Australian Naval Nuclear Power Safety (Transitional Provisions) Act 2024

The Schedule rests on a handful of legal concepts that determine whether, and how, an ARPANS licence migrates into the ANNPS regime. These concepts are introduced and defined in Schedule 1 and by reference to the ANNPS Act.

• Commencement: The Act only operates on and after its commencement, and that commencement is expressly linked to the commencement of the ANNPS Act (s 2(1) and Schedule 1, item 1). The text in the published commencement table that appears to give a date is declared not to be part of the Act (s 2(2)). Therefore the operative trigger is the ANNPS Act commencing , if the ANNPS Act does not commence, this transitional Act does not commence (s 2(1); commencement table entry).
• Regulated activity: The Schedule defines "regulated activity" by reference to section 9 of the ANNPS Act (Schedule 1, item 1). The meaning of that term for transitional purposes therefore depends on the substantive definition provided in the ANNPS Act; the transitional rules direct readers to that source for scope.
• Facility activity: Item 2 uses the phrase "facility activity (within the meaning of section 11 of the ANNPS Act)". Again, the content of that concept is not defined in this transitional Act but referred to the ANNPS Act’s section 11. The condition that a licence authorises an activity that is a "facility activity" at commencement is a central eligibility test for the conversion in item 2 (Schedule 1, item 2(1)(d)).
• Types of ARPANS licences: The Schedule relies on the existence of facility licences issued under section 32 of the ARPANS Act and other licences issued under sections 32 or 33 of that Act (Schedule 1, items 2 and 3). The transitional rules distinguish licences that authorise only certain ARPANS activities from licences that authorise both the ARPANS activities listed in section 30(1) and the activity listed in paragraph 32(1A)(b) of the ARPANS Act, or that authorise the activity in ARPANS section 31(1). The classification of an existing ARPANS licence against these statutory categories determines whether conversion is total (item 2) or partial (item 3).
• Legal conversion and split operation: Item 2 states that, "on and after commencement the licence has effect as if it were an Australian naval nuclear power safety licence issued to the licence holder under subsection 31(1) of the ANNPS Act" (Schedule 1, item 2(2)(a)). Item 3 provides a split operation: the licence continues under the ARPANS Act only to the extent it relates to non‑regulated activities; to the extent it relates to a regulated activity it is treated as an ANNPS licence (Schedule 1, item 3(2)-(3)). The Note in each item makes explicit that, to the extent converted, the licence is no longer an ARPANS licence and the ARPANS licence‑conditioning provision (s 35 ARPANS) ceases to apply to that converted part (Schedule 1, item 2 note; item 3 note).
• Conditions imposed on converted licences: Converted licences become subject to (a) the conditions referred to in ANNPS paragraphs 32(1)(a) and (b), (b) any conditions the ANNPS Regulator specifies under subsection 34(2) of the ANNPS Act, and (c) any conditions prescribed by regulations (Schedule 1, items 2(2)(b) and 3(3)(b)). These cross‑references anchor the initial regulatory terms of converted licences in the ANNPS Act’s condition regime rather than the ARPANS Act’s s 35.
• Regulation‑making power for transitional matters: Schedule 1, item 4 delegates to the Governor‑General power to make regulations required or permitted by the Act or necessary and convenient to give effect to it; the regulations may address transitional matters (including saving or application provisions) in respect of enactment of the ANNPS Act and the shift of regulatory responsibility from ARPANS to ANNPS. Item 4(3) explicitly states that items 2 and 3 do not limit the regulations that may be made under item 4.

These concepts together create a mapping operation: certain ARPANS licences, or specified parts of them, become ANNPS licences on commencement; those licences become subject to ANNPS conditions and may attract further conditions from the ANNPS Regulator and regulations; for any residual activities not classified as regulated activities, the existing ARPANS regime continues to apply to those parts of a licence. The Act therefore operationalises a statutory transfer of regulatory responsibility around a defined subset of nuclear‑related activities without providing the substantive definitions of those activities in the transitional text itself, instead importing them by reference to the ANNPS Act (Schedule 1, items 1-3).

The Act targets a narrow group of legal actors and a broader set of regulatory actors who administer licences and conditions. The primary affected parties are:

• Licence holders under the ARPANS Act whose licences are in force immediately before commencement and that authorise activities described in the transitional rules (Schedule 1, items 2 and 3). That is:
  • Persons holding facility licences issued under section 32 of the ARPANS Act that, immediately before commencement, authorise activity referred to in subsection 30(1) of the ARPANS Act but do not authorise the activity in paragraph 32(1A)(b), and where the activity is a "facility activity" as defined in ANNPS section 11 (Schedule 1, item 2(1)); and
  • Persons holding licences under section 32 or 33 of the ARPANS Act that, immediately before commencement, authorise both the ARPANS activities in subsection 30(1) and also the activity in paragraph 32(1A)(b), or authorise activity referred to in subsection 31(1) of the ARPANS Act, and where the activity is a "regulated activity" as defined in ANNPS section 9 (Schedule 1, item 3(1)).
• The ANNPS Regulator (as referenced via subsection 34(2) of the ANNPS Act), who gains the power to specify conditions for licences that are converted to ANNPS licences (Schedule 1, items 2(2)(b) and 3(3)(b)). The Regulator also inherits the administrative responsibility to apply ANNPS licence processes to the converted licences.
• The ARPANS regulator and its administrative staff, who remain responsible for the parts of licences that continue under the ARPANS Act (Schedule 1, item 3(2)). They will need to identify and manage licences that are split between regimes.
• Commonwealth decision‑makers empowered to make regulations: the Governor‑General, acting under the regulation‑making power in Schedule 1, item 4, and the executive branch officials who draft regulations and any prescribed conditions under that power.
• Legal counsel, compliance and safety officers at affected facilities, who must determine whether existing licences or licence activities meet the criteria in the Schedule and, if so, implement the transition to the ANNPS framework and its conditions.
• Third parties that contract with licence holders, insurers, and supply‑chain participants that depend on the legal character of a licence (announced conversions may produce contractual consequences where contracts reference ARPANS licences or regulatory regimes).

Who is not directly affected by the transitional rules: licences that are not in force immediately before commencement; activities that are not facility activities or regulated activities as defined by the ANNPS Act; and licences that authorise only the ARPANS activities excluded by the Schedule’s criteria. The Act does not suspend existing ARPANS obligations for activities that remain under ARPANS (Schedule 1, item 3(2)); it is corrective by reallocation, not by universal repeal of ARPANS licences.

The Act therefore creates a small set of legal winners and incumbent administrative losers in an operational sense: particular licence holders face a change in legal regime for some or all of their authorised activities, the ANNPS Regulator acquires authority to impose conditions on converted licences, and the ARPANS regulator retains authority over non‑converted activity in mixed licences. That mapping is mechanical, but it changes who decides licence conditions and which statutory condition regimes apply to specific activities (Schedule 1, items 2-3).

The Act itself imposes few express duties or rights on licence holders, but it changes the statutory framework that determines duties and rights by reclassifying licences as ANNPS licences (or splitting them). The practical and legal consequences come from the cross‑references to the ANNPS Act and the residual operation of the ARPANS Act.

Primary legal shifts in duties and rights are:

• Change of governing statute for certain licence activities: On and after commencement, licences (or parts of licences) that are taken to be ANNPS licences are governed by the ANNPS Act's licensing provisions rather than the ARPANS Act's licence provisions (Schedule 1, items 2(2)(a) and 3(3)(a)). The Schedule explicitly says that, to the extent converted, the licence is "taken to be" an Australian naval nuclear power safety licence issued under subsection 31(1) of the ANNPS Act, and that section 35 of the ARPANS Act (about licence conditions) no longer applies to that converted extent (Schedule 1, items 2 note and 3 note). The duty to comply therefore shifts to duties specified in the ANNPS Act for licence holders.
• Application of ANNPS licence conditions: Converted licences become subject to the conditions referred to in paragraphs 32(1)(a) and (b) of the ANNPS Act (Schedule 1, items 2(2)(b)(i) and 3(3)(b)(i)), any additional conditions the ANNPS Regulator specifies under subsection 34(2) of the ANNPS Act (Schedule 1, items 2(2)(b)(ii) and 3(3)(b)(ii)), and any conditions prescribed by regulations (Schedule 1, items 2(2)(b)(iii) and 3(3)(b)(iii)). Those cross‑references impose a new menu of possible duties, but the Schedule does not state the content of those duties; licence holders must look to the ANNPS Act and the regulations for specifics.
• Continuation of ARPANS duties for non‑regulated parts: Where a licence covers both regulated and non‑regulated activities, the licence continues in force under the ARPANS Act only to the extent it relates to activities that are not regulated activities (Schedule 1, item 3(2)). That means duties and rights under the ARPANS Act remain binding for those non‑converted parts.
• Regulator discretion to vary conditions: The ANNPS Regulator has express scope to specify conditions under subsection 34(2) of the ANNPS Act, and the transitional rules make those specified conditions applicable to converted licences (Schedule 1, items 2(2)(b)(ii) and 3(3)(b)(ii)). The regulation‑making power in item 4 likewise permits conditions to be prescribed by regulation (Schedule 1, item 4). These are statutory sources of discretion to impose obligations on formerly ARPANS‑licensed operations once they are converted.
• Rights to deal with licences: The Schedule says converted licences "can be dealt with as such" (note in item 2). That language indicates the converted instrument is to be treated operationally as an ANNPS licence for functions such as variation, suspension, revocation, or assignment to the extent permitted by ANNPS provisions; the transitional Act does not itself enumerate licence transaction processes, but it enables the ANNPS regime to be applied to the converted licences (Schedule 1, item 2 note).
• Regulatory continuity and saving: The regulation power (Schedule 1, item 4) allows regulations to prescribe saving or application provisions to preserve or adapt rights and duties during the transition. The Act thus contemplates tailored regulation to resolve detail (Schedule 1, item 4(2)).

In short, the Act effects legal re‑labelling that imports ANNPS duties and ANNPS regulator powers onto converted licences, and leaves ARPANS duties intact for non‑converted parts. Licence holders therefore gain or lose statutory duties and rights depending on the classification of their authorised activities; the precise content of available rights and obligations after transition is determined by the ANNPS Act and any regulations made under this transitional Act.

The transitional Act itself does not create new offences, penalties, or enforcement mechanisms. Instead, it reallocates which statutory enforcement and penalty regimes apply to particular licence activities by converting licences or parts of licences to the ANNPS framework. The enforcement consequences therefore derive from the ANNPS Act and the ARPANS Act rather than from this Schedule.

Relevant enforcement mechanics, as they follow from the Schedule, are:

• Applicability of ANNPS enforcement regime to converted activities: Because the Schedule declares that on and after commencement a converted licence "has effect as if it were an Australian naval nuclear power safety licence issued to the licence holder under subsection 31(1) of the ANNPS Act" (Schedule 1, item 2(2)(a) and item 3(3)(a)), the statutory enforcement powers, sanctions, and compliance mechanisms set out in the ANNPS Act would apply to the licence to the converted extent. The Schedule does not itself spell out those enforcement provisions; licence holders must consult the ANNPS Act for the specifics of powers such as contravention penalties, compliance notices, emergency powers, or administrative sanctions.
• Continuation of ARPANS enforcement for non‑converted activities: Item 3(2) expressly continues the licence in force under the ARPANS Act only to the extent it relates to activities that are not regulated activities. Enforcement powers and penalties under the ARPANS Act therefore continue to be available for those non‑converted activities.
• Removal of ARPANS s 35 from converted parts: The Schedule notes that, on and after commencement, the converted licence is no longer a licence under the ARPANS Act and that section 35 of the ARPANS Act (about licence conditions) no longer applies to the licence to the extent it relates to the regulated activity (Schedule 1, items 2 and 3 notes). Any enforcement rules or penalty consequences that flow from s 35 of the ARPANS Act therefore cease for converted activity; they will be replaced by the corresponding ANNPS licence condition and enforcement regime.
• Regulator specification of conditions and regulatory instruments: Converted licences are subject to conditions specified by the ANNPS Regulator under subsection 34(2) of the ANNPS Act and to conditions prescribed by regulation (Schedule 1, items 2(2)(b)(ii)-(iii) and 3(3)(b)(ii)-(iii)). Conditions specified by a regulator commonly carry administrative enforcement remedies for non‑compliance in the principal Act; therefore, condition specification may be a proximate source of enforceable obligations for converted licence holders (though the Schedule does not itself set out penalty amounts or criminal offences).
• Regulation‑making and transitional enforcement detail: Item 4(2) permits regulations of a transitional nature, including saving or application provisions. Regulations could therefore specify transitional enforcement procedures or clarify the application of enforcement powers during conversion. The Act permits such regulations but does not itself impose any particular transitional enforcement procedure.

Because the Act merely shifts legal governing frameworks, the immediate enforcement risk for licence holders is that an activity they previously conducted under an ARPANS licence may, upon conversion, be subject to different enforcement tools, notice regimes, or penalties under the ANNPS Act. The Schedule does not set the penalty quantum, enforcement thresholds, or adjudicative processes , those are left to the ANNPS Act and to any regulations made under item 4.

This transitional Act is expressly designed to operate in concert with two other statutes: the ANNPS Act (the new regime) and the ARPANS Act (the existing regime). Its entire legal effect is a reallocation of regulatory responsibility, achieved by cross‑reference. The principal interactions are the following:

• Direct cross‑references to the ANNPS Act: The Schedule imports multiple ANNPS provisions into operative effect for converted licences. It uses the ANNPS Act as the destination for licences that meet the Schedule’s criteria:
  • "Regulated activity" means what section 9 of the ANNPS Act says it means (Schedule 1, item 1).
  • "Facility activity" is tied to section 11 of the ANNPS Act for the purposes of item 2 (Schedule 1, item 2(1)(d)).
  • Converted licences are to be treated as if issued under subsection 31(1) of the ANNPS Act (Schedule 1, items 2(2)(a) and 3(3)(a)).
  • The converted licences become subject to conditions referred to in paragraphs 32(1)(a) and (b) of the ANNPS Act and to conditions specified under subsection 34(2) of the ANNPS Act (Schedule 1, items 2(2)(b)(i)-(ii) and 3(3)(b)(i)-(ii)). This means that to understand the substantive scope of the transition the ANNPS Act must be read in tandem with this transitional Schedule.
• Interaction with the ARPANS Act: The Schedule presupposes licences issued under the ARPANS Act (sections 32 and 33 of that Act) and stipulates that, where a licence continues to relate to non‑regulated activities, it "continues in force (and may be dealt with) under the ARPANS Act" (Schedule 1, item 3(2)). It also states that, to the extent a licence is converted, section 35 of the ARPANS Act (on licence conditions) no longer applies to that licence to the converted extent (Schedule 1, items 2 and 3 notes). Thus the Schedule creates a legal partition: some licensed activities move to ANNPS; those that do not remain under ARPANS. Practical operation of licences that span both regimes will therefore require cross‑statute compliance.
• Regulatory hierarchy and continuity: The Act does not repeal the ARPANS Act nor does it purport to amend substantive ARPANS provisions directly; the Schedule effects an operational redirection by taking pre‑existing ARPANS licences and treating their converted parts as ANNPS licences. Because the ANNPS Act’s definitions (s 9 and s 11) are the determinative yardstick for conversion, the substantive boundaries depend on how the ANNPS Act defines regulated and facility activities.
• Delegated instruments and regulation‑making: Schedule 1, item 4 gives the Governor‑General power to make regulations for matters required or permitted by the Act and to prescribe transitional measures to carry out the enactment of the ANNPS Act and the transition of regulatory responsibilities from ARPANS to ANNPS. Those regulations can fill gaps, preserve rights, or set schedules for compliance, thereby creating an interaction layer of delegated law that can modify how the principal Acts operate in the short term.
• Non‑incorporation of commencement table notes: Section 2(2) explicitly rules that information in column 3 of the commencement table is not part of the Act. This affects how published commencement information interacts with the written statute. Stakeholders must not rely on the textual "1 November 2025" appearing in publication column 3 as an operative statutory date because the Act declares such column 3 information not to be part of the statute (s 2(2)). The effective commencement remains tied to commencement of the ANNPS Act under section 2(1).
• No express modification of other Commonwealth laws beyond ARPANS: The Schedule’s text does not attempt to amend other Commonwealth statutes directly; it reassigns particular licences between the two statutes only. Any wider legal consequences (for example, in administrative law, environmental law or contracts) will flow indirectly from the change of the governing statutory regime for the converted activities.

In effect, the Schedule is an operational bridge between ARPANS and ANNPS. It does not, by itself, define the regulatory content of converted licences; it delegates that to the ANNPS Act and to regulations. Practitioners will need to read the two Acts together and pay particular attention to the definitions contained in the ANNPS Act for determining which licences are converted and which enforcement and condition regimes apply.

The Act is freshly enacted and the Schedule contains an internal note stating that the commencement table "relates only to the provisions of this Act as originally enacted" and "will not be amended to deal with any later amendments of this Act" (s 2 note). Beyond that, the statutory text contains no records of earlier amendments or repeals; the Act is in its original form as assented on 24 October 2024 (cover page).

Key points borne out by the text on amendment status:

• Original enactment: The Act text provided is the original enactment; there are no subsequent amendment items within the text (Act preamble indicates assented 24 October 2024).
• Commencement table caveat: Section 2(2) cautions that any information placed in column 3 of the commencement table is not law and may be edited in published versions without affecting the statute. This is an internal drafting practice that prevents the published ancillary column from being read as an operative amendment or an authoritative statutory date. Practitioners must therefore rely on the operative words in section 2(1) rather than on ancillary publication material.
• Schedules and future amendment route: The Act establishes a regulation‑making head of power (Schedule 1, item 4) to prescribe matters necessary to carry out the Act, including transitional provisions. Any future changes to transitional detail would therefore be effected either by regulations made under this head of power or by formal amendment of the Act through parliamentary process. The Schedule explicitly contemplates that items 2 and 3 do not limit the nature of regulations that can be made for transitional purposes (Schedule 1, item 4(3)), thereby leaving significant scope for delegated instruments rather than primary‑law amendment.
• No internal amendment history to record: There is no list of prior amendments or repeals in the Act text supplied. The Act’s own s 3 confirms that legislation specified in a Schedule to this Act is amended or repealed as set out in the Schedule, but Schedule 1 does not list legislative amendments to other statutes; it provides transitional rules instead.

Because the Act is new, the amendment history is succinct: enacted as presented, with regulation‑making power intended to manage transitional details and potential future technical adjustments. Any future change to the Act itself would require the ordinary legislative amendment process unless achieved by regulations where the Act’s delegated power permits.

The source text does not record any litigation related to this transitional Act. The Act includes a parliamentary note recording that a Minister’s second reading speech was made (House of Representatives on 16 November 2023; Senate on 16 September 2024), but the text of that speech is not supplied and no cases, judgments, or disputes are cited in the Act itself.

Observations grounded in the Act about litigation risk and likely disputes:

• Potential for administrative law challenges: Because the Schedule converts licences and transfers regulatory powers from the ARPANS Act to the ANNPS Act, licence holders who disagree with the Regulator’s specification of conditions under ANNPS subsection 34(2) or with the Regulator’s application of ANNPS licence processes to a converted licence may seek judicial review of regulatory decisions under administrative law. The transitional Act itself does not create or resolve those judicial review pathways; those remedies are available under the general law and under the relevant principal Act.
• Classification disputes: The Act’s conversion depends on whether an activity is a "facility activity" (ANNPS s 11) or a "regulated activity" (ANNPS s 9). Disputes about whether a particular authorised activity fits those ANNPS definitions can generate litigation over whether conversion applies and over the legal consequences of conversion. The Schedule gives the ANNPS textual definitions determinative force by reference, thereby making definitional disputes likely to be litigated under ANNPS text rather than this Schedule.
• Licence‑condition challenges and continuity issues: The Schedule removes the operation of ARPANS s 35 to the converted parts of a licence (Schedule 1, items 2 and 3 notes). Parties may litigate about whether a particular licence condition survives conversion, whether the Regulator properly specified conditions under ANNPS subsection 34(2), or whether the regulation‑making power was exercised validly in a particular way. The Act allows regulations to prescribe transitional saving provisions, and questions about the validity or scope of those regulations could generate litigation.
• No existing case law: There is no litigation history provided in the text; any statements about actual judicial outcomes, case names, or appellate treatment would be beyond what the Act supplies and therefore are not recorded here.

In short, the source contains no litigation history. The legal architecture created by the Schedule, however, provides multiple plausible focal points for future litigation (classification of activities, specification of conditions, exercise of regulation‑making power), but the Act does not itself record or describe any existing disputes.

This transitional Act contains a number of drafting and operational features that could produce practical surprises for affected parties. These are concrete items to watch for because they change legal status without restating substantive definitions or conditions in the transitional text.

• Commencement is conditional: The Act does not operate autonomously. It only commences "at the same time as the Australian Naval Nuclear Power Safety Act 2024 commences", and it "does not commence at all if that Act does not commence" (s 2(1); commencement table). Practitioners must therefore track the ANNPS Act’s commencement timetable to know whether and when the transitional provisions will take effect. The date that appears in the published table's column 3 is expressly non‑operative and not part of the Act (s 2(2)). Do not rely on that printed date.
• Conversion changes the governing statute: Where conversion applies, the converted licence is "taken to be" an ANNPS licence and is no longer a licence under the ARPANS Act to the extent of the converted activity (Schedule 1, items 2(2)(a) and 3(3)(a); notes). That is not merely administrative relabelling; it alters which statutory provisions apply to licence conditions, enforcement, variation, and any statutory rights attached to the licence.
• Split licences create compliance complexity: Item 3 contemplates licences that straddle both ARPANS and ANNPS regimes. The licence "continues in force (and may be dealt with) under the ARPANS Act but only to the extent that the licence relates to an activity that is not a regulated activity" (Schedule 1, item 3(2)). That means a single licence instrument may be governed by two separate statutory regimes simultaneously. Licence holders, regulators and inspectors must be clear about which part of a licence is subject to which set of conditions, inspection powers, or reporting requirements. Recordkeeping and compliance systems that previously treated the licence as unitary will need to be adjusted.
• Changed condition regime: Converted licences are subject to the conditions referred to in ANNPS paragraphs 32(1)(a) and (b), any conditions the ANNPS Regulator specifies under subsection 34(2) of the ANNPS Act, and any conditions prescribed by regulation (Schedule 1, items 2(2)(b) and 3(3)(b)). The Schedule does not state those conditions’ text; licence holders must consult the ANNPS Act and any regulations to determine the new compliance baseline.
• Loss of ARPANS s 35 protections for converted parts: The Schedule’s notes state that section 35 of the ARPANS Act (on licence conditions under that Act) no longer applies to the licence to the extent it relates to the regulated activity (Schedule 1, items 2 and 3 notes). If licence holders had contractual, regulatory or procedural expectations grounded in the ARPANS condition rules, those expectations may not survive conversion for converted activities.
• Regulation‑making power is broad: Item 4 permits regulations to prescribe matters necessary to carry out the Act and to include transitional or saving provisions for enactment of the ANNPS Act and the transition of regulatory responsibility (Schedule 1, item 4(1)-(2)). Item 4(3) explicitly states that items 2 and 3 do not limit what regulations can do. That gives the executive significant delegated scope to define procedural detail or to prescribe additional conditions. Stakeholders should expect delegated instruments to flesh out operational detail and should monitor for regulation changes following commencement.
• Reliance on definitions in another Act: The Schedule depends heavily on definitions in the ANNPS Act (for "regulated activity" and "facility activity") to determine which licences are converted. Until the ANNPS Act is read, an affected person cannot determine conversion solely from the transitional Act text; the conversion turns on how ANNPS s 9 and s 11 operate.
• No transitional grace described: The Schedule does not itself set out transitional timeframes for compliance after conversion, nor does it say whether converted licences retain any grandfathered operational practices. Those details may be provided by regulations under item 4, but the absence of a statutory grace period in the Schedule itself means licence holders cannot assume any respite from ANNPS compliance unless and until regulations provide it.
• Administrative fragmentation risk: The split of regulatory responsibility between ARPANS and ANNPS for mixed licences may produce administrative inefficiencies and disputes over inspection scheduling, reporting bifurcation, or inconsistent regulatory expectations for activities that are operationally connected but legally separated by the conversion.
• Public information vs statutory text: The Act highlights that published commencement table column information is not part of the Act (s 2(2)). Do not treat published ancillary information as authoritative statutory content; rely on the statutory language.

Each of these "gotchas" follows from specific Schedule provisions or from the Act’s structural choices. They underline that the conversion is legal in character, not merely administrative: the legal regime controlling activities can change overnight on the ANNPS Act’s commencement, and the precise content of subsequent duties depends on reading the ANNPS statute and related regulations.

Compliance with the transitional rules requires proactive steps by licence holders, regulators and advisers because the Schedule transforms the statutory regime governing particular activities and leaves the detail of conditions to the ANNPS Act and to delegated regulations. The following checklist sets out concrete actions anchored to the Schedule’s text.

1. Confirm whether the transitional Act will commence

   • Track whether and when the ANNPS Act commences. The transitional Act commences only "at the same time as the Australian Naval Nuclear Power Safety Act 2024 commences" and will not commence if that Act does not commence (s 2(1)). Do not rely on ancillary publication dates in column 3 of the commencement table (s 2(2)).

2. Identify relevant ARPANS licences

   • For each licence that the entity holds under the ARPANS Act, determine whether the licence was issued under section 32 or section 33 of the ARPANS Act and whether it was in force immediately before the transitional Act’s commencement (Schedule 1, items 2(1)(a) and 3(1)(a)-(b)).
   • Map the activities authorised by each licence to the ARPANS subsections cited in the Schedule: subsection 30(1), paragraph 32(1A)(b) and subsection 31(1) of the ARPANS Act (Schedule 1, items 2 and 3). The Schedule’s applicability tests are expressed in terms of whether the licence authorises particular activities under those ARPANS provisions.

3. Map activities to ANNPS definitions

   • Determine whether each authorised activity is, at the time of commencement, a "facility activity" (ANNPS s 11) for the purposes of item 2, or a "regulated activity" (ANNPS s 9) for the purposes of item 3 (Schedule 1, items 1-3). This requires consulting the ANNPS Act’s substantive definitions because the transitional Act imports them by reference.

4. Classify licences for conversion or partial continuation

   • If a facility licence matches item 2’s criteria (issued under ARPANS s 32; in force immediately before commencement; authorises activity under ARPANS s 30(1) but not ARPANS para 32(1A)(b); and the activity is a facility activity under ANNPS s 11), expect the whole licence to be treated as an ANNPS licence on commencement (Schedule 1, item 2).
   • If a licence matches item 3’s criteria (issued under ARPANS s 32 or s 33; in force immediately before commencement; authorises both categories identified in item 3(1)(c)(i) or authorises ARPANS s 31(1) activity; and the activity is a regulated activity under ANNPS s 9), expect the licence to be split: the parts relating to regulated activities become ANNPS licences and the remainder stays under ARPANS (Schedule 1, item 3).

5. Prepare for new or different licence conditions

   • For licences converted to ANNPS licences, prepare to comply with the conditions referred to in ANNPS paragraphs 32(1)(a) and (b), any conditions the ANNPS Regulator specifies under ANNPS subsection 34(2), and any conditions prescribed by regulation (Schedule 1, items 2(2)(b) and 3(3)(b)). Obtain and record a copy of those ANNPS provisions and the relevant regulations once they are finalised.
   • Review operational, safety, reporting and auditing systems to ensure that they meet ANNPS condition requirements; any gap must be closed prior to or immediately after commencement.

6. Document and segregate activities and compliance obligations

   • For licences that will be split, maintain clear records that identify which activities are regulated activities (ANNPS) and which remain under ARPANS. Segregate safety management plans, reporting channels, and compliance calendars accordingly to avoid conflating requirements under different statutes (Schedule 1, item 3(2)).
   • Update contracts and insurance arrangements that reference ARPANS licensing status or regulatory compliance expectations, to ensure those arrangements remain valid if the underlying licence is converted or split.

7. Engage with regulators

   • Notify the relevant regulator(s) of any ambiguity or borderline categorisation. Because converted licences are subject to any conditions specified by the ANNPS Regulator under subsection 34(2), early engagement can clarify what conditions will apply and whether transitional derogations will be available (Schedule 1, items 2(2)(b)(ii) and 3(3)(b)(ii)).
   • Monitor and participate in any consultation on regulations made under Schedule 1, item 4, because those regulations may prescribe transitional matters, saving provisions, or additional conditions that affect compliance obligations.

8. Plan for inspection, reporting and enforcement

   • Anticipate potentially different inspection regimes and reporting formats under the ANNPS Act. Adjust incident reporting, emergency preparedness, and record retention policies to match ANNPS expectations where conversion applies.
   • Keep contemporaneous records of licence authorisation scopes as at the date immediately before commencement (the Schedule requires licences to be in force "immediately before commencement" to qualify) to support any dispute about eligibility for conversion.

9. Seek legal and technical advice

   • Because the Schedule imports definitions and regulatory condition regimes from the ANNPS Act, obtain legal advice that reads the two Acts together. Technical safety and compliance advisers should prepare gap analyses between the ARPANS compliance framework currently applied and the ANNPS conditions that will govern converted licences.

10. Monitor delegated instruments

• The Governor‑General’s regulation‑making power in Schedule 1, item 4 can be used to prescribe transitional details, including saving and application provisions. Monitor the Federal Register of Legislation for instruments made under the transitional power and calendar their compliance deadlines into your operational compliance plan.

Taken together, compliance requires a staged programme: verify whether the transitional Act commences; classify licences against the Schedule’s criteria by reference to both ARPANS and ANNPS provisions; update documentation and systems for split or converted licences; and engage with the ANNPS Regulator and legal advisers to manage the shift in governing duties and enforcement risk. The Schedule leaves detail to the ANNPS Act and to regulations, so active monitoring and rapid adjustment will be necessary at commencement.
