#### 70 Inquiries into accidents etc. (1) Where: (a) an accident: (i) resulting in loss of human life or serious injury to any person; or (ii) involving a train carrying passengers; or (b) any other serious incident; occurs on a railway owned or operated by the Commission, the Minister may, by instrument in writing, establish a Board of Inquiry to inquire into, and report to him on, the circumstances of the accident or incident, as the case may be, and such other matters relating to the accident or incident, as the case may be, as are specified in the instrument. (2) A Board of Inquiry shall be constituted in such manner as is specified in the instrument by which it is established. (3) The provisions of the Royal Commissions Act 1902 apply, with such modifications (if any) as are prescribed by the regulations, to and in relation to a Board of Inquiry as if it were a Royal Commission within the meaning of that Act.
