Australian Meat and Live-stock Industry (Repeals and Consequential Provisions) Act 1997

The Act is structured around several interlocking legal concepts. Identifying those concepts as they appear in the text clarifies who decides, who pays and what changes in legal status occur.

Central concepts in the text

• Commencement staging and conditional commencement (s 2): many items are tied to the staged commencement of parts of the Australian Meat and Live‑stock Industry Act 1997. The Act therefore creates temporal legal dependencies. Subsection 2(5) concretely provides that Schedule 2 will not commence and is repealed if Parts 2 and 3 of the 1997 Act commence at the same time. The Note after s 2 describes the intended sequencing for the amendments in Schedule 2 and the repeal in Schedule 4. This creates operational dependence on the timing of the 1997 Act’s Parts.

• Delegation and administrative control (s 8A): the Secretary may delegate "all or any" of the Secretary’s powers under this Act in writing to an officer (Public Service Act 1922 meaning) or an APS employee (Public Service Act 1997 meaning) employed in the Department. The clause centralises administrative power in the Secretary while permitting written delegations down the Department.

• Regulations power (s 9 and Schedule 5 item 51): the Governor‑General may make regulations necessary or convenient to carry out the Act, and Schedule 5 Part 6 lists particular Acts and transitional matters for which regulations may be made. The power is wide and explicitly framed to cover transitional matters arising from the repeal of the Meat and Live‑stock Industry Act 1995 and enactment of the 1997 Act and various levy/charge Acts.

• Vesting and transfer of assets and liabilities (Schedule 5 Part 3 items 11-13): assets and liabilities of three statutory authorities become assets and liabilities of the Commonwealth at commencement time (item 11(1)). An authorised person (Minister or officer authorised in writing , item 10 definition) may direct payments from the CRF to prescribed industry bodies (item 12) and may make written determinations transferring specific assets or liabilities to prescribed industry bodies (item 13). The transfer is subject to conditions set in the direction or determination.

• Payments appropriated out of the Consolidated Revenue Fund (item 12(2), item 21(6)): when authorised directions are given, the specified amount is payable out of the CRF and appropriated accordingly. Item 21 also states amounts payable under its saving provisions are to be paid out of the CRF.

• Conditions and criminal exposure (item 14): recipients of amounts or assets transferred subject to conditions must not contravene those conditions intentionally or recklessly, with a penalty of 120 penalty units and application of Chapter 2 of the Criminal Code.

• Evidentiary and conclusive certificate mechanisms (items 15, 19(3), 20(3)): an authorised person may certify exempt matters for stamp duty (item 15), and certificates identifying land or other assets signed by an authorised person are taken to be such documents unless the contrary is established (items 19(3), 20(3)). These provisions lower transactional friction for registration and stamp duty processes but make certificates prima facie evidence.

• Continuity of rights for staff and transfer of staff (Part 4): staff of the statutory authorities who become "transferring staff members" to prescribed industry bodies are provided continuity of service, preservation of accrued leave entitlements, and particular treatments under the SRC Act and the DFRDB Act (items 26-43). The Act also specifies the effect on maternity leave rights (items 32-33), long service leave arrangements with detailed credit calculations (items 37-42), and limits on superannuation application for prescribed industry bodies (items 34-36).

• Preservation of pre‑existing regulatory instruments (Part 2 items 5-9): export licences, determinations and similar instruments in force immediately before commencement continue to have effect as if issued under corresponding provisions of the new Act, but treated as if issued by the Secretary under the new Act (item 5(1)).

• Repeal and consequential amendment architecture (Schedules 2-4): Schedule 2 amends the Meat and Live‑stock Industry Act 1995 by repealing multiple definitions and parts; Schedule 3 adjusts levy and charge definitions to map revenue flows to the new levy/charge Acts; Schedule 4 repeals a defined list of old Acts.

Definitions and decisionmakers

• "Authorised person" is defined in Schedule 5 Part 3 item 10 as the Minister or an officer authorised in writing by the Minister for the purposes of that Part. This person exercises transfer determinations (items 12-13), directs substitution of parties in pending proceedings (item 18), and issues certificates (items 15, 19, 20).

• "Secretary" is capitalised and given explicit delegation powers (s 8A); the Secretary steps into many roles previously held by the AMLC for continuing instruments (Schedule 5 Part 2 item 5).

• "Prescribed industry body" is used throughout Part 3 and Part 4 as the transferee of assets, liabilities and staff. The Act assumes the existence or later prescription of such bodies; the Act does not define them in the text provided, so prescription will arise elsewhere or by regulation.

Revenue and appropriation concepts

• The Act reassigns revenue streams and levy/charge labels across statutes via Schedule 3 and saves the continued application of repealed Acts in respect of levy/charge imposed before commencement (item 21(1)). It specifies payments are to be made out of the CRF, and amounts payable under the saving provisions are appropriated (item 21(6)).

Transaction‑clearing devices

• Certificates, registers and publication requirements feature as instruments intended to streamline and legitimise transfers and payments: transfers and directions must generally be published in the Gazette (item 12(5)); certificates are taken to be evidence unless the contrary is shown (item 15(3)-(4); items 19(3), 20(3)); land registration officials and asset officials are directed to treat certificates as proper instruments (items 19(2), 20(2)). These devices reduce bilateral frictions but also shift some risk onto the recipient or third parties who deal relying on certificates.

Together, these concepts create a transitional legal architecture: vesting in the Commonwealth, delegated decisionmaking through authorised persons and the Secretary, redirected financial flows through the CRF, preservation of regulatory instruments by a deeming mechanism, and detailed staff transition rules, all underpinned by a broad regulations power for transitional matters.

The Act affects multiple groups with distinct legal positions and economic interests. The primary affected actors and how the text changes their legal situation are set out below.

Statutory authorities previously established under the Meat and Live‑stock Industry Act 1995

• The Meat Industry Council, the Australian Meat and Live‑stock Corporation (AMLC), and the Meat Research Corporation are expressly referenced as "statutory authority" in Schedules 5 Parts 1, 3 and 4 (items 1, 10, 23, 46). Their assets and liabilities vest in the Commonwealth at the commencement time (item 11(1)). They are required to assist the Minister in the transition and to provide written reports about money and assets and to "take such action as the Minister directs" to enable informed decisions (item 2(1)-(2)). The Act therefore changes them from operational statutory bodies to transition objects whose functions are curtailed to facilitating the transition (item 2(1)) and to delivering final reports (Part 5, items 47-49). Part 1 item 3 states that Part 1 is repealed when the Meat Industry Act is repealed, which is relevant to their legal existence.

Prescribed industry bodies

• The Act contemplates "prescribed industry bodies" as recipients of assets, liabilities and payments under written directions and determinations by an authorised person (items 12-13). The Act does not define "prescribed industry body" in the provided text, but repeatedly uses the term as the transferee of funds and assets. Those bodies, once identified, will receive payments from the Consolidated Revenue Fund and may receive specific assets and liabilities subject to conditions. They will assume compliance obligations, including a criminal exposure for intentional or reckless contravention of conditions attached to transfers (item 14(1)). They are also the entities to which amounts that were payable to pre‑commencement statutory authorities are to be paid (item 21(2)-(5)). Thus the Act transfers economic resources and regulatory entitlements to prescribed industry bodies, subject to directions and conditions.

Commonwealth (Minister, authorised officers, Secretary)

• The Commonwealth becomes the holder of the previous statutory authorities’ assets and liabilities at commencement time (item 11(1)). The Minister (or authorised officers acting in writing) is empowered to make determinations, give directions, publish directions in the Gazette and certify exempt matters for stamp duty (item 12, item 13, item 15). The Secretary can delegate powers under the Act to Department officers and APS employees (s 8A), and the Governor‑General has broad regulation‑making power (s 9; Schedule 5 item 51). The Commonwealth thereby becomes the decision‑maker over transfers, payments and transitional prescriptions.

Producers, exporters, processors and licence holders

• Existing export licences, orders, directions, notices and other documents issued by the AMLC under the old Act, and in force immediately before commencement, continue after commencement as if they had been granted by the Secretary under the corresponding provision of Part 2 of the new Act (Schedule 5 Part 2, item 5(1)). Applications made under the old Part 3 may be dealt with under the new Part 2 (item 5(2)). Decisions and determinations of the AMLC continue as if made by the Secretary (item 6). Warrants, nominee appointments and analyst appointments remain effective (items 7-9). This preserves legal rights and regulatory positions of licence‑holders and exporters during the transition.

Employees and transferring staff members

• Staff who were officers or employees of the abolished statutory authorities and who become employed by a prescribed industry body at commencement time are "transferring staff members" (item 23). Their service is taken to be continuous for all purposes (item 31(2)); they are taken to have accrued Long Service Leave, recreation leave and sickness leave entitlements equivalent to those they had as officers immediately before commencement (item 31(3)). The Act preserves obligations under the SRC Act for injuries suffered before commencement (item 26) and imposes cooperation obligations on employers so the Commonwealth can meet rehabilitation obligations (item 28(1)). Superannuation coverage is altered: a prescribed industry body is not an approved authority under certain superannuation Acts and the Minister must not declare a prescribed industry body to be a "relevant body" for the Supervisory Mechanisms Act (items 34-36). Mobility rights under the Public Service Act 1922 may cease at commencement time for transferring staff members (item 45), creating a change in employment status.

Third parties that deal with land and assets

• Land registration officials and asset officials are directed to treat authorised person certificates as proper instruments for registration and transactions (items 19(2), 20(2)). Documents that appear to be certificates are taken to be such certificates unless the contrary is established (items 19(3), 20(3)). Stamp duty exemptions also operate via authorised person certificates and those certificates are evidence unless contrary shown (item 15). Third parties who accept these certificates therefore rely on statutory evidentiary presumptions created by the Act.

Levy and charge payers

• The Act restructures levy/charge labels and the legal liabilities for collection via Schedule 3 and amendments to the Primary Industries Levies and Charges Collection Act 1991 (Schedule 3 items 9-21). It also saves the continuing operation of repealed Acts in respect of levies/charges imposed before commencement (Schedule 5 item 21(1)). Persons who were liable to pay levies under the old statutes may find payment directions and collection obligations preserved or moved to different named Acts. The Primary Industries Act amendments change the definition of "producer" and specify who is taken to be a producer for collection purposes (items 9-18, 20-22 under Schedule 3).

Courts and tribunals

• The Act allows substitution of prescribed industry bodies for statutory authorities in pending proceedings by written direction of an authorised person (item 18). It provides a statutory compensation path where the operation of the Act would otherwise acquire property other than on just terms (item 22). These provisions create litigation vectors for disputes over transfers, compensation, and substituted parties.

In sum, the Act affects: (a) abolished statutory authorities (as they lose functions and have assets/liabilities vested in the Commonwealth); (b) prescribed industry bodies (as recipients of assets, liabilities and payments, and bearers of conditions and criminal exposure); (c) the Commonwealth executive (Minister, authorised officers, Secretary) as the central decision‑maker and funder via the CRF; (d) licence‑holders, exporters, analysts, and nominees whose instruments are preserved but transferred to the Secretary or new framework; (e) transferring staff whose employment status, entitlements and superannuation arrangements are recalibrated; (f) levy/charge payers who face redirected collection regimes; and (g) third parties who register or deal with land and assets subject to authorised certificates.

This section sets out the principal duties imposed by the Act and the rights that the Act preserves or creates, with reference to the specific provisions.

Duties imposed on statutory authorities

• Assist in transition (Schedule 5 Part 1 item 2): It is a function of each statutory authority "to assist in relation to matters relevant to, or arising out of, the commencement of Part 3 of the new Act, the repeal of the Meat Industry Act and the intended operation of Parts 3 and 4 of this Schedule" (item 2(1)). Assistance includes providing the Minister, at the Minister’s request, with a written report containing full particulars of the money and other assets of the authority (item 2(2)(a)), taking action directed by the Minister to enable properly informed decisions about assets and liabilities (item 2(2)(b)), and reimbursing the Commonwealth for money expended by the Commonwealth in relation to these matters (item 2(2)(c)). These are mandatory functions assigned to the authorities until Part 3 of the new Act commences (item 3).

Duties of the Secretary and delegation

• Delegation (s 8A): The Secretary may, in writing, delegate all or any of the Secretary’s powers under the Act to an officer or an APS employee working in the Department. The power to delegate is a duty to maintain administrative operation by authorising subordinates to act; it centralises administrative control but permits operational delegation.

Duties of the authorised person (Minister or authorised officer)

• Direction of payments (Schedule 5 Part 3 item 12): An authorised person may direct that specified amounts be paid to a prescribed industry body or other person, subject to conditions about use or expenditure. The direction triggers payment from the Consolidated Revenue Fund appropriated accordingly (item 12(2)) and must be published in the Gazette (item 12(5)). The authorised person may also identify assets to be transferred to a prescribed industry body and set conditions about their use or disposal (item 13(1)). An authorised person can also make determinations allowing instruments to continue with references altered to prescribed industry bodies (item 17) and can substitute prescribed bodies for statutory authorities in pending proceedings (item 18). The authorised person therefore has broad administrative and transactional duties.

Duties of prescribed industry bodies and recipients of transferred assets/amounts

• Compliance with conditions (item 14): A prescribed industry body or other person to whom an asset is transferred or an amount is paid under items 12 or 13 must not contravene the conditions, either intentionally or recklessly. Contravening this duty attracts a penalty of 120 penalty units and application of Chapter 2 of the Criminal Code (item 14(1)-(2)). Payment recipients must also observe any conditions attached and can be required by an authorised person to use funds in a specified manner.

Duties regarding records and archives

• Archives Act compliance (item 16): The Act does not authorise a Commonwealth record to be transferred or otherwise dealt with except in accordance with the Archives Act 1983. A Commonwealth record must not be transferred to a person under this Part unless the Australian Archives has given permission under paragraph 24(2)(b) of that Act (item 16(1)-(2)). This imposes a duty to obtain archival permission before transferring Commonwealth records.

Duties and rights in relation to staff

• Continuity of service and entitlements (item 31): A transferring staff member’s service is taken to be continuous, and accrued entitlements to Long Service Leave Act benefits, recreation leave and sickness leave and recognition of years of service are preserved (item 31(2)-(3)). The SRC Act continues to apply to injuries and loss/damage to property suffered before commencement (item 26). The Commonwealth is liable to pay certain liabilities of the AMLC under the SRC Act and is taken to have been the employer for certain purposes (item 27). Employers must provide cooperation to enable the Commonwealth to fulfil rehabilitation obligations under specified SRC Act sections (item 28(1)). For superannuation, the prescribed industry body is not an approved authority under certain Superannuation Acts and the Minister must not declare a prescribed industry body to be a relevant body under the Supervisory Mechanisms Act (items 34-36). The Act thus creates a mix of protective rights for staff (continuity, preserved leave, SRC coverage for pre‑commencement injuries) and altered obligations (changes to superannuation recognition and loss of some Commonwealth mobility rights).

Rights preserved for licensees, analysts and nominees

• Continuity of instruments (Part 2 items 5-9): Subject to commencement, existing export licences, orders, directions, determinations, warrants, nominations and analyst appointments in force immediately before commencement continue to have effect and are to be treated as if granted, made, issued or given by the Secretary under the corresponding provisions of the new Act (item 5(1); item 6). Applicants may have their applications continued under the new Part 2 (item 5(2)). This preserves existing regulatory rights and statuses.

Rights and duties for third parties dealing with land and assets

• Registration and certificate effects (items 19-20): If the authorised person provides a certificate identifying land or other assets as having become land or assets of a prescribed industry body, the relevant registrar or assets official may register and give effect to the certificate (items 19(2), 20(2)). Documents that appear to be certificates are taken to be such certificates and properly given unless contrary is established (items 19(3), 20(3)). This creates a substantive right for third parties to rely on the authorised person’s certificate for transactional effect.

Duty to publish certain directions

• Directions and determinations required to be published (item 12(5), item 13(4)): A copy of each direction or determination must be published in the Gazette. This imposes a duty of public notice on the authorised person and creates a contemporaneous administrative record.

Saving rights regarding levies and charges

• Continuation of collection rules (item 21(1)-(5)): Despite repeal or amendment of Acts that impose levies or charges, the Acts and any regulations and agreements continue to apply in relation to a levy or charge imposed before the commencement time as if the prior Acts had not been repealed or amended. The Act also requires amounts payable to statutory authorities or prescribed bodies as a consequence of pre‑commencement liabilities to be paid to prescribed industry bodies (items 21(2)-(5)). This preserves payers’ obligations and creates a statutory right for prescribed bodies to receive prior amounts.

Compensation and property rights

• Just terms compensation (item 22): If the operation of this Act would result in the acquisition of property other than on just terms, an affected person has a right to reasonable compensation from the Commonwealth, either by agreement or as determined by a court of competent jurisdiction (item 22(1)). Item 22 invokes the constitutional notions of acquisition and just terms and creates a remedies pathway.

Regulatory and rule‑making powers

• Regulations (s 9; Schedule 5 item 51): The Act gives the Governor‑General power to make regulations on matters required or permitted by the Act and those necessary or convenient to carry out the Act. Part 6 item 51 lists Acts and transitional matters for which regulations may be made. This is a broad administrative power and creates an on‑going duty on the executive to make and prescribe the details the Act contemplates.

In short, the Act imposes duties on abolished statutory authorities to cooperate and report, empowers the Commonwealth executive to determine transfers and payments, requires recipients of transfers to comply with conditions (with criminal penalties for intentional or reckless contraventions), preserves rights of licence‑holders by deeming continuity under the Secretary, protects certain staff entitlements while altering superannuation and mobility rights, preserves levy collection regimes for pre‑commencement liabilities, and provides a statutory portal for compensation where property is effectively acquired other than on just terms.

The Act sets limited but significant criminal and administrative enforcement mechanisms. The enforcement architecture in the text combines statutory penalties, criminal law incorporation, administrative publication and evidentiary presumptions.

Criminal penalty for contravention of conditions on transferred assets and payments

• Item 14(1) creates a specific criminal offence for a prescribed industry body or other person who is given an asset or amount under items 12 or 13 and who contravenes the condition attached to that transfer "either intentionally or being reckless as to the condition." The penalty for that offence is 120 penalty units. Item 14(2) expressly applies Chapter 2 of the Criminal Code to offences against item 14. The Act therefore elevates contravention of transfer conditions , where the Commonwealth has transferred assets or funds subject to conditions , to an offence within the federal criminal regime and ties sentencing and general criminal provisions to the Criminal Code.

Administrative enforcement and review mechanisms

• Publication and transparency (items 12(5), 13(4)): Directions and determinations must be published in the Gazette. Publication creates administrative transparency and produces an official record against which compliance and enforcement may be measured. It also enables interested parties to identify obligations and permitted uses, which supports administrative accountability and potential judicial review if administrative decisions are procedurally defective.

• Deeming of prior instruments to new decision‑maker jurisdiction (items 5-9): Existing export licences, directions, determinations, warrants and analyst appointments continue to have force as if issued by the Secretary under the new Act. This continuity reduces enforcement gaps in regulation of exports and related matters, because the Secretary has the domestic enforcement powers under the new Act. The Act does not itself specify appeal or merits review paths for decisions continued under the deeming provisions; those review paths will be found within the new Act or general judicial review principles.

Evidentiary presumptions and transactional enforcement

• Certificates as evidence and presumptive validity (items 15, 19(3), 20(3)): An authorised person’s certificate that a matter is an exempt matter for stamp duty (item 15(2)) is declared to be "evidence of the matter stated in the certificate" (item 15(3)). A certificate identifying land or other assets that appears to be such a certificate is taken to be such a certificate and to have been properly given unless the contrary is established (items 19(3), 20(3)). These presumptions simplify enforcement by making the authorised person’s certificate a strong procedural vehicle for effecting transfers and registrations. They also shift the burden to challengers to disprove the certificate’s validity. Registration and asset officials are empowered to treat the certificates as proper instruments (items 19(2), 20(2)), which enforces the transfers administratively.

Financial enforcement by appropriation and payment directions

• Payments out of the Consolidated Revenue Fund (item 12(2), item 21(6)): Amounts specified in an authorised person’s direction are payable out of the CRF and are appropriated accordingly. This both enforces the transfer by making funds available and creates a budgetary commitment that is under Commonwealth control. Item 21(6) similarly appropriates amounts payable under its saving provisions.

Criminal Code application

• Chapter 2 of the Criminal Code applies to offences under item 14 (item 14(2)). This places offences under the general framework of Commonwealth criminal law, enabling the application of standard evidentiary, procedural and sentencing provisions. The Act does not create additional enforcement agencies; enforcement would be undertaken by Commonwealth prosecutors and law enforcement as per criminal law practice.

Potential enforcement through courts

• Compensation and acquisition (item 22): Item 22 creates a civil remedy pathway by which a person whose property is acquired otherwise than on just terms may obtain compensation either by agreement with the Commonwealth or, failing agreement, by determination of a court of competent jurisdiction. This is an enforcement mechanism against the Commonwealth’s taking of property rights and places such disputes within the ordinary civil court system.

Miscellaneous compliance obligations with potential penalties elsewhere

• The Act incorporates existing frameworks that contain their own enforcement provisions. For example, continuity of application of the SRC Act (item 26) means claims, liabilities and penalties under that Act remain enforceable as to injuries and property loss suffered before commencement. The Act’s preservation of existing instruments (items 5-9) likewise moves enforcement responsibility to the Secretary under the new Act’s regulatory framework, which will include the enforcement tools of that new Act even though those tools are not repeated in the provided text.

Limitations and concrete detail

• The Act does not itself create extensive bespoke regulatory sanctions aside from item 14. Instead it relies on:
  • criminal enforcement via Chapter 2 of the Criminal Code for contravention of conditions attached to asset/amount transfers;
  • administrative enforcement via publication and registration mechanisms;
  • existing enforcement regimes in preserved Acts and the new Australian Meat and Live‑stock Industry Act 1997;
  • civil remedies through compensation for acquisitions not on just terms.

Operationally, the most direct statutory penalty created by this instrument is the 120 penalty unit sanction for intentional or reckless contravention of conditions attached to asset or payment transfers under items 12 and 13. The combination of Gazette publication, evidentiary presumptions for authorised certificates, and the CRF appropriation for payments supplies enforcement and implementation pathways that are administrative rather than criminal for most transitional acts, reserving criminal enforcement for breach of conditions specified by the authorised person.

This Act is explicitly consequential and interacts with a suite of other Commonwealth statutes and statutory instruments. The text supplies multiple cross‑references and saving arrangements that determine legal interplay.

Relationship with the Australian Meat and Live‑stock Industry Act 1997

• Conditional commencement and subjectivity: Sections 2, 3 and 8 of this Act tie commencement dates and effect to the staged commencement of Parts of the Australian Meat and Live‑stock Industry Act 1997. Section 8 states the Act "has effect subject to Division 3 of Part 2 of the Australian Meat and Live‑stock Industry Act 1997," signalling that Division 3 of Part 2 of that Act may pre‑empt or limit operation here. Subsection 2(3)-(5) conditions many Schedules’ commencement on the commencement of Parts 2 and 3 of the 1997 Act. The Note after s 2 explicitly explains that the amendments in Schedule 2 are only necessary if export regulatory provisions in Part 2 of the 1997 Act commence before Part 3, and that when Part 3 commences the Meat and Live‑stock Industry Act 1995 will be repealed by Schedule 4 to this Act. Thus the Act is designed to operate in close sequence with the 1997 Act and to avoid duplication or conflict by conditional repeal and non‑commencement.

Repeal and amendment of prior Acts

• Schedule 2 effects numerous amendments to the Meat and Live‑stock Industry Act 1995 (Schedule 2 items 1-19), removing many definitions and repealing whole subdivisions and divisions. Schedule 4 expressly repeals a list of legacy Acts, including the Meat and Live‑stock Industry Act 1995 and related levy Acts. These repeals interact with residual rights and obligations through Schedule 5 saving provisions. Item 21(1) saves the continued application of an Act or its regulations in relation to levies/charges imposed before commencement even if the Act has been repealed or amended, ensuring continuity of collection obligations.

Mapping levy and charge regimes across Acts

• Schedule 3 makes consequential amendments to multiple Acts that govern levies, charges and the collection regime,Australian Animal Health Council Act, National Cattle Disease Eradication Trust Account Act, National Residue Survey Acts, Primary Industries Levies and Charges Collection Act 1991, and Schedules 1-2 insert and remove named levy and charge Acts from the Primary Industries schedules. These changes reassign levy labels and revenue flows to the suite of 1997 Acts (e.g., Buffalo Export Charge Act 1997, Cattle Transactions Levy Act 1997). Schedule 5 item 21(1) saves pre‑commencement levies so revenue collection remains lawful during the transitional period. In short, the Act reconfigures the fiscal architecture of industry levies and aligns collection under the Primary Industries Levies and Charges Collection Act 1991 with the new 1997 levy/charge Acts.

Interaction with the Criminal Code and other Commonwealth statutes

• Item 14(2) applies Chapter 2 of the Criminal Code to offences created in item 14(1). The Act also references the Consolidated Revenue Fund for appropriation (items 12(2), 21(6)), engages the Archives Act 1983 for records transfers (item 16), and uses definitions from the Public Service Acts (s 8A cross‑references the Public Service Act 1922 and Public Service Act 1997). Schedule 5 Part 4 cross‑references numerous employment and social security statutes and schemes, including the SRC Act, DFRDB Act, Long Service Leave Act, Maternity Leave Act, OHS Act and the Superannuation Acts. These cross‑references preserve and calibrate rights and liabilities under those laws for transferring staff.

Evidentiary interaction with registration systems at State/Territory level

• Items 19 and 20 empower land registration officials and assets officials under State and Territory laws to register and give effect to an authorised person’s certificate. Item 15 creates a stamp duty exemption under State/Territory law for "exempt matters" and permits the authorised person to certify an exempt matter; the certificate is to be taken as evidence. These provisions interact directly with State and Territory land registration and stamp duty regimes by directing officials to treat Commonwealth certificates as sufficient for registration and exemption, subject to the contrary being established.

Interaction with constitutional property protections

• Item 22 acknowledges that if the operation of the Act would result in an acquisition of property otherwise than on just terms, compensation is payable under section 51(xxxi) constitutional principles. The item remedies acquisition by agreement or court determination, thus interacting with constitutional property acquisition law.

Regulation‑making and subordinate legislation

• Section 9 and Schedule 5 item 51 provide broad regulation‑making powers for transitional matters and expressly list several 1997 Acts for which regulations may address transitional consequences. This establishes a mechanism to fill gaps or manage detailed interactions through subordinate instruments rather than primary legislation.

Preservation of pre‑existing regulatory action

• Items 5-9 in Schedule 5 Part 2 deem actions of the AMLC under the old Act to continue under the new Act as actions of the Secretary. This creates an administrative continuity: enforcement, licensing and regulatory obligations continue under the new statutory head without interruption.

In practice, therefore, this Act does not operate in isolation. It is an enabling, transitional and corrective instrument that reorganises statutory relationships among Commonwealth Acts, links Commonwealth administrative decisions to State/Territory registrars and fiscal systems, reassigns levy revenue flows, and preserves, where necessary, rights and obligations under the old regime until transitions are effected under the new.

The textual material provided is itself an Act that makes amendments and repeals but does not include a narrative of subsequent amending Acts or later revisions. The document contains within it an internal amendment and repeal programme, which is its own amendment history in effect.

Key amendment and repeal steps enacted by this instrument

• Replacement of administrative provisions: Section 8A replaces an earlier section (the document indicates "Repeal the section, substitute:" for s 8A and s 9) to provide an explicit delegation power for the Secretary (s 8A) and to restate the regulations power (s 9). These are operational amendments to the Act’s core administrative clauses.

• Schedule 2 amendments to the Meat and Live‑stock Industry Act 1995: Schedule 2 removes multiple definitions from s 52 of the 1995 Act (definitions such as authorised officer, covering, enter, evidential material, examine, export licence, live‑stock export licence, meat export licence, occupier, offence against this Part, premises, registered premises in items 2-13). It omits "and control" from paragraph 51(1)(a) (item 1). It substitutes "and promote" for "promote and control" in paragraph 54(c) and repeals paragraph 54(d) (items 14-15). It repeals Subdivisions B and C of Division 2 of Part 3 and repeals Division 7 of Part 3 and sections 161-162 and paragraph 163(2)(b) (items 16-19). Item 20 extends the date in s 227 from "30 June 1998" to "31 December 1998". These are substantive amendments to the 1995 Act’s regulatory architecture.

• Schedule 3 consequential amendments: Schedule 3 makes a series of amendments across a number of Acts to align levy and charge definitions with the new 1997 levy/charge Acts. It replaces the Australian Animal Health Council levy definition to list specific levy provisions under the 1997 Acts and other Acts (item 1); amends the National Cattle Disease Eradication Trust Account Act 1991 to add revenue entries corresponding to levy/charge Acts (items 2-5); adjusts definitions in the National Residue Survey (Livestock Slaughter) Levy Act 1992 to alter the composition of "livestock" (items 7-8); extensively amends the Primary Industries Levies and Charges Collection Act 1991 to alter the definition of "producer", update cross‑references and schedules to reflect the new Acts, and add new entries to Schedules 1 and 2 (items 9-22). These are consequential legislative alignments to direct revenues and collection mechanics to the new scheme.

• Schedule 4 repeals Acts: Schedule 4 lists and repeals multiple prior Acts in full, including the Cattle Export Charges Act 1990, Cattle Transaction Levy Act 1995, Live‑stock Export Charge Act 1977, Live‑stock Slaughter Levy Act 1964, Meat and Live‑stock Industry Act 1995, Meat and Live‑stock Industry Legislation Repeal Act 1995, and National Residue Survey (Cattle Export) Levy Act 1995, National Residue Survey (Cattle Transactions) Levy Act 1995 (Schedule 4 item 1). This is the direct repeal step that clears the statutory slate for the new regime.

• Schedule 5 transitional, saving and consequential provisions: Schedule 5 itself is a comprehensive package of transitional rules relating to functions, regulatory continuity, vesting of assets and liabilities, payments to prescribed industry bodies, transfer of staff and associated employment rights and liabilities, long service leave and superannuation carve‑outs, the preservation of levies and charges and payment redirection, certificates for registration and stamp duty exemptions, final annual reports and regulation‑making for transitional matters (Parts 1-6). Schedule 5 therefore effects the operational transitional machinery necessary to implement repeal and replacement.

Conditional and temporal amendment mechanics

• The Act’s commencement structure (s 2) makes multiple amendments conditional on the staged commencement of Parts of the Australian Meat and Live‑stock Industry Act 1997. Subsection 2(5) specifically provides that if Parts 2 and 3 of the 1997 Act commence at the same time, Schedule 2 will not commence and is repealed at commencement of Part 3 of the 1997 Act. Section 3 further provides a contingency where amendments in Schedule 3 have effect as if they were amendments of the National Cattle Disease Eradication Reserve Act 1991 if another amending Act (Audit (Transitional and Miscellaneous) Amendment Act 1997) commences on or before the commencement of Schedule 3.

No subsequent amendments recorded in the provided text

• The document supplied does not contain later amending instruments or a chronology of subsequent revisions. The "amendment history" here therefore consists of the enumerated changes the Act itself effects to previous statutes and the contingent commencement architecture that manages temporal interactions with related 1997 statutes.

Where to look for further amendment history

• For any post‑1997 amendments to this Act, or for determinations under its delegated powers, one must consult the legislative history databases, the Federal Register of Legislation for instrument versions, and subsequent amending Acts, which are outside the scope of the supplied text. The Act itself preserves many transitional directions that delegate the detailed adaptation to regulation, Ministerial direction and authorised officer determinations.

The text provided contains no judicial decisions, references to cases, or a litigation record; it is a primary statute and not a compendium of case law. Therefore there is no litigation history contained in the source to report. Nonetheless, the Act creates several statutory hooks that are likely to give rise to litigation risks and potential claims, and those are set out here as legal vectors grounded in the Act’s provisions.

Potential litigation vectors grounded in the Act

• Compensation for acquisition of property (item 22): Item 22 explicitly recognises that if the operation of the Act would result in acquisition of property otherwise than on just terms, compensation is payable by the Commonwealth. Where the Commonwealth and an affected person cannot agree on "such reasonable amount of compensation," the amount is to be determined "by a court of competent jurisdiction." Item 22 therefore contemplates and provides a pathway for litigated claims under constitutional acquisition law principles (referenced to paragraph 51(xxxi) of the Constitution in the item). Any dispute over whether a taking has occurred, the characterization of the interest acquired, or the quantum of just terms compensation would be contested in court.

• Criminal prosecutions for contravention of transfer conditions (item 14): Item 14 creates a criminal offence with a penalty of 120 penalty units for intentional or reckless contravention of conditions attached to asset transfers or payments under items 12 or 13. Prosecutorial discretion and evidentiary disputes in any prosecution under this clause could produce contested litigation. The Act applies Chapter 2 of the Criminal Code to such offences, invoking the full machinery of the Criminal Code for legal definitions, mental element, and sentencing.

• Disputes over transfer determinations and directions (items 12-13): The authorised person’s powers to direct payments from the CRF and to make written determinations transferring particular assets and liabilities to prescribed industry bodies are broad. Affected parties could seek judicial review on administrative law grounds where the authorised person acts outside power, fails to observe procedural fairness in an adverse decision affecting rights, or misconstrues conditions. Litigation could also arise from interpretation of those conditions and whether a body has contravened them. The Act’s requirement for Gazette publication may affect standing and timeliness of review challenges.

• Challenges to evidentiary certificates (items 15, 19, 20): The Act declares that certain authorised person certificates are evidence and that documents that appear to be such certificates are taken to be such certificates unless contrary is established. Litigation could arise where a third party disputes the validity or contents of a certificate, alleges fraud or administrative error, or points to non‑compliance with the Archives Act condition for transfer of Commonwealth records (item 16). Courts may be asked to determine whether the certificate was properly given or whether reliance upon it was reasonable.

• Employment and superannuation disputes (Part 4 items 26-45): The Act modifies staff status, preserves some entitlements and removes certain approvals under superannuation Acts for prescribed industry bodies (items 34-36). Potential litigation vectors include claims for entitlements after transition, disputes about continuity of service, entitlements to long service leave credit calculations under items 38-41, or claims arising from termination or redundancy where workers contend the Act or authorised determinations were misapplied.

• Substitution of parties in pending proceedings (item 18): Item 18 permits an authorised person to direct substitution of a prescribed industry body for a statutory authority as a party to proceedings pending at commencement time. Disputes may arise over the propriety of substitution directions, procedural fairness, or whether substitution prejudices litigants’ rights. A substituted party may bring its own litigation to clarify liability or seek relief.

• Levy and charge collection disputes (item 21 and Schedule 3): Item 21 saves the continued application of repealed Acts in relation to levies or charges imposed before the commencement time. Disputes over liability to pay levies already imposed, whether a levy was lawfully imposed or calculated, or the reallocation of revenue between statutory authorities and prescribed industry bodies could generate litigation.

• Constitutional or jurisdictional challenges connected to commencement sequencing (s 2): The Act’s conditional commencement structures (s 2) and subjectivity to Division 3 of Part 2 of the 1997 Act (s 8) could give rise to disputes about whether particular Schedules or provisions are in force at a given time. Parties may litigate the legal status of a provision when regulatory action is taken during a contested commencement window.

Absence of reported cases in the text

• No cases are named or cited in the provided Act text. Any actual litigation that arose from implementation of the Act would be found in external case law databases, litigation registries, or reports and is not summarised within this document.

For practitioners, the Act therefore contains several plausible litigation triggers: acquisition and compensation claims (item 22), prosecutable contraventions of transfer conditions (item 14), judicial review of transfer/direction determinations (items 12-13), disputes over certificates (items 15, 19-20), employment and superannuation claims (Part 4), levy disputes (item 21; Schedule 3), and commencement sequencing litigation (s 2). Each of these potential disputes arises from explicit provisions in the Act and suggests the types of claims one should expect to manage or litigate in the absence of further implementing instruments or negotiated settlements.

This section flags traps, legal frictions and operational features in the Act that may produce surprises in practice. Each point is grounded in the Act’s text.

1. Conditional and potentially confusing commencement sequencing (s 2)

• The Act ties the commencement of many Schedules to the staged commencement of Parts of the Australian Meat and Live‑stock Industry Act 1997 (s 2(3)-(5)). Subsection 2(5) provides that if Parts 2 and 3 of the 1997 Act commence at the same time, Schedule 2 does not commence and is repealed. The Note after s 2 emphasises that Schedule 2’s amendments are only needed if Part 2 of the 1997 Act starts before Part 3. Practitioners should not assume all Schedules are in force on Royal Assent; timing matters and different provisions may be in force or repealed depending on the commencement sequence. Administrative action during transitional windows risks operating under the wrong legal basis.

2. Broad delegation to Department personnel (s 8A)

• Section 8A permits the Secretary to delegate "all or any" of the Secretary’s powers under the Act to an officer or APS employee employed in the Department. The breadth of the clause means many material decisions and determinations (e.g., those contemplated in Schedule 5 items 12-13) could be taken not by the Minister but by delegated officers. Delegation instruments should be carefully drafted and published to avoid disputes about authority.

3. Authorised person discretion and conditional transfers (Schedule 5 Part 3 items 10-13)

• The authorised person (Minister or officer authorised in writing) may direct payments to prescribed industry bodies from the CRF and transfer particular assets or liabilities to prescribed industry bodies, subject to conditions. These are broad discretionary powers and they include the power to set use or disposal conditions. The text does not constrain the content of conditions, though the condition breach offence attaches criminal liability. Because the authorised person can both make the transfer and set conditions, potential conflicts of interest or perceptions of favouritism may arise unless decisions are transparent and published (item 12(5)).

4. Criminal exposure for contravening conditions (item 14)

• Recipients of transferred assets or amounts face a criminal penalty,120 penalty units,if they intentionally or recklessly contravene conditions attached to transfers. The Act applies the Criminal Code to such offences. Bodies accepting transferred assets must ensure internal compliance systems are robust and that conditions are carefully reviewed before acceptance. The mens rea standard includes recklessness, which is a higher risk than a strict liability or negligence standard.

5. Certificates taken as evidence and prima facie valid unless contrary is established (items 15, 19(3), 20(3))

• Authorised person certificates for stamp duty exemption and for land/asset transfer or registration are taken to be evidence and "a document that appears to be a certificate" is taken to be such a certificate unless the contrary is established. This legal presumption eases transactions but creates a risk: courts may be asked to determine later whether a certificate was in fact improperly issued. Until successfully challenged, such certificates can have binding transactional effects. Practitioners should validate the provenance of certificates and, where possible, require underlying determinations or Gazette publications.

6. Archive permission requirement (item 16)

• The Act does not authorise transfer of Commonwealth records except in accordance with the Archives Act 1983. Transfers of Commonwealth records to persons under the Part require permission of the Australian Archives. Failure to obtain such permission could render a transfer unauthorised and legally challenged. The Act places the onus on the authorised process to comply with the Archives Act.

7. Superannuation carve-outs (items 34-36)

• The Act specifies that section 145 of the Superannuation Act 1922 does not apply in relation to a prescribed industry body (item 34) and that a prescribed industry body is not an approved authority for the purposes of the Superannuation Act 1976 or the Superannuation Act 1990 (item 35). The Minister must not declare a prescribed industry body to be a relevant body under the Superannuation Benefits (Supervisory Mechanisms) Act 1990 (item 36). These changes limit the statutory superannuation protections for prescribed industry body employees and may have consequences for employees’ post‑transition retirement benefits. Employment counsel and HR practitioners need to review the superannuation status of transferring staff and contractually address potential gaps.

8. Loss of public service mobility rights (item 45)

• If certain divisions of the Public Service Act 1922 applied immediately before commencement to a person who becomes a transferring staff member, those divisions stop applying at commencement time and the person stops being an officer of the Australian Public Service. Similarly, Division 4 and the Officers’ Rights Declaration Act 1928 may cease to apply. Transferring staff may therefore lose mobility, redeployment, and other public service protections at commencement. This change can affect bargaining, redundancy risk, and appeals rights.

9. Complex long service leave calculations and eligibility traps (items 38-41)

• The Act provides detailed rules for long service leave credits, distinguishing employees with less than ten years of service at commencement from those with at least ten. For less than ten years’ service, combined service periods, the circumstances under which leave on full salary or on half salary can be granted, and the mechanics of payments in lieu are all precisely set out (items 38-41). Misapplication of these rules could produce underpayments or disputes. Practitioners should model entitlements carefully against the detailed subitem calculations.

10. Saving of pre‑commencement levy and charge regimes (item 21)

• Despite the repeal and amendment of levy Acts, item 21 saves the operation of repealed or amended Acts in relation to levies or charges imposed before commencement and preserves agreements between Commonwealth and States. This preserves existing payers’ obligations and revenue streams but can complicate accounting and collection when a new levy regime is in place concurrently. Careful reconciliation and communication to payers are necessary.

11. Appropriation and fiscal commitments (items 12(2), 21(6))

• Payments directed by an authorised person are made out of the Consolidated Revenue Fund and are appropriated accordingly. Item 21(6) also appropriates amounts payable under the saving provisions. These create real fiscal commitments from the Commonwealth. Departments and finance officers must ensure budgetary provision and record keeping.

12. Undefined "prescribed industry body" in the provided text

• The Act repeatedly uses "prescribed industry body" as the recipient of assets, liabilities and staff and as the entity to which amounts are payable. The supplied text does not define that term. The absence of a definition in the provided materials means implementers must find the definition elsewhere (perhaps in the 1997 Act or by regulation) or risk uncertainty about the identity of transferees. This is a practical "gotcha" for lawyers and administrators conducting transfers.

Taken together, these features create concentrated discretion in the Commonwealth executive, create strong evidentiary presumptions that facilitate transfers, shift retirement benefit entitlements, and expose recipients to criminal risk for contravening conditions. Each of these elements requires active administrative control, careful documentation, and often coordination with State/Territory officials to avoid unintended legal consequences.

This section gives concrete steps, checks and procedural measures, tied to the relevant sections and items of the Act, that parties affected by the transition should take to comply with the Act’s obligations and to manage legal risk.

For statutory authorities (Meat Industry Council, AMLC, Meat Research Corporation)

• Provide the Minister with requested written reports on money and assets (Schedule 5 Part 1 item 2(2)(a)). Ensure reports are full and dated, and include legal descriptions, account balances, contingent assets and contingent liabilities.
• Maintain and be prepared to transfer records only in compliance with the Archives Act 1983 (item 16). Before any record is transferred, obtain written Australian Archives permission under paragraph 24(2)(b) of the Archives Act.
• If directed by the Minister, take the actions the Minister specifies to enable informed decisions about assets and liabilities (item 2(2)(b)), including material disclosure and cooperation in valuations, contracts and litigation file transfers.
• Reimburse the Commonwealth for expenditures reasonably required and as directed (item 2(2)(c)) where applicable, and ensure proper accounting and backup documentation for reimbursements.

For the Secretary/Department officials

• Use the delegation power in s 8A to document in writing any delegations to officers or APS employees. Make delegation instruments explicit about the scope of the delegate’s authority, instruments that must be signed by the Secretary personally, and the accountability and reporting mechanisms.
• When continuing licences, orders and determinations under Schedule 5 Part 2 item 5(1), keep a clear register of instruments taken to continue, the original issuing instrument, and the mapping to the corresponding provision in the new Act.
• When making directions or determinations under Schedule 5 Part 3 items 12-13, set out conditions precisely. Ensure Gazette publication of each direction or determination (item 12(5), item 13(4)). Maintain clear records to evidence compliance with the conditions and the legal basis for the direction.

For authorised persons (Minister or officers authorised in writing)

• When issuing directions under item 12 or determinations under item 13:
  • Identify the prescribed industry body clearly and ensure it is lawfully prescribed.
  • Set conditions that are clear, measurable and time‑bounded where possible; record the legal basis for each condition.
  • Publish the direction/determination in the Gazette promptly (item 12(5), item 13(4)).
  • Ensure the Consolidated Revenue Fund appropriation is handled through proper Treasury channels and that accounting and reporting controls are in place (item 12(2)).
• Ensure that certificate practices under items 15, 19 and 20 follow internal verify‑and‑sign procedures so that authorised person certificates are properly prepared, because those certificates are prima facie evidence.

For prescribed industry bodies and recipients of transferred assets/amounts

• Before accepting any transferred asset or amount subject to conditions:
  • Obtain a copy of the direction/determination and its conditions.
  • Conduct internal legal review of conditions to ensure ability to comply.
  • Put internal controls and compliance monitoring in place to prevent intentional or reckless contravention; contravention is an offence carrying a 120 penalty unit maximum and application of the Criminal Code (item 14).
• For transfers of land or registrable assets, ensure the authorised person’s certificate is lodged with the relevant Registrar or assets official and maintain copies of the certificate and any mapping determinations (items 19, 20).
• If receiving funds from the CRF under a direction, account for those funds strictly according to the specified use and record spending against the conditions.

For staff and human resources departments (transferring staff members)

• Treat employment as continuous for leave and service purposes (item 31(2)-(3)). Record service histories, accruals and existing leave credits accurately.
• Review long service leave entitlements carefully, especially for staff with less than ten years service immediately before commencement. Use the specified "long service leave credit" calculations in item 41 to determine entitlements, and observe the rules about granting full salary leave or half salary leave (items 38-41).
• For maternity leave, observe that the Maternity Leave Act continues to apply in relation to confinements as specified in items 32-33; HR should record maternity leave triggers occurring before and after commencement and ensure the prescribed industry body treats those employees as if the prescribed industry body were a prescribed authority.
• Review superannuation arrangements: prescribed industry bodies are not approved authorities under certain Superannuation Acts (items 34-36). Confirm whether alternative private or award superannuation arrangements are required and advise staff of any changes to accruals or employer contributions.

For levy and charge payers and finance teams

• Understand that levy and charge Acts may have been re‑labelled and that some collection rules remain in force for levies imposed before commencement (Schedule 3 and Schedule 5 item 21(1)). Confirm current payer liability under the Primary Industries Levies and Charges Collection Act 1991 as amended by Schedule 3 to see who is taken to be the "producer" for collection purposes (Schedule 3 items 9-14).
• Keep documentation of pre‑commencement liabilities and any amounts payable to statutory authorities, because the Act redirects or preserves payments to prescribed bodies (item 21(2)-(5)).

For State and Territory registrars and asset officials

• When presented with an authorised person’s certificate under items 19 or 20, treat the certificate as proper for registration and effect transactions accordingly (items 19(2), 20(2)). Understand that documents that "appear to be a certificate" will be taken as such unless the contrary is established; ensure internal procedures for verifying authenticity and seek legal advice where doubt exists.
• For stamp duty matters, if presented with an authorised person’s certificate for an "exempt matter" under item 15, treat the certificate as evidence of exemption unless the contrary is established. Ensure that procedures for lodging and verifying such certificates follow the lawful requirements.

For legal counsel and compliance officers

• Be alert to the criminal exposure in item 14 and advise client organisations to obtain legal and compliance clearance before accepting conditional transfers.
• Where the Act vests assets in the Commonwealth and then allows the authorised person to sell or transfer assets (item 13(2)), ensure any sale processes are compliant with procurement and disposal law and that title issues are cleared with land registries per item 19.
• Monitor for Gazette publications of directions and determinations (items 12(5), 13(4)), subscribe to the Gazette, and maintain contemporaneous records of any instruments affecting clients.
• Where property rights are affected, consider early negotiation for just terms compensation if acquisition exposure is present (item 22).

Operational checklists

• Verify commencement status of relevant provisions (s 2) before acting.
• Obtain and retain copies of any direction, determination or authorised person certificate.
• Ensure Gazette publication is cross‑checked and archived.
• Confirm Archives Act permissions before transferring records.
• Conduct due diligence on assets and liabilities proposed for transfer; obtain legal title searches and verify encumbrances.
• Put compliance monitoring in place for conditions attached to transfers; implement internal audit and reporting obligations.
• Ensure employment contracts and benefits reflect continuity of service and the changed superannuation framework.

Following these concrete steps, and keeping reference to the specific items cited above, will reduce legal risk and align operations with the statutory transitional requirements the Act prescribes.
