45  Additional matters—activity of having possession or control of an NNP facility in a designated zone

 (1) This section applies to a licence to authorise a facility activity of having possession or control of an NNP facility in a designated zone.

 (2) If subsection 27(3) applies in relation to the application for the licence, the Regulator must be satisfied that the construction evaluation for the facility (as proposed at the time of making the decision to issue the licence) demonstrates the suitability of the facility for the possession or control.

 (3) The Regulator must take into account the results of the field exercise provided under subsection 27(6).
