Several recurrent legal concepts structure the statute. Each is given a precise scope in the instrument and in the Schedule 1 dictionary, and each is declared to apply across University legislation (s5, s8, Schedule 1).

1. University legislation

• Defined broadly to include statutes, rules, orders and any other legislative instrument or notifiable instrument made under the ANU Act or under a statute, rule or order (s6). The definition is central because the statute repeatedly states that its provisions apply to "University legislation" and that references to such legislation may include instruments made under it (ss13-18).

2. Application and displacement

• The instrument is designed to be applied to all University legislation (s5) and its provisions "must be applied" except where displaced by express provision or contrary intention in other University legislation (s7(1)-(2)). The text states that "displaced" includes "modified" (s7(3)). This creates a baseline set of drafting and interpretative norms that can be varied by other University instruments.

3. Interpretative machinery

• The statute imports a dictionary and requires that definitions in Schedule 1 apply to all University legislation (s8, Schedule 1). It also provides rules on how terms used in authorising legislation are to be read (s9), how general references to University entities are to be understood (s10), the legal effect of examples and notes (ss11-12), and how references to legislation or provisions should be read when instruments are amended, repealed and remade (ss13-18). For example, a reference to University legislation is to include the legislation "as in force from time to time" and remade provisions (s17(1)).

4. Powers to make and vary instruments

• If the enabling provision gives power to make an instrument, the legislation is taken to give the power (s19). The power to make an instrument includes power to amend or repeal it, exercisable subject to the same conditions as the power to make it, with a caveat where a condition ceases to be satisfied after the instrument is made (s20).

5. Administrative convenience and continuity

• The statute contains several rules aimed at administrative continuity: decisions by bodies survive changes in membership (s21); time extension power may be exercised after the relevant time has ended (s22); College Deans may exercise Associate Dean functions unless personal exercise is required (s25); and section 26 provides explicit savings when University legislation repeals other University legislation, so appointments, delegations, approvals and other things can continue under a declaring instrument (s26).

6. Approved forms regime and electronic processes

• The Vice‑Chancellor may approve forms for University legislation and those forms must be used for their intended purposes (s23(1)-(2)). The statute allows substantial compliance (s23(3)) but makes "properly completed" forms subject to mandatory requirements that may be imposed on format, signatures, verification and electronic process (s23(4)-(7)). An approved form provided by an electronic process in accordance with a mandatory requirement is taken to be in writing (s23(9)). The Vice‑Chancellor must ensure approved forms are available on the University’s website or otherwise (s23(10)).

7. Service rules

• The statute prescribes permitted modes of serving notices on individuals: personal delivery, prepaid post to an address in the University’s records, or email to either the University‑provided email or any email in the University’s records (s24(2)). It then sets deemed service timing for post and email (s24(3)-(4)). The section preserves other service rules where authorised (s24(5)).

8. Repeal, transition and expiry

• The instrument repeals the prior legislation statute 2020 (s27), authorises transitional rules to be made under the Governance Statute (s28), applies the saving mechanisms in s26 to the repeal (s29), and provides that the instrument expires in 10 years (s31).

Each of these concepts is stated as a drafting or administrative rule to be applied across the University’s internal law. The statute thus functions as a unifying drafting and administrative code: it defines baseline meanings, procedures, continuity mechanisms and practical norms for how University legislation should be made, referenced and applied.

The statute is framed to apply to "all University legislation" and, by design, to the full range of University entities and individuals who interact with that legislation. Specific affected parties and the ways they are affected, as stated in the text, include:

• The Council and University bodies: The Council is the statutory maker of statutes under the ANU Act and the statute is made under that authority (s3). The concept "University body" in s21 explicitly includes the Council and any body established under University legislation or by Council decision. Section 21 governs continuity of acts by such bodies despite changes in membership, and section 19 governs the making of instruments under University legislation.

• The Vice‑Chancellor: The Vice‑Chancellor is given specific administrative power to approve forms (s23(1)); the Vice‑Chancellor must ensure forms are available online or otherwise (s23(10)). That places operational responsibility on the office for a key compliance interface between the University and individuals.

• Deans and Associate Deans: The College Dean of an ANU College may exercise any function given to an Associate Dean unless the Associate Dean is required personally to exercise it (s25(1)-(2)). The statute changes who can act in certain operational roles by allowing functional substitution under specified limits.

• Individuals to whom notices are to be given: Section 24 sets out how notices must or may be served on "an individual" under University legislation. This includes staff, students, applicants, external parties and others who receive notices under University instruments. The practical effect is that an individual’s University‑recorded postal or email address is an authorised delivery point (s24(2)(b)-(c)).

• Registrars and officers exercising delegated powers: The instrument contains an illustrative example (s20(3) example) that shows how power to amend or revoke instruments operates in practice. Reappointees and delegates should expect the power to amend or revoke to be exercisable on the same conditions as the power to make the instrument (s20(2)-(3)).

• Rule and order makers under other statutes: Rules made under the Governance Statute (and other statutes) can prescribe transitional matters in respect of repeal and remaking of this instrument (s28). The statute itself may be displaced by contrary intention in other University legislation (s7(2)), so rule makers drafting new University instruments will be affected when choosing to adopt or displace these baseline rules.

• People and entities relying on existing appointments, delegations, approvals and instruments: Section 26 preserves the continued operation of appointments, delegations, approvals and other instruments where a repealing and declaring legislation relationship exists. The statute therefore affects the legal status of existing delegations and approvals when older University legislation is repealed.

• All users of approved forms and administrative processes: The approved forms regime (s23) applies to any University legislation that designates a form as an "approved form" and stipulates mandatory requirements for completion and provision. Entities or third parties seeking to rely on an instrument executed using a non‑approved form should expect the instrument to be ineffective for that purpose and liable to be rejected or otherwise handled in accordance with University policy (s23(2), (5)).

• The University’s legal and compliance functions: Because the instrument sets cross‑cutting interpretative rules (ss6-18), the University’s legal drafters, compliance officers and records managers will be affected by the need to align drafting practice, record‑keeping and service practices with the statute’s definitions, service rules and approved forms regime.

Finally, by design the statute influences how external parties interact with University law: contractors, external advisors, students, staff and other stakeholders must engage with the University’s record systems for address and email (s24), use approved forms where required (s23), and be aware that University instruments may be amended or preserved in particular ways under ss20 and 26. The instrument therefore affects both internal decision makers and external recipients of University regulatory or administrative action.

The statute creates a set of affirmative duties, powers and protections that operate as baseline administrative and interpretative rules for University legislation. Below are the principal duties (things that University entities must or are required to do) and rights or powers (authorities conferred), with direct textual references.

Duties and mandatory obligations

• Apply the instrument to University legislation, unless displaced: A provision of this instrument "must be applied" to all University legislation in accordance with its terms, except where displaced (s7(1)). This places an obligation on drafters and decision makers to start from the statute’s text when construing or applying University instruments.

• Use approved forms where required: If the Vice‑Chancellor approves a form to be used for a particular purpose, "the form must be used for that purpose" (s23(2)). If a non‑approved instrument is used, it is "not effective for the purpose" and may be dealt with under University policy (s23(2), (5)). The statute also requires that "properly completed" forms comply with each mandatory requirement (s23(4)).

• Ensure approved forms are publicly available: The Vice‑Chancellor must ensure approved forms are available on the University’s website or another appropriate way (s23(10)). This places an administrative duty on the Vice‑Chancellor’s office.

• Maintain service practices and records: The statute prescribes authorised methods of serving notices and defines deemed service timings for post and email (s24(2)-(4)). If University legislation requires service on an individual, the University is obligated to use one of those modes, subject to other applicable law (s24(5)).

• Apply the Schedule 1 dictionary definitions: A definition in Schedule 1 "applies to all University legislation" (s8). This imposes a drafting and interpretative duty to use those definitions consistently.

Powers, rights and discretions

• Power to make instruments: If University legislation gives a power that can be exercised by making an instrument, that power is available (s19). This confirms existing authority to create instruments where authorised.

• Power to amend or repeal instruments: The power to make an instrument includes power to amend or repeal it, and that power is exercisable in the same way and subject to the same conditions as the power to make it (s20(1)-(2)). There is a built‑in mechanism for practical flexibility, with a caveat if a condition ceases to be satisfied after an instrument is made (s20(3)).

• Vice‑Chancellor’s approval powers over forms: The Vice‑Chancellor may, in writing, approve forms for University legislation and determine mandatory requirements and electronic processes (s23(1), (7)-(9)). The Vice‑Chancellor also controls availability of forms (s23(10)).

• Extension of time: Where University legislation allows an entity to extend a deadline, the entity "may extend the time, even though the relevant time has ended" upon application (s22(2)). This grants a procedural right to applicants and discretion to decision makers.

• Continuity of acts by University bodies: Acts done by a University body do not cease solely because the membership of the body changes (s21(2)). That protects the legal effect of appointments, delegations and decisions made by bodies even if membership later changes.

• College Dean substitution of functions: The College Dean may exercise functions given to an Associate Dean under University legislation or Council/Vice‑Chancellor decision, unless the legislation requires personal exercise by the Associate Dean (s25(1)-(2)).

Protections and saving mechanisms

• Effect of repeal with a declaring legislation: If a repealing legislation repeals other University legislation and the repealing or other University legislation declares that s26 applies, the repealed legislation is taken to have been amended rather than repealed, and existing appointments, delegations, approvals and other things continue to have effect under the declaring legislation (s26(1)-(4)). This provides a legal safety net for continuity of administrative arrangements during legislative turnover.

• Substantial compliance standard for forms: The statute recognises "substantial compliance" with an approved form as sufficient (s23(3)), which provides some protection against minor non‑conformities, while preserving the requirement that mandatory requirements be satisfied (s23(4)).

Notably absent as express duties or rights

• The statute does not create offences, civil penalties or criminal sanctioning regimes. It contains no penalty provisions within its text. Enforcement is oriented towards administrative invalidity (for example, forms not effective) and to preservation or revocation of instruments under the mechanisms described (ss20, 23, 26).

In practice, the duties require University officers to ensure consistent drafting and record keeping, make approved forms available and enforce their proper completion, and to respect the prescribed service mechanisms. The rights and discretions give the Vice‑Chancellor and other specified entities administrative control over forms, time extensions and the making or amendment of instruments.

The instrument does not institute a discrete enforcement or penalty regime. It operates as a prescriptive set of drafting, interpretative and administrative rules that shape the legal effect of University instruments rather than by imposing fines or criminal sanctions. The statute’s text contains no express offence provisions, monetary penalties or administrative fines. Enforcement mechanisms are therefore indirect and administrative, and they operate through legal effectiveness and University policy rather than through criminal or civil penalty machinery.

Primary enforcement mechanisms in the statute

• Invalidity or ineffectiveness of non‑compliant instruments and forms: The statute makes the use of an unapproved form or an improperly completed approved form ineffective "for the purpose" the form is intended to serve (s23(2), (4)-(5)). The University may reject such an instrument or decline to take action on it, subject to its policies and procedures (s23(2), (5)). That creates a practical sanction: non‑compliant submissions will not produce the intended legal effect.

• Revocation or amendment of instruments: The power to make an instrument includes power to amend or repeal it, exercisable on the same conditions as the power to make it (s20(1)-(2)). Where a condition ceases to be satisfied, the power to amend or revoke can operate to remove permissions or approvals (s20(3)). This gives administrators an internal tool to enforce conditions attached to permissions or approvals.

• Procedural service rules with deemed effect: Section 24 prescribes modes of service and provides deemed dates of service for post and email (s24(3)-(4)). This means that failure by a recipient to monitor the contact details held in University records may lead to a loss of procedural protection, as service is taken to have occurred on the deemed day. That functionally enforces compliance with notice regimes by making proper record maintenance consequential.

• Continuity and savings in repeals: Section 26 preserves existing appointments, delegations and approvals when a repealing and declaring legislation relationship exists (s26(2)-(4)). Where a University instrument contains conditions requiring continued compliance, the continued effect of those appointments and approvals may be contingent on subsequent compliance under the declaring instrument. This acts to enforce continuity where intended, and to preserve rights and duties where not meant to be disrupted.

• University discretion and policies: The statute expressly allows University policy or discretion to determine what happens to ineffective instruments or non‑compliant forms (s23(2), (5)). Enforcement therefore often occurs within the University's policy framework rather than as statutory penalty. For instance, the University may permit rectification within a specified time or may reject documents altogether (s23(5)).

Limits on enforcement powers

• No statutory sanctions: The absence of express offence or penalty provisions means compliance is not enforced by criminal prosecution or pecuniary penalties under this instrument. Instead, enforcement depends on the legal effect of the instrument (for example invalidity of forms) and internal University processes.

• Preservation of other laws and instruments: Section 24(5) preserves the operation of other University legislation or other law that authorises service in a different way. That means other statutes or rules may contain their own enforcement or penalty regimes which remain available and unaffected.

Practical enforcement risk profiles

• For individuals and contractors, the statute’s primary enforcement effect will be administrative: an application made using the wrong form, or a failure to receive notice because University records were out of date, will affect legal rights and processes (s23, s24). The University’s policy choices on dealing with ineffective instruments determine whether the effect is remedial or final.

• For University officers and decision makers, the power to revoke or amend instruments (s20) and the continuity rules (s21, s26) create internal levers of enforcement over delegates and institutional processes.

Overall, enforcement under this statute is built around legal effectiveness, record‑keeping and administrative discretion rather than express civil or criminal sanctions.

The statute expressly positions itself within a wider legal and statutory landscape, citing and incorporating, by reference and note, Commonwealth statutory construction materials and the ANU Act. The instrument both relies on and defers to other laws where appropriate, and it permits departure from its rules by other University legislation through a stated "contrary intention". The key interaction points in the text are the following.

Relationship with the ANU Act

• The statute is made under the ANU Act, section 50 (Statutes) (s3). That anchors the instrument’s authority within the ANU Act regime and means its legal effectiveness is within the ANU Act’s statutory framework.

References to Commonwealth construction statutes

• The instrument includes explicit references and notes to the Acts Interpretation Act 1901 and to the Legislation Act 2003, and states that those Commonwealth statutes apply to University legislation, subject to any contrary intention in University legislation, including this instrument (s7 and accompanying note). For example:
  • s7's Note 2 states the provisions of the Acts Interpretation Act apply to University legislation subject to any "contrary intention" (note to s7).
  • Section 26 is described as "additional to, and does not limit" the Acts Interpretation Act, section 7, as applied by the Legislation Act, s13(1)(a) (s26(7)).

Incorporation of instruments and instruments under legislation

• The statute treats references to University legislation as including instruments made under that legislation, and expressly accounts for adopted, applied or incorporated provisions (s18(1)-(2)). This means an ANU statute that adopts external rules or incorporates other instruments should still fall within the operation of references made under University legislation (s18).

Displacement and contrary intention

• The statute establishes a default set of interpretative and procedural rules, but allows them to be displaced by "expressly" or by "contrary intention" in University legislation or other University legislation (s7(2)). That provides drafting flexibility: for example, a later statute or rule can state an express contrary intention and thereby override particular provisions of this instrument.

Interaction with Governance Statute and rules

• The instrument enables rules made under the Governance Statute, section 68(1) (General power to make rules and orders), to prescribe transitional matters relating to the repeal of the 2020 Legislation Statute or the making of this instrument (s28). It further declares that rules made for that transitional purpose “have effect despite anything in this instrument (other than [s28])” (s28(3)). That gives the Governance Statute a specific interaction role in managing transition.

Effect on repealed legislation and saving mechanisms

• Section 26 establishes mechanics for dealing with repeals of University legislation where the repealing legislation or another University legislation declares that s26 applies. Under such a scenario, the repealed legislation is treated as having been amended rather than repealed, and various appointments, delegations, approvals or other instruments continue to have effect under the declaring legislation (s26(1)-(4)). The statute expressly states this section is "additional to, and does not limit" the Acts Interpretation Act, section 7 (s26(7)). Thus, s26 operates alongside Commonwealth rules on repeal and savings.

Application over time

• The statute states that a reference to University legislation includes the legislation "as in force from time to time" and accounts for repeal and remaking, omitted and remade provisions, and changed names (s17). That aligns with typical statutory drafting practice: references are taken to include amended and remade versions unless a contrary intention is expressed. This is an explicit interaction with the dynamic operation of legislative instruments.

Preservation of other service rules and laws

• Section 24(5) preserves the operation of any other University legislation or other law that authorises or requires service of a document otherwise than as provided in s24. That maintains legal consistency where other statutes or common law impose different service requirements.

Limits to interaction

• The instrument often frames the Commonwealth statutes and other University legislation as "additional to, and not limiting" the indicated sections (for example ss9(3), 20(4), 26(7)). That signals that the instrument should be read alongside, not in substitution for, the Acts Interpretation Act and the Legislation Act.

In short, the 2023 Legislation Statute is designed to sit on top of the ANU Act and to operate with standard Commonwealth legislative construction rules, while giving the University an internal, cross‑cutting drafting and administrative code that can be displaced where necessary. It expressly delegates transitional power to rules under the Governance Statute and provides saving rules to preserve continuity when University legislation is repealed.

The instrument itself contains its own internal amendment and repeal history limited to what it directly implements. The statute records the following historical and transitional events:

• Repeal of the 2020 Legislation Statute: Section 27 expressly repeals the Australian National University (Legislation) Statute 2020. That is the central historical movement recorded in the instrument.

• Transitional rules and savings: The instrument furnishes transitional arrangements. Section 28 authorises rules under the Governance Statute, section 68(1), to prescribe transitional matters (including savings and application provisions) relating to the repeal of the 2020 statute or to the making of this instrument (s28(1)-(3)). Those rules have effect despite anything in the 2023 instrument except s28 itself (s28(3)).

• Application of section 26 to the repeal: Section 29 declares that section 26 (Effect of repeal of University legislation) applies to the repeal of the 2020 Legislation Statute, and that the provisions of Division 6.2 are transitional provisions (s29(1)-(2)).

• Additional transitional provision clause: Section 30 states the Division is additional to and does not limit section 26 or the Acts Interpretation Act’s section 7 as applied by the Legislation Act (s30).

• Expiry: The statute contains an expiry provision: it expires 10 years after the day it commences (s31).

• Commencement: The instrument commences on the day after it is registered (s2).

There are no express amending entries for the 2023 instrument itself contained in the text beyond these transitional measures and the repeal of the 2020 version. The instrument does not list any prior amendments to its own text, nor does it record incremental modifications. The repeal of the 2020 statute and the insertion of transitional rule‑making and saving provisions are the only explicit historical‑change elements embedded in the instrument.

Operational implications of the amendment history as recorded

• Continuity: By applying section 26 to the repeal of the 2020 statute (s29), the instrument signals that the University intends to preserve existing appointments, delegations, approvals and other things that were in force under the 2020 statute where a declaring legislation declares s26 applies (s26(2)-(4)). That reduces immediate disruption when one version of the instrument is replaced by another.

• Delegation of transitional detail to rules: The statute assigns detailed transitional prescription to rules made under the Governance Statute rather than setting every transitional step in the statute itself (s28). That means future transitional clarifications and savings may be implemented by rules rather than further statute.

• Scheduled review point: The 10‑year expiry (s31) creates a built‑in sunset clause that requires the University to revisit the provisions or let them lapse, or to replace them before expiry. The instrument does not provide an automatic extension mechanism beyond the creation of new University legislation.

No other amendment history (for example, intervening revocations or earlier versions) is recorded in the instrument text provided.

The statute text contains no references to judicial decisions, litigation, or legal challenges. It lists no case names, no judicial interpretations, and includes no references to litigation arising from either this instrument or the Legislation Statute 2020 that it repeals. There are also no provisions making express reference to past litigation as a driver for drafting choices.

Consequently, based on the instrument as provided:

• There is no recorded litigation history within the text to analyse or to cite.
• No precedent or court construction of the provisions is included in the statute or its notes.

For practitioners needing litigation context, the instrument’s drafting purpose and textual references to Commonwealth statutory interpretation statutes (the Acts Interpretation Act and the Legislation Act) indicate the University intends these provisions to be applied consistently with standard construction principles; however, any authoritative judicial construction or litigation arising from these precise 2023 provisions is not present in the instrument. If litigation arises in future, courts would construe the instrument against the text here and the surrounding ANU Act framework, with the usual deference to statutory language and to any declared "contrary intention" in other University legislation (s7(2)).

The instrument contains numerous drafting choices and administrative defaults that create practical pitfalls and implementation risks. Below are the most salient "gotchas" grounded directly in the instrument’s wording.

1. Default application unless displaced (s7)

• The statute’s provisions "must be applied" to all University legislation unless displaced by express provision or a contrary intention (s7(1)-(2)). Drafters who assume the instrument is optional may be surprised to find their rules automatically subject to these baseline definitions and procedural rules unless they explicitly provide otherwise.

2. Approved form inflexibility and University discretion (s23)

• If a Vice‑Chancellor‑approved form is required for a purpose, the statute states "the form must be used" and an instrument using a different form is "not effective for the purpose" (s23(2)). The University may reject or decline action and otherwise deal with the instrument "in accordance with the University's policies and procedures" (s23(2)). Although "substantial compliance" is sufficient (s23(3)), the statute also makes "properly completed" forms dependent on meeting each mandatory requirement (s23(4)). The combination of strict mandatory elements and broad discretion for the University to reject non‑compliant submissions increases operational risk for external parties and lower‑capacity applicants.

3. Electronic‑process mandatory requirements (s23(7)-(9))

• An approved form may impose mandatory electronic process steps that can block completion until prior information is provided, or prevent submission until requirements are satisfied (s23(7)-(8)). Where mandatory electronic requirements exist, forms provided using an approved electronic process are taken to be "in writing" (s23(9)). Failure to implement or to follow these electronic processes may render a submission ineffective.

4. Reliance on University records for service (s24)

• Service by prepaid post or email is validated against addresses and email addresses "shown in the University’s records" (s24(2)(b)-(c)). A recipient whose contact details in University records are not current risks constructive achievement of service and loss of notice protections. Moreover, email service is taken to have been received on the day it would have been received in the "ordinary course" (s24(4)), which may be contested in particular circumstances.

5. Broad definition and transferability of references (ss10, 17)

• General references to entities and positions are to be read as references to the entity within or for the University, and where there are several such entities the reference is to the entity "with responsibility for the matter" (s10(1)(a)(ii)). This can create ambiguity where responsibility is shared or unclear, and can alter who is understood to be the decision maker without an express naming.

6. Examples part of legislation (s11)

• Examples in University legislation are expressly stated to be "part of the University legislation" and may extend but not limit meaning (s11(1)-(3)). Drafting that relies on an example being illustrative only could be surprised when a court or administrator treats the example as legislative text.

7. Continuity of acts despite membership changes (s21)

• Actions taken by a University body "do not end only because the membership of the body changes" (s21(2)). This secures administrative continuity, but it may complicate accountability lines where a newly constituted body wishes to revisit decisions made by its predecessors.

8. S26 saving mechanics depend on declaring legislation (s26)

• The continuation of appointments, delegations and approvals under s26 requires that the repealing or other University legislation declare that s26 applies (s26(1)). If such a declaration is not made, parties cannot rely on s26 to preserve arrangements. Practically, drafting must ensure the declaring instrument explicitly invokes s26 where continuity is desired.

9. Power to amend or repeal in same way as power to make (s20)

• The power to amend or repeal an instrument is exercisable "in the same way, and subject to the same conditions" as the power to make it (s20(2)). Where the original power to make included substantive conditions, those conditions will govern amendment or revocation, and administrators must track them to avoid procedural defects. The caveat in s20(3) can complicate this where a condition ceases to be satisfied.

10. Ten‑year expiry (s31)

• The instrument expires 10 years after commencement. If the University does not replace it in a timely manner, the baseline interpretative regime it creates will lapse. Any planning which assumes permanence must account for the sunset.

11. Absence of penalties (Penalties)

• There are no express penalty provisions. Enforcement is largely administrative and depends on University policies and internal processes. Parties requiring immediate external statutory sanctions will not find them here.

12. Delegation substitution limits (s25)

• The College Dean may exercise an Associate Dean’s functions unless those functions are required to be performed personally by the Associate Dean (s25(1)-(2)). Where a function depends on the Associate Dean’s "state of mind", the College Dean may exercise the function on their own state of mind (s25(4)). This could raise evidential issues for matters requiring subjective judgements, where the instrument allows substitution.

13. Interaction with other laws and the "contrary intention" escape hatch (s7)

• The statute routinely defers to other University legislation where a contrary intention is expressed (s7(2)). Drafts that inadvertently conflict with this instrument may be overridden by later legislation, but only if it expresses a contrary intention. Drafters must decide whether to adopt or to explicitly displace these baseline rules.

Being aware of these points is important for drafters, administrators, students and external parties dealing with University instruments, because operational consequences (ineffective forms, deemed service, continuity or loss of delegations) can follow from the application of these otherwise technical provisions.

This section translates the statute’s provisions into a practical compliance checklist and implementation guidance, tied to the text. It is organised by the main operational areas the statute governs.

A. Drafting and legislative design

• Start from the statute’s defaults: Treat the Legislation Statute 2023 as the baseline for definitions, interpretative rules and administrative mechanics (s5, s8). When drafting a statute, rule or order, explicitly state any "contrary intention" if you intend to displace particular provisions (s7(2)). Record the displacement text clearly to avoid ambiguity about whether the instrument is intended to modify baseline rules.

• Use Schedule 1 terms consistently: Apply definitions from Schedule 1 across University legislation (s8). Avoid creating local definitions that inadvertently conflict with the dictionary unless there is an express, deliberate reason and that intention is clearly expressed.

B. Approved forms regime

• Require use of approved forms only where necessary: If a University instrument requires a specified form to be "approved", ensure that the Vice‑Chancellor actually approves the form in writing (s23(1)). Once approved, ensure the instrument states unequivocally that the approved form must be used for that purpose (s23(2)).

• Draft approved forms with mandatory requirements in mind: If a form will include mandatory requirements, list them explicitly and describe what constitutes "properly completed" (s23(4), (6)). Clarify which items are mandatory (signatures, witnesses, format, verification) under s23(7).

• Design electronic processes to avoid inadvertent blocking: Where the approved form is electronic, test mandatory electronic steps to ensure they do not unduly prevent legitimate submissions (s23(7)-(8)). Ensure the electronic process satisfies s23(9) where a written form is required.

• Provide clear rectification procedures: Since the University may reject non‑compliant submissions (s23(2), (5)), include time frames and processes for cure where appropriate in University policy so that reasonable non‑substantive errors can be remedied.

C. Service and records management

• Keep University contact records current: Because service may be validly effected to addresses or emails shown in University records (s24(2)(b)-(c)), maintain reliable processes to update postal and email addresses for students, staff and relevant third parties. Log changes with timestamps.

• Capture consent and notification preferences where practicable: Record whether individuals have been provided with or use University email addresses, to manage expectations about service under s24(2)(c)(i).

• Log service attempts and expected receipt dates: For posted notices, record the posting date and the address used, to support the s24(3) deemed service date. For emails, capture transmission timestamp and any delivery or bounce notifications to evidence the s24(4) deemed receipt.

D. Delegations, instruments and continuity

• When making appointments, delegations or approvals that may outlive the instrument under which they were made, ensure the repealing or declaring legislation explicitly applies s26 if continuity is required (s26(1)-(4)). Otherwise, plan for re‑making or confirmation of delegations under the new instrument.

• Track conditions attached to instruments: Because the power to amend or repeal an instrument is exercisable on the same conditions as the power to make it (s20(2)), and because a condition ceasing to be satisfied can affect that power (s20(3)), maintain a register of conditions and whether they remain satisfied.

E. Administrative decision processes

• Use extension of time power where helpful: If University legislation allows an entity to extend time, exercise the power even after the relevant time has ended if warranted (s22(2)). Implement an application process and record decision criteria.

• Apply s21 continuity deliberately: Where bodies make appointments, delegations or decisions, record minutes and delegate instrument texts so that the legal effect is preserved despite membership changes (s21(2)). Keep a traceable audit trail.

• Associate Dean substitution: When delegating functions that may be exercised by a College Dean under s25, document whether personal exercise by an Associate Dean is required. Where functions depend on state of mind, document approach to evidence so that substitutions are defensible (s25(4)-(5)).

F. Transitional and repeal planning

• Use Governance Statute rules for transitional details: When repealing or remaking legislative instruments, make transitional rules under the Governance Statute section 68(1) to prescribe operational savings and transitional arrangements (s28). Ensure those rules explicitly state they have effect despite anything in the Legislation Statute if necessary (s28(3)).

• Prepare for the ten‑year expiry: The instrument expires 10 years after commencement (s31). Program a legislative review and replacement process well before the expiry date to avoid a regulatory gap.

G. Publication and accessibility

• Publish approved forms and make them accessible: The Vice‑Chancellor must ensure approved forms are available on the University’s website or otherwise (s23(10)). Publish both the form and clear guidance on mandatory requirements and the consequences of non‑compliance.

H. Policies and discretion

• Draft University policies to operationalise statutory discretions: Where the statute allows the University to reject non‑compliant instruments or to exercise discretion, put in place clear policy frameworks that describe when rectification will be permitted and how decisions will be made (s23(2), (5)). This reduces inconsistent application and litigation risk.

I. Training and internal controls

• Train staff who handle forms, service of notices and delegated decision making on the statute’s mechanics, especially on how the University’s record systems feed into service and on the effect of using unapproved or improperly completed forms.

J. External communication and contract drafting

• When contracting or communicating with external parties, make clear which addresses and emails will be used for service, and advise parties to keep their University record details current, to avoid unintended deemed service outcomes under s24.

By applying these steps closely linked to the statutory text (ss2-31, Schedule 1), University officers, drafters and external users can align operational practice with the legal baseline the statute establishes, reduce the risk of invalid instruments and ensure smoother transitions when legislation is repealed or remade.
