36A Appointment
(1) The Managing Director is to be appointed by the Commission. (2) The Commission must not appoint the Chair, the Deputy Chair, or a Commissioner referred to in paragraph 24(1)(d), as Managing Director. (3) The appointment of a person as Managing Director is not invalid merely because of a defect or irregularity in relation to the appointment.
