s determination to specify fees for four distinct categories: passport applications, other travel‑related documents, endorsements on travel documents, and observations on travel documents (s 4(1)-(4)). Because the Act ties the definition to s 4, the scope of what counts as an application fee is governed by the scope of s 4.

Minister’s determination. The Act gives this term a statutory meaning, being an instrument made by the Minister for the purposes of this Act under s 8 (s 3(1)). Section 8 requires the Minister to make determinations by legislative instrument. The choice of instrument type embeds the determinations within the statutory instrument framework, and it makes those instruments the authorised source of specified fees (s 4).

Fees imposed as taxes. The Act does not call the amounts "charges" or "user‑pays fees" only; it expressly provides that the fees specified in determinations made under s 4 are imposed, and are so imposed as taxes (s 4(5)). That characterisation is statutory, and it will influence legal characterisation for administrative, accounting, and perhaps constitutional purposes.

Maximum fee and indexation. The Act places a cap on the maximum amount that an application fee may be in a given financial year. The cap is concrete in the first year, $1,000 (s 5(2)(a)). For subsequent years the maximum is the result of a formula that multiplies the previous year’s maximum by an indexation factor derived from the All Groups Consumer Price Index, with a rounding rule to three decimal places and a specific rule preserving the previous maximum if the factor is one or less (s 6(1)-(3)). The Act therefore builds an automatic inflation adjustment into the statutory maximum.

Discretion to differentiate. The Act permits determinations to specify different application fees for different circumstances (s 5(1)). The permitted differentiators are not listed in the Act. That creates delegated discretion for the Minister to set varied fees across applicant classes, document types, processing categories or other circumstances chosen within the instrument.

Non‑cost‑related fees. Section 5(3) explicitly removes any statutory requirement that an application fee bear any relationship to the cost of issuance, endorsement or observation. That lets decision‑makers set fees that capture broader policy objectives, revenue needs, or cross‑subsidies rather than just recovering costs.

Liability timing. The person liable for the fee is the applicant, and liability arises at the time of application (s 7(1)-(3)). The Act does not set out payment mechanisms, refund rules, or explicit enforcement pathways within its text, it simply fixes the person and moment of liability.

Interaction with Australian Passports Act 2005. The Act defers certain definitions to the Australian Passports Act 2005 (s 3(2)) and synchronises commencement for most provisions with specified sections of that Act (s 2). That means operational meaning for terms such as "Australian travel document" or other defined terms will be taken from that parent Act.

Regulations power. The Governor‑General may make regulations to carry out or give effect to the Act (s 9). The Act itself is spare on process and administrative detail, and so the regulation power is the statutory route for filling practical gaps.

Those concepts combine to create a statutory architecture where the Minister, by legislative instrument, fixes taxable application fees within a capped and index‑adjusted envelope, with liability placed on applicants at the time of application, and with permitted differentiation and no statutory link to cost recovery.

The Act identifies two categories of directly affected persons: applicants for Australian travel documents and the Minister who sets fees by determination. The statutory allocation of roles and liabilities makes clear who pays and who decides.

Applicants. Any person who applies for an Australian travel document, who applies for an endorsement on their Australian travel document, or who applies for an observation to be made on their Australian travel document is liable to pay the application fee at the time the application is made (s 7(1)-(3)). The Act uses non‑restrictive language, "a person who applies", which captures natural persons and entities that are legally entitled to apply under the Australian Passports Act 2005 (the Act defers to that Act for undefined terms, s 3(2)). Because liability is triggered at the time of application, applicants bear the immediate cash flow burden of the fee regardless of subsequent outcomes.

The Minister. The Minister is given exclusive power to make the determinations that specify the fees, and must do so by legislative instrument (s 4(1)-(4), s 8). That delegations structure makes the Minister the central decision‑maker for fee design, including differential treatment of applicants consistent with s 5(1). By authorising the Minister to set fees that are "imposed as taxes" (s 4(5)), the Act changes the legal character of the amounts the Minister sets.

Potentially affected government bodies. Although not named in the Act, operational bodies that process passport applications are de facto implicated because applicants will need to pay at time of application. The Act leaves operational mechanisms, how the fee is collected, receipts, refunds, and accounting,to regulations or administrative practice; s 9 gives the Governor‑General power to prescribe matters necessary to carry the Act into effect. The Act does not specify which agency collects revenue or how it is recorded; that will fall to the administrative arrangements established under the Australian Passports Act 2005 and any regulations.

Third parties and stakeholders. The Act allows determinations to specify different fees for different circumstances (s 5(1)). That creates the potential for third parties, such as travel agents, legal representatives, or document‑service providers,to be affected by fee levels and distinctions because they may need to pass fees on, advise clients, or absorb fees when acting on behalf of applicants. The Act itself does not address who may accept payment on behalf of applicants.

Wider public fiscal impact. Because fees are explicitly imposed as taxes (s 4(5)), their collection will be revenue for the Commonwealth rather than being confined to cost‑recovery accounting. That affects the government's fiscal position, and it will determine how revenue is treated in budgets and financial accounting. The Act does not specify any hypothecation or ear‑marking of the revenue.

In sum, the Act places direct financial obligations on applicants at application time, vests fee design and differentiation power in the Minister via legislative instruments, and leaves operational and administrative collection modalities to regulation and the parent passport legislation. The legal characterisation as taxes alters the public‑financial framing of the receipts.

The Act creates a narrow set of obligations and powers. It does not create broad new rights; rather it establishes duties to pay, and decision‑making powers for the Minister and the Governor‑General, with delegation to legislative instruments for particulars.

Applicants’ duty to pay. A person who lodges an application for an Australian travel document, an endorsement, or an observation must pay the applicable application fee at the time the application is made (s 7(1)-(3)). The duty attaches at application lodgement; the Act does not create exceptions in text for inability to pay, deferred payment, or installment arrangements. The duty is legal, not merely procedural; failure to pay would leave the specified statutory liability unpaid. The Act does not itself set out consequences of non‑payment, such as refusal, cancellation, or penal sanctions; those consequences must be found or implemented elsewhere, or in administrative practice.

Ministerial duty and power to determine fees. The Minister has the power to specify fees by legislative instrument for each of the fee categories listed in s 4. While the Act uses permissive language ("may specify"), it creates the structure for the Minister to act. Section 5(1) gives the Minister power to set different fees for different circumstances, which is a delegated regulatory discretion that should be exercised within the confines of any applicable administrative law requirements external to the Act. The Act gives no textual constraint on which circumstances justify differentiation, only that differentiation is permitted.

Duty to respect statutory maximum. The Minister’s determinations must operate within the statutory maximum for any financial year. The initial maximum is $1,000 for the first operative financial year (s 5(2)(a)). For subsequent years, the maximum is the indexed amount calculated under s 6. The determinations must not exceed the statutory maximum; the Act links the determinations to the cap by describing the maximum amount for an application fee in a financial year as the specified figure.

Regulatory power. The Governor‑General may make regulations "prescribing matters necessary or convenient to be prescribed for carrying out or giving effect to this Act" (s 9). That is a broad enabling regulation power, allowing the executive to supply procedural, administrative, or complementary detail that the Act does not specify.

Right‑characterisation as taxes. The Act’s declaration that fees are imposed as taxes (s 4(5)) is not a duty but an express legal characterisation. This affects rights and duties indirectly: for example the categorisation may affect how fees are treated in financial and legal analyses, including questions about appropriations, budgeting, or parliamentary control. The Act does not itself stipulate rights of objection, review, refund or appeal regarding fees set under a Minister’s determination.

Indexation duty. The Act prescribes a specific method for working out the maximum fee in later financial years (s 6). The indexation mechanism requires use of the All Groups Consumer Price Index ("index number") as first published for the relevant quarter, and a rounding rule for the factor to three decimal places (s 6(3)). The Minister or administering agency will therefore need to apply that calculation to determine the cap each year.

Administrative duties implied but not spelled out. The Act is silent on collection mechanisms, receipting, refunding, remission, debt recovery, enforcement processes, or auditing of fee income. Those matters fall to regulations or administrative arrangements, but the absence of statutory guidance means that the practical duties for officials will be established outside this Act.

In summary, the Act places a clear duty on applicants to pay the fee at the time of application, gives the Minister regulated discretion to set fees within a statutory maximum that is subject to indexation, and provides for regulation‑making to supply implementation detail. Rights in relation to fee setting, refunds, or challenges are not specified in the Act.

The Act itself sets out the liability to pay and the timing of payment, but it does not establish explicit criminal sanctions, administrative penalties, or enforcement procedures within its text. The enforcement-related provisions are therefore sparse and implicit rather than prescriptive.

Statutory liability. The Act creates the legal obligation: a person who applies for a passport, a travel‑related document, an endorsement, or an observation is liable to pay the application fee at the time of application (s 7(1)-(3)). That liability is the Act’s primary enforcement hook, in that it fixes who is legally responsible and when payment must be made.

No express penalties in the Act. Nowhere in the Act are penalties, offences, fines, or specified enforcement remedies set out for failure to pay the application fee. The Act does not prescribe that an application be refused, returned, or ignored where no fee is paid; it leaves those operational consequences unarticulated in the statutory text. The absence of tailored enforcement provisions means that any enforcement must be founded in other legal provisions, administrative practice, departmental policy, or regulations made under s 9.

Regulations power. The Governor‑General may make regulations for carrying out or giving effect to the Act (s 9). That regulation power is the likely route for operationalising enforcement mechanisms, such as specifying payment methods, consequences of non‑payment (including refusal to process an unpaid application), refund or remission processes, and debt recovery practices. The Act itself does not specify that those matters will be dealt with by regulation, but s 9 authorises regulations necessary to give effect to the Act.

Tax characterisation and legal consequences. The Act expressly states that fees specified in determinations are imposed as taxes (s 4(5)). That legal character may have consequences for enforcement, as tax liabilities are often collected and enforced under particular Commonwealth financial and tax collection frameworks. The Act does not, however, set out which collection or enforcement machinery applies to these taxes. Any reader considering enforcement should note that the Act’s tax characterisation is explicit, but the means of collection and enforcement are not.

Administrative recourse and review. The Act does not provide for refunds, remissions, internal review or merits review in the text. If appeal or review mechanisms are needed, they must be found in other statutory instruments, departmental policy, or regulations. The Act also does not prescribe any auditing, reporting, or oversight regime for the fees collected.

In short, the Act imposes a payment obligation and defines the Minister’s power to fix the amounts, while leaving the concrete enforcement mechanics, penalties for non‑payment, and administrative processes to be supplied outside the Act, most likely by regulations or existing administrative frameworks.

The Act is concise and explicitly interacts with the Australian Passports Act 2005, and implicitly interacts with other legal and administrative frameworks by delegating detailed implementation to legislative instruments and regulations.

Reference to the Australian Passports Act 2005. The Act stipulates that expressions used in it that are defined in the Australian Passports Act 2005 have the same meaning as in that Act (s 3(2)). That creates an explicit lexical and operational tie to the parent statute. Terms such as "Australian travel document" and other subject‑matter definitions are therefore governed by the Australian Passports Act 2005. Additionally, the commencement of most of this Act’s operative provisions was tied to the commencement of sections 3 to 58 of the Australian Passports Act 2005 (s 2(1) table). Consequently, the practical operation of fee imposition is integrated with the procedural and substantive regime established under the Australian Passports Act 2005.

Legislative instruments. The Minister’s determinations are required to be made by legislative instrument (s 8). That designation places the determinations within the broader Commonwealth statutory instrument architecture, which is itself governed by Commonwealth legislation about legislative instruments. The Act does not describe parliamentary oversight, tabling, or disallowance procedures, but making the determinations as legislative instruments means they exist within that framework. The Act does not specify interaction with any particular statute governing the lifecycle of legislative instruments.

Regulations power. Section 9 authorises the Governor‑General to make regulations necessary or convenient for carrying out or giving effect to this Act. Regulations made under s 9 will interact with the Act by providing procedural and administrative detail absent from the text, such as payment processes, collection, and any specified administrative remedies. The Act does not identify which other Acts the regulations may modify or interact with, so any cross‑reference to financial management, taxation collection, or administrative procedure legislation would depend on the specific content of regulations made under s 9.

Public finance and tax law. By declaring the fees to be imposed as taxes (s 4(5)), the Act changes the legal character of amounts collected. That characterisation will interact conceptually and possibly operationally with Commonwealth public finance, appropriation, and accounting principles. The Act itself does not spell out how revenue will be budgeted or appropriated, nor how it will be recorded in public accounts. Practitioners should expect interaction between fee collections under this Act and the Commonwealth’s financial and treasury legislation and practices, but such interactions are not specified in the Act.

Administrative law. The Act confers powers and discretions to the Minister and to the executive via regulations. Those exercises of power will be subject to general administrative law principles, judicial review, and any review mechanisms set out elsewhere. The Act does not create or exclude merits review or judicial review routes; any such processes will be governed by general law and other statutory schemes.

Indexation and statistical releases. The indexation mechanism in s 6 depends on the All Groups Consumer Price Index number "first published by the Australian Statistician for the quarter". That creates a technical interaction with the Australian Bureau of Statistics’ publication schedule and practices. The Act relies entirely on those published figures to calculate the indexation factor, and prescribes a rounding convention. Any changes to CPI methodology or to the publishing authority would be relevant to application of s 6, but the Act does not itself create contingencies for changes in statistical practice.

In conclusion, the Act is intentionally compact and depends on the Australian Passports Act 2005 for definitions and operation, places determinations within the legislative instrument framework, leaves implementation and enforcement detail to regulation, and characterises fees as taxes which has implications for public finance interactions. The specific practical interactions with taxation, appropriations, and administrative frameworks will arise from other statutes, regulations, and administrative practice rather than from this Act’s text.

The Act as provided is presented in its original, enacted form and includes its own commencement table and a note about the table. The information available in the Act text shows the initial legislative timeline and a statement about how the Act’s commencement table should be interpreted; it does not record any subsequent amendments within its text.

Assent and commencement. The Act is identified as Australian Passports (Application Fees) Act 2005, No. 6, 2005, and notes assent on 18 February 2005. The commencement provisions are set out in s 2 and a commencement table. Sections 1 and 2 and anything else not covered by the table commenced on the day the Act received Royal Assent, 18 February 2005. Sections 3 to 9 commenced at the same time as sections 3 to 58 of the Australian Passports Act 2005; the table sets that date as 1 July 2005 (s 2(1) table).

Act’s commencement table caveat. The Act includes a legislative note: "This table relates only to the provisions of this Act as originally passed by the Parliament and assented to. It will not be expanded to deal with provisions inserted in this Act after assent" (s 2 note). That is a procedural rather than substantive point, advising readers that the printed commencement table reflects the Act as originally enacted and will not be updated in the printed table to reflect later insertions. It is common in statutory practice to disclaim automatic updating of such tables; here the Act makes that explicit.

No amendment record in the text. The text supplied does not contain any subsequent amendment notes, replacement text, or inserted provisions. The Act’s structure (nine sections) is compact and self-contained in the supplied text. There are no s 10 or later sections that record amendment history. Absent an external amendment register or consolidated text, the Act as presented should be treated as the original enacted instrument.

Second reading speech references. The Act records that the Minister’s second reading speech was made in the House of Representatives and the Senate on specified dates (House 2 December 2004; Senate 9 December 2004), but these references are contextual and do not amount to legislative amendments. They may be relevant to legislative history but are not operative changes to the Act.

What to look for when researching amendments. Because the Act’s own text does not include later amendments, anyone needing the current law should consult a consolidated or updated version of the statute as maintained in official legislative databases. The Act’s note about the commencement table warns that printed commencement tables may not be kept up to date in the face of later insertions; that caution applies equally to amendments that could change the content, scope, or commencement of provisions.

In summary, within the supplied text the amendment history is limited to the original assent date and commencement timing. The Act explicitly notes that its commencement table reflects only the original enactment and will not be expanded to show later insertions, so subsequent amendments, if any, are not recorded in the text provided.

The Act text supplied does not contain any judicial decisions, references to litigation, or mentions of judicial interpretation. There are no cases cited, no recorded disputes, and no statutory references to litigation procedures within this Act. Accordingly, the Act itself contains no litigation history to report.

Implications of the absence of litigation record in the Act. The absence of litigation history in the Act text means that any questions about how courts have interpreted the Act, disputes over the Minister’s determinations, or challenges to the tax characterisation of fees are not addressed in the source provided. Practitioners seeking litigation precedents or judicial treatment of the Act’s provisions must look beyond the text supplied to case law databases and reported decisions; such searches are necessary to determine whether the Act’s constructs (for example, the "imposed as taxes" clause in s 4(5), the permissible divergence of fees from cost in s 5(3), or the Minister’s delegated discretion in s 5(1) and s 8) have been the subject of judicial scrutiny.

Types of disputes that could arise, based on the Act’s content. Although there is no litigation recorded in the supplied text, the statutory features of the Act suggest categories of potential legal disputes that practitioners might expect to see in litigation records elsewhere, namely:

• challenges to the validity of a Minister’s determination, for example on delegation or statutory construction grounds, because determinations are made by legislative instrument (s 8) and must operate within the Act’s caps and indexation rules (s 5-6);

• disputes about whether a particular amount charged is a lawful "application fee" under s 4 and within the statutory maximum, or whether a specified fee exceeded the cap for the relevant financial year (s 5-6);

• litigation concerning the legal character of the fees as "taxes", including consequences for collection, appropriation, or other fiscal legal frameworks (s 4(5));

• judicial review claims challenging administrative decisions linked to fee collection, for example where an applicant alleges unlawful waivers, refunds, or non‑payment consequences, noting the Act does not itself specify enforcement mechanisms (s 7, s 9).

But these are generic categories inferred from the Act’s structure; the Act itself contains no case names, outcomes, or judicial reasoning. For concrete litigation history one must consult judicial decisions and law reports.

Method for obtaining litigation history. To map actual litigation that has occurred, practitioners should search federal court databases, decisions of the High Court and Federal Court, Administrative Appeals Tribunal listings where related administrative decisions might be challenged, and consolidated statute annotations. The Act’s lack of embedded litigation references means that empirical claims about disputes cannot be grounded in the statute alone.

In short, the supplied Act contains no litigation history. Any statement about how courts have treated the Act, or about disputes arising under it, requires external case law research; the Act itself offers no judicial annotations or examples.

The Act is short and technical, and it contains specific provisions that can produce practical traps for administrators, applicants, and advisers. These points are framed strictly by the Act’s text.

Fees are imposed as taxes. The Act does not describe the amounts as mere administrative charges; it states that fees specified in determinations are "imposed, and are so imposed as taxes" (s 4(5)). That statutory characterisation affects how the revenue is legally framed and may have implications for financial reporting, appropriations, and legal classification. Do not treat these amounts as automatically "user‑charges" for accounting or legal purposes without checking how the tax characterisation is treated administratively.

No statutory link to cost. Section 5(3) expressly states that an application fee need not bear any relationship to the cost of issuing or endorsing a document. That removes any statutory constraint on cost‑based pricing. A natural consequence is that fees may be set above, below, or entirely independent of administrative cost; consequently comments or assumptions based on cost recovery are not anchored in the Act.

Timing of liability. Liability is fixed at the time the application is made (s 7(1)-(3)). Administratively, that creates an immediate payment obligation. Practitioners should be aware that the Act imposes timing certainty but does not provide a statutory mechanism for deferred payment, waivers, or instalments.

Ministerial discretion and differentiation. The Minister can specify different fees for different circumstances (s 5(1)). The Act gives no statutory list or criteria for such differentiation. That can lead to variable fee schedules that are set administratively in the determinations, potentially producing complexity in compliance for applicants and for intermediaries who submit applications on behalf of others.

Maximum fee limits and indexation rounding. The initial maximum is $1,000 (s 5(2)(a)); later caps are indexed under s 6. The indexation factor calculation requires use of the All Groups CPI "first published by the Australian Statistician for the quarter", and the Act instructs a rounding procedure to three decimal places, rounding up if the fourth decimal place is 5 or more (s 6(3)). Small arithmetic or rounding errors could produce disputes about the statutory maximum for a particular year, so administrators must apply the formula and the rounding rule precisely.

What the Act does not do. The Act is silent on many operational matters. It does not specify payment methods, refund policies, remission powers, collection or enforcement mechanisms, or consequences of non‑payment. It also does not indicate whether fees are refundable if an application is unsuccessful, nor does it address intermediaries collecting fees on behalf of applicants. Those practical matters must be settled in regulations, administrative procedures, or other instruments.

Dependence on external definitions. The Act delegates unspecified terms to the Australian Passports Act 2005 (s 3(2)). If a reader assumes a meaning for "Australian travel document" or other terms without checking the parent Act, they risk error. The Act’s reliance on those definitions is a gotcha for anyone reading it in isolation.

Comprehensive commencement note. The Act’s commencement table and its note state that the table only relates to the provisions as originally passed and will not be expanded to include later insertions (s 2 note). If later amendments alter commencement or insert provisions, the Act’s printed table will not reflect them; do not rely on the table alone for up‑to‑date commencement information.

No enforcement or appeal text. Because the Act does not contain enforcement or appeal provisions, practitioners must trace such mechanisms elsewhere. A common pitfall is assuming the Act supplies those mechanisms; it does not.

In practice, these provisions combined mean that advisers should check the Minister’s determination(s) and any regulations, verify the statutory maximum and indexation for the relevant year, confirm the method and timing of payment required by administrative practice, and be cautious about assuming refunds or cost‑related pricing.

Compliance requires two complementary tracks: applicants and their advisers must meet the payment timing and amount requirements, and administrators must ensure determinations and indexation calculations are lawful and communicated. The Act’s text supplies specific steps and procedural markers.

For applicants and advisers:

• Check the operative Minister’s determination. Since the Minister sets the fees by legislative instrument (s 8) and the Act’s operative clause authorises fees for passports, travel‑related documents, endorsements and observations (s 4(1)-(4)), the first compliance step is to inspect the current Minister’s determination to identify the applicable fee for the relevant application type and circumstance. The Act allows different fees for different circumstances (s 5(1)), so confirm the precise class of application.

• Pay at application time. Liability is statutory and arises "at the time the application is made" (s 7(1)-(3)). Ensure payment is made in the way required by the administering authority at the time of lodge, because the Act fixes timing rather than permitting deferred settlement.

• Anticipate the statutory maximum. The Act sets a maximum fee per financial year (s 5(2)). For budgeting and advising clients, confirm whether the fee charged falls below the statutory maximum for the relevant financial year; the initial maximum for the first year is $1,000 (s 5(2)(a)). For later years compute or confirm the indexation result per s 6.

• Verify whether cost relationships exist. Do not assume the fee equals administrative cost. Section 5(3) explicitly allows fees not to bear any relationship to cost. When advising clients on whether a fee should be refundable on administrative grounds, check for separate administrative policies or regulations; the Act does not create refund entitlements.

For administrators and legal/financial officers:

• Make determinations by legislative instrument. The Act requires the Minister to specify fees by legislative instrument (s 8). Ensure the instrument is properly drafted, made and registered under the legislative instrument rules that govern such instruments. The determination must be internally consistent with the Act’s categories (s 4) and must not exceed the statutory maximum for the financial year (s 5-6).

• Apply the indexation formula accurately. For later financial years calculate the indexation factor as directed in s 6(1)-(3), using the All Groups CPI number first published by the Australian Statistician for the relevant quarter. Round the indexation factor to three decimal places, rounding up if the fourth decimal place is 5 or more. If the indexation factor for the year is one or less, retain the previous year’s maximum (s 6(2)).

• Publish fee schedules and communication. Because the Act authorises differentiation under s 5(1), clearly communicate fee schedules, classes of application, and any criteria used to distinguish circumstances, so applicants and intermediaries can comply with payment timing (s 7). Transparency reduces disputes about which fee applies.

• Use regulations to fill procedural gaps. Section 9 empowers the Governor‑General to make regulations necessary to carry out the Act. Use the regulation power to provide for payment methods, receipt issuance, refund or remission conditions, collection processes, and administrative remedies. Because the Act does not supply these procedural details, regulations are the appropriate place to codify them.

• Treat fee receipts as tax revenue. The Act states that fees are imposed as taxes (s 4(5)). Ensure accounting and appropriation treatments align with the legal characterisation of those amounts as taxes in the Commonwealth’s financial controls.

• Maintain records for periodic review. Keep documentation of how fees were set, indexation calculations, the legislative instrument text, and any internal guidance on fee application. Since the Act permits different fees for different circumstances (s 5(1)) and does not require cost‑based explanations (s 5(3)), a clear administrative record is valuable if challenged.

• Coordinate with the Australian Passports Act 2005. Because definitions are taken from the Australian Passports Act 2005 (s 3(2)) and certain commencements were aligned with that Act (s 2), ensure the fee regime is implemented in a manner consistent with the parent Act’s processes and application handling.

In practice, compliance is a mix of legal conformity, keeping determinations within statutory caps and making them by legislative instrument, and administrative practice, requiring payment at application, publishing clear fee schedules, and using regulations or administrative instruments to fill operational gaps. The Act supplies the legal constraints; executive practice supplies the day‑to‑day mechanisms to comply with them.
