Australian Grands Prix (Formula One) Regulations 2016 (Victoria)

These Regulations set out detailed, event‑specific rules governing access, behaviour, safety controls, enforcement powers and commercial activity for the Australian Formula One Grand Prix at Albert Park. They are made under s 51 of the Australian Grands Prix Act 1994 (reg 2) and operationalise the Act’s event management objectives (reg 1). Mechanically, the instrument does the following.

Establishes offences and penalties that apply within the declared area and designated access areas during the race period and, for some measures, during a broader specified period leading up to and after the race (regs 9-13, 47-49; definition of specified period in reg 5). Many prohibitions carry penalties of 20, 10 or 5 penalty units depending on the conduct (see regs throughout Parts 3-7).
Defines and broadly prohibits a long list of “prohibited items” and places express limits on possession and movement of liquor, filming, advertising, sale of goods, and actions that might disrupt or endanger public safety (reg 5 definitions; regs 17-18, 26, 39-40, 25).
Authorises appointment and identification requirements for “authorised persons” who enforce the Regulations, and grants specific inspection, direction and surrender powers to those authorised persons and to police (regs 6-7, 41-46).
Provides powers and procedures for screening, search and seizure, direction to leave and expulsion, and graded re‑entry bans for repeat non‑compliance during the specified period (regs 41-49).
Limits and clarifies the Corporation’s administrative discretions: setting opening and closing times, reserving areas and seats, designating no smoking areas, establishing works areas and specified periods, and determining authorisations for recording, advertising or vending (regs 13, 14, 36, 47-48, 51).

INTERPRETATION OF LEGISLATION ACT 1984 (ILA)

Style changes

Section 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.

References to ILA s. 39B

Sidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression "(1)" at the beginning of the original regulation, rule or clause.

Interpretation

As from 1 January 2001, amendments to section 36 of the ILA have the following effects:

• Headings

All headings included in a Statutory Rule which is made on or after
1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.
This includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms.
See section 36(1A)(2A)(2B).

• Examples, diagrams or notes

• Location of "legislative items"

A "legislative item" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.

• Other material

Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).

The Regulations rest on a small set of core concepts that structure rights, prohibitions and administrative discretion.

Declared area and designated access area: the Regulations repeatedly restrict entry, exit and behaviour “in the declared area or a designated access area” during the race period or, for some provisions, during the specified period. The Regulations do not define “race period” within their text; they use it as a central temporal marker for applicability (see regs 9-13 and multiple elsewhere). The specified period is defined in reg 5: for the declared area it runs from 11 weeks before the race period until 3 weeks after it; for designated access areas it is the period specified in a declaration under s 32A(1)(a) or (b) of the Act (reg 5).
Permitted entrant and ticketing: access rights hinge on whether a person is a permitted entrant (reg 5 definition). A permitted entrant includes ticket‑holders issued by the Corporation, persons admitted on payment of an admission fee, and persons admitted under general or specific authorisation by the Corporation. The Corporation may issue reserved area or reserved seat tickets (reg 14).
Prohibited item and liquor regimes: the definition of prohibited item in reg 5 is comprehensive. It expressly includes glass objects, unsealed beverage containers, chairs other than folding chairs, flags/banners above specified size, laser pointers, distress signals, whistles, items caught by weapons and dangerous‑goods laws, drones, broadcast equipment that may interfere with Corporation broadcasts, and items in quantities suggesting commercial use (reg 5). Reg 17 places a broad restriction on possession of liquor in the area unless purchased in accordance with the Liquor Control Reform Act 1998 or authorised by the Corporation; reg 18 prohibits possession of prohibited items without authorisation.
Authorised persons and police powers: the Corporation appoints authorised persons (reg 6). Authorised persons must be clearly identified and produce ID on request; failure to produce ID on demand means the person is not authorised in relation to the person making the demand (reg 7). Authorised persons and police share powers to instruct, inspect, confiscate, direct to leave, remove unauthorized structures and use screening measures (regs 41-46).
Public access area carve‑out: reg 5A operates as an event‑specific public‑access exception. It lists many provisions that do not apply to conduct in or in relation to a public access area at times and dates specified in a public access area declaration. Multiple individual prohibitions include notes referencing reg 5A and reg 51(1A) prevents the Corporation from imposing conditions that limit a person’s ability to bring items into a public access area during a declared public access time (regs 5A, 51(1A)).
Works areas and specified period rules: the Regulations establish a separate regime for works, services and build‑up periods through Part 7 (regs 47-49), including specific powers to exclude people from works areas, progressively longer re‑entry bans for repeat directing/expulsions, and a prohibition on obstructing or endangering works (reg 47(1)-(4), reg 49(2)).

These concepts are operationalised by concrete powers , e.g., the power to require surrender of items (reg 41), to inspect bags or require passage through screening (reg 42), to remove advertising (reg 39(2)) and to dismantle unauthorised structures (reg 31(2)). The Corporation’s authorisation is a recurring gateway for behaviour that would otherwise be prohibited.

The Regulations identify a small number of decision actors and a broad population of subjects.

The Corporation: the Regulations give the Corporation dominant administrative authority. It appoints authorised persons (reg 6), fixes opening and closing times (reg 13), sets reserved areas and seats (reg 14), designates no smoking areas (reg 36), establishes works areas and authorises works (reg 47), issues written authorisations for filming, advertising, vending and other activities (regs 26, 29, 39-40), and erects signage (regs 13(2), 36(2), 51(2)). The Corporation can remove items from the area by condition of entry (reg 51(1)) and decides entry conditions for the declared and designated access areas.
Authorised persons: persons appointed under reg 6 enforce many provisions. They must be identified (reg 7) and can request ID and ask persons to produce tickets (reg 7(2), reg 46(1)(a)). They also have power to request surrender (reg 41), inspect bags and pockets and require screening (reg 42), direct persons to leave reserved areas or the declared area (regs 43-44), dismantle unauthorised structures (reg 31(2)), and request return of glass objects (reg 15).
Police: police officers exercise statutory powers complementary to those of authorised persons, with express authority to use reasonable force where necessary (reg 45). Police may prevent entry or departure where persons are non‑permitted entrants or possess prohibited items (reg 46(2)), expel persons who refuse directions (reg 45 and reg 48(3)), and enforce re‑entry prohibitions (reg 46(1)(d), reg 10, reg 49).
Spectators and ticket‑holders: the public attending the event are regulated as “permitted entrants” when they hold appropriate tickets (reg 5). Ticket‑holders are subject to access rules (regs 9-14), conduct rules (Parts 4-5), inspection and surrender obligations (regs 41-42), and potential directions to leave (regs 38, 43-44). Reserved seat holders face specific restrictions (reg 14).
Businesses, vendors and advertisers: the Regulations constrain commercial activity within the declared and designated access areas. Sale, solicitation, distribution of promotional material, and commercial advertising are prohibited without written authorisation by the Corporation (regs 39(1), 39(3), 39(4), 40). Owners and occupiers of buildings may be exempted in limited circumstances (reg 39(5)(a)).
Contractors, service providers and workers: persons building infrastructure and providing services during the specified period are affected by the works‑area regime (regs 47-49). The Regulations criminalise obstruction and endangerment of works and permit authorised persons and police to exclude or direct persons in works areas (reg 47(1)-(4)).
Private security operators: reg 6 conditions appointment as an authorised person on holding appropriate licences under the Private Security Act 2004 or being otherwise believed by the Corporation to have appropriate skills. This ties the enforcement labour pool to the private security licensing system.

Who pays: monetary consequences fall on individuals for contravening offences (penalty units attached to many regs) and on vehicle owners for the prescribed fee for keeping a vehicle in a place by the Corporation (reg 50). The Regulations also prescribe a monetary payment the Corporation must make to the committee of management under s 41 of the Act and set the calculation method for years after 2026 (reg 52). The endnotes provide example values and the mechanism for fee‑unit and penalty‑unit calculation (Endnotes; Monetary Units Act 2004; Sentencing Act 1991 references).

Who decides: the Corporation has wide discretionary authority to authorise activities, determine access conditions, designate areas and signs, issue tickets, and appoint authorised persons. Police exercise statutorily bounded enforcement and use‑of‑force powers. The committee of management is a recipient of a prescribed payment from the Corporation under reg 52, subject to the Act.

The Regulations create a matrix of mandatory conduct rules for attendees, duties for the Corporation and rights/protections for persons affected by enforcement.

Duties on persons attending or in the declared/designated areas

Entry and exit: a person who is not a permitted entrant must not enter or attempt to enter the declared or designated access area during the race period (reg 9(1)). Entry and exit must be through designated entrances and exits (reg 9(2)-(3)). Non‑compliance attracts penalties (reg 9(1) 20 penalty units; reg 9(2)-(3) 10 penalty units).
Possession and conduct: persons must not possess prohibited items without Corporation authorisation (reg 18), must not have liquor unless purchased in conformity with the Liquor Control Reform Act 1998 or authorised by the Corporation (reg 17(1)), and must not engage in behaviour that disrupts events, endangers safety or interferes with drivers (regs 23-25). Recording and broadcasting are restricted to private enjoyment unless the Corporation has provided written authorisation (reg 26).
Compliance with directions: persons must comply with directions to surrender items (reg 41), to undergo inspection (reg 42), to produce tickets (reg 14(7)-(8), reg 46(1)(a)), and to leave when lawfully directed by authorised persons or police (regs 38, 43-44). Failure to comply with specified directions can attract penalties and expulsion (reg 43(2), reg 44).
Works‑period conduct: during the specified period, persons must not obstruct or endanger works and must not enter works areas without authorisation (reg 47(1)-(2)). Non‑compliance has specific penalties and leads to exclusion under regs 47-49.

Duties on the Corporation

Identification and notice: the Corporation must ensure authorised persons are clearly identified and must provide opening and closing times by website, newspaper and signage at designated entrances (reg 7(1); reg 13(2)). The Corporation must erect signage describing prohibited entry items (reg 51(2)).
Authorisation and administration: the Corporation is the gatekeeper for exceptions and permissions , issuing written authorisations for filming, advertising, vending, reserved seats/areas, and authorised entry by vehicle (regs 14, 26, 29, 39-40, 12). It also establishes works areas and no smoking areas (regs 36(1)-(2), 47).
Financial duties: the Corporation must pay the prescribed amount to the committee of management; reg 52 sets a prescribed amount for 2026 and a formula for subsequent years.

Protections and rights for persons

Identification duty of authorised persons: authorised persons must produce their identification on request and, if they fail to do so, they are not authorised to exercise powers in respect of the person making the demand (reg 7(2)-(3)). This is an express procedural protection.
Return of surrendered items where practicable: items surrendered under reg 41 must, if practicable, be returned within a reasonable time unless they are firearms, dangerous articles, controlled weapons or dangerous goods (reg 41(2)). This defines a limited right to return.
Public access area carve‑out: reg 5A and several specific provisions (eg reg 14(9), reg 42(1A), reg 46(3)) protect persons in declared public access areas from many of the Regulations’ powers, serving as statutory limits on the reach of the Corporation and authorised persons during declared public access times.
Procedural limits on force: police may use no more force than is reasonably necessary when expelling or preventing entry/reattempted entry (reg 45). This establishes a legal standard constraining the use of force.

Rights to administrative authorisation and written authorisation: many exceptions require the Corporation’s written authorisation (regs 26, 29, 31(1), 39-40), which in practice means affected persons must seek and obtain that documentation if they intend to film, display banners, sell goods, erect structures or use broadcast devices.

The Regulations attach a mix of criminal penalties expressed in penalty units and administrative enforcement powers to ensure compliance.

Penalty framework

Penalty units: offences are quantified in penalty units. Across the instrument, most serious conduct attracts 20 penalty units, middling offences 10 penalty units and lower level breaches 5 penalty units (see, for example, regs 8 (20 units), 9(2)-(3) (10 units), 14(5)-(6) (5 units), and many others). The explanatory endnotes set out the valuation mechanism: for the financial year commencing 1 July 2025 the value of a penalty unit is $203.51; the value for future years is fixed under the Monetary Units Act 2004 and published in the Gazette (Endnotes). The amount in dollars therefore moves with the statutory penalty unit mechanism.
Fee units: reg 50 prescribes a fee expressed in fee units for vehicle recovery and storage: 20 fee units plus 5 fee units for each day or part of a day the vehicle is kept by the Corporation. The endnotes state the value of a fee unit for the financial year commencing 1 July 2025 as $16.81 (Endnotes). The fee calculation is therefore subject to the Monetary Units Act 2004 indexing.

Enforcement powers and procedures

Surrender and confiscation: authorised persons and police may request surrender of items contravening regs 17 or 18 and items believed to be used in contravention of a long list of event rules (reg 41(1)(a)-(e)). Surrendered items must, if practicable, be returned within a reasonable time unless they are firearms, dangerous articles, controlled weapons or dangerous goods (reg 41(2)).
Inspection and screening: during the race period authorised persons and police may request production and opening of bags, turning out of pockets, and require passage through screening equipment including x‑ray or hand‑held devices (reg 42(1)(a)-(c)). Refusal can result in direction not to enter and attracts a 20 penalty unit liability for non‑compliance with a direction (reg 42(2)-(3)).
Directions to leave and expulsion: authorised persons or police may direct persons to leave reserved areas or the declared area for ticket failure or if they refuse to surrender items or refuse inspection (reg 43). They may also direct persons to leave where they believe an offence has been committed (reg 44). Police may use reasonable force to expel persons who refuse to comply with such directions (reg 45).
Additional powers: authorised persons and police may request production of tickets or other evidence of entitlement and may prevent entry or departure for possession of prohibited items or unlawful entry attempts (reg 46). Powers to remove signs, dismantle structures, or remove items and advertising are specified in regs 31(2), 39(2), and elsewhere.
Progressive re‑entry bans during specified period: reg 49 sets graduated re‑entry prohibitions during the specified period. First expulsion or direction to leave during the specified period disqualifies re‑entry for 24 hours or until the end of the specified period, whichever first occurs; second occasion disqualifies for seven days; third or subsequent occasions disqualifies for the remainder of the specified period (reg 49(2)(a)-(c)). Re‑entry after being directed to leave during the race period is separately set at 24 hours unless the Corporation provides written authorisation (reg 10).
Removal and dismantling: authorised persons or police may cause unauthorised structures to be dismantled and removed from the declared/designated area (reg 31(2)). Posters and other unauthorised advertising may be removed (reg 39(2)).

Operational constraints and safeguards

Identification and authorisation requirement for authorised persons: reg 7 requires authorised persons to be clearly identified and to produce ID on request; failure to produce ID means they lack authority in relation to the person making the demand (reg 7(2)-(3)). Several provisions expressly limit the exercise of powers in public access areas (reg 42(1A), reg 46(3), reg 14(9)).
Return of items: reg 41(2) sets out a practical return principle, subject to exceptions for serious items that cannot be returned. This requires an enforcement administration in which items are logged, stored and either returned or retained consistent with the exceptions.
Use of force standard: police may use no more force than is reasonably necessary when expelling a person or preventing re‑entry (reg 45). The Regulations amplify the role of police in enforcement rather than creating new police powers beyond the reasonable‑force limiter.

Practical enforcement footprint

The combined effect of inspection powers, surrender powers and the capacity to prevent entry or expel attendees shifts operational enforcement onto a mix of private security (authorised persons) and public police resources. The authorised person appointment links to private security licensing (reg 6), creating a compliance chain that implicates licencing, training and identification systems.

The Regulations are heavily cross‑referential to a number of Victorian statutes and the Australian Grands Prix Act 1994 (the Act). They rely on the Act as their parent statute and align many definitions and offences with other statutes.

Direct cross‑references in the text

Australian Grands Prix Act 1994: These Regulations are made under s 51 of the Act (reg 2). Several powers and definitions rely on the Act: designated access area declarations under s 32A of the Act inform the specified period (reg 5); section 35 of the Act is referenced in the prohibited item definition that catches broadcast equipment to which Corporation consent may be given (reg 5(t)); section 41 of the Act is the payment obligation referenced in reg 52 (reg 1(cb), reg 52).
Liquor Control Reform Act 1998: the definition of liquor and the sale/possession restrictions reference the Liquor Act and treat purchase in accordance with it as the gateway for lawful consumption or possession (reg 17).
Control of Weapons Act 1990 and Firearms Act 1996: prohibited item definitions incorporate weapons, controlled weapons and firearms and refer to the relevant Acts (reg 5(j)-(n)), so that possession of such items will be both a Regulation offence and likely an underlying offence under those Acts.
Dangerous Goods Act 1985: the definition of dangerous goods is imported (reg 5) and dangerous goods are expressly included among prohibited items (reg 5(m)), aligning Regulation prohibitions with broader hazardous‑materials law.
Tobacco Act 1987: the notion of an “acceptable no smoking sign” is defined to accord with s 3 of the Tobacco Act (reg 5).
Private Security Act 2004: appointment of authorised persons must be consistent with private security licensing (reg 6).
Road Safety Act 1986, Road Safety Road Rules 2017, Marine Safety Act 2010: the definitions of vehicle, electric personal transporter and vessel borrow the statutory meanings from these laws (reg 5).
Sentencing Act 1991 and Monetary Units Act 2004: the Regulations express penalties and fees in penalty units and fee units; the endnotes set out the 2025 values and indexing mechanisms (Endnotes). Enforcement fines are therefore connected to the State's broader penalty and fee indexation architecture.
Subordinate Legislation Act 1994 and Interpretation of Legislation Act 1984: endnotes reference sunset and interpretative style changes and confirm that explanatory material does not form part of the Regulation (Endnotes, Interpretation note).

Overlaps, duplications and practical interactions

Parallel offences: the Regulations create offences that may overlap with other statutory offences. For example, possession of a weapon could constitute an offence under the Control of Weapons Act 1990 and also breach reg 18. In practice, this gives enforcement agents multiple statutory bases for action; reg 41(2) clarifies that certain serious items cannot be returned if surrendered, aligning contraventions with other weapons or dangerous‑goods statutes.
Police powers and statutory limits: police powers in the Regulations are framed “in addition to” other powers the police already possess (reg 46(2) states “in addition to any other powers conferred”). The “reasonable force” standard in reg 45 interfaces with common law and statutory constraints on police force.
Corporation discretion and property/occupier rights: reg 39(5)(a) exempts owners or occupiers of buildings where advertising has been permitted by them, and reg 51(1A) prevents the Corporation from imposing entry conditions that limit bringing items into declared public access areas during declared times. Those carve‑outs create narrow points of intersection with property rights and other statutory obligations for occupiers and lessees.
Financial flows and Act obligations: reg 52 prescribes amounts the Corporation must pay to the committee of management under s 41 of the Act and sets a formula for years after 2026. That interacts with the Act’s financial scheme and budget allocations for committee of management responsibilities.

Practical implication for compliance and enforcement

Enforcement agencies must coordinate statutory bases: policing, private security licensing, public health (no smoking) rules and hazardous‑goods enforcement will need procedural alignment. For example, an item that is both a prohibited item under these Regulations and classified as a dangerous good under the Dangerous Goods Act will require handling consistent with both regimes (see reg 41(2)).
Administrative authorisations must be documented: many exemptions require written Corporation authorisation (regs 26, 29, 31(1), 39-40). Those authorisations effectively operate as permits under the broader regulatory ecosystem and should be drafted with cognisance of licensing, public safety and broadcasting laws.

The version provided incorporates amendments through 23 February 2026 (Version No. 003). The instrument’s Table of Amendments and marginal notes identify two later statutory rules:

Australian Grands Prix (Formula One) Amendment Regulations 2018, S.R. No. 23/2018. The Table of Amendments records the date of making as 27 February 2018 and commencement 7 March 2018 (Table of Amendments).
Australian Grands Prix (Formula One) Amendment Regulations 2026, S.R. No. 7/2026. The Table shows date of making 10 February 2026 and commencement 23 February 2026 (Table of Amendments).

The text includes specific marginal notes identifying where those instruments altered the principal regulations. Key example amendments visible in the body of the Regulations include:

Insertion and amendment of definitions in reg 5: several definitions were inserted or amended by S.R. No. 23/2018 and S.R. No. 7/2026. For instance, the definition of electric personal transporter was added by S.R. No. 23/2018 (marginal note at reg 5), and a number of amendments to the definitions and the specified period are noted as inserted or amended by S.R. No. 7/2026 (see marginal notes after the defined terms and for specified period).
Introduction of reg 5A: the public access area carve‑out regime was inserted by S.R. No. 7/2026 (marginal note: “Reg. 5A inserted by S.R. No. 7/2026 reg. 7”). This is a significant structural amendment narrowing the application of many prohibitions in certain declared public access areas and times.
Multiple rules throughout Parts 2-7 carry marginal notes stating they were inserted or amended by S.R. No. 7/2026 reg. [number]. These include expansions of the authorised persons regime (regs 6-7 updates), additions of many enforcement notes referencing reg 5A, and new or modified penalties and procedural powers (for example, reg 13(3), reg 14(5)-(9), reg 15, reg 16 and many others labelled as “inserted by S.R. No. 7/2026”).
Reg 52: the method for calculation of payments under s 41 of the Act was inserted by S.R. No. 7/2026 (marginal note). Reg 52 sets a prescribed amount for 2026 ($200,000) and a formula for subsequent years (200 000 × 1·03^(Y-2026)).

Endnotes and explanatory details provide style and interpretative notes (Interpretation of Legislation Act 1984 references) and identify the sunset provision: the Regulations were made on 18 October 2016 and will sunset 10 years after the day of making on 18 October 2026 under the Subordinate Legislation Act 1994 (Endnotes).

For historical tracing and compliance auditing, the marginal notes in each regulation identify where specific subregulations or paragraphs were inserted or amended and by which S.R. number (e.g., reg 5A inserted by S.R. No. 7/2026 reg. 7; various regs annotated as “inserted by S.R. No. 7/2026 reg. X” or as amended by S.R. No. 23/2018 reg. 4). Users should consult the Table of Amendments and the consolidated version for precise clause‑level amendment history.

The Regulations and the material you provided do not include any judicial decisions, reported cases, or litigation history. The text contains no citations of cases, no references to litigation outcomes and the endnotes do not list any court proceedings. The Explanatory Details and Endnotes are strictly legislative and administrative: they provide interpretative guidance, fee/penalty unit indexing and amendment tables, but they do not summarise any litigation.

Practical implications for research and risk assessment

No litigation record in the instrument: because the instrument itself contains no litigation history, legal researchers and practitioners should not assume settled judicial interpretations of key phrases used in the Regulations (such as “race period”, “public access area declaration”, “reasonable grounds” for directing to leave, or the permissible scope of “interfere with” in reg 8) are available in the consolidated text. Those terms may instead have been litigated under the parent Australian Grands Prix Act 1994 or other statutes; such case law, if any, is not recorded in this document.
Necessity of targeted case law searches: where contested enforcement actions or constitutional questions may arise (for example, challenges to directions to leave, seizure of property under reg 41, enforcement of public access area carve‑outs or limits on filming and recording restrictions), a rules lawyer should search Victorian superior court and VCAT records for cases dealing with the Act and event‑specific enforcement and consult police and administrative law decisions relevant to the reasonable‑force and inspection powers in the Regulations.
Administrative review routes: the instrument does not specify internal review mechanisms for Corporation decisions to grant or refuse authorisations; practitioners should review the Act and general administrative law principles and processes (including merits review provisions in other statutes or tribunal jurisdictions) to identify available remedies in the event of disputed decisions under the Regulations.

If a litigation history search is required, the next step is to search Victorian courts, tribunal databases and legal reporting services for cases referencing the Australian Grands Prix Act 1994 and these Regulations, and to examine any recorded enforcement actions or decisions by the Corporation that became the subject of judicial review.

The Regulations are detail‑rich; several features repeatedly appear in the text and create practical traps for implementers and users of the event space. The following are concrete, source‑grounded points to watch.

Public access area carve‑outs (reg 5A and many notes)

Many prohibitions are subject to non‑application where there is a public access area declaration. Reg 5A(1)-(2) lists many substantive provisions that do not apply in or in relation to a public access area at dates/times specified in the public access area declaration. Numerous specific provisions include a built‑in “Note: The prohibition in this subregulation does not apply in certain circumstances, see regulation 5A.” Failure to check whether a public access area declaration has been made for specific dates can produce enforcement confusion, e.g., whether filming or selling goods is prohibited in a particular area on a specific day (see regs 26, 39, 40 and the cross‑references to reg 5A).
Reg 51(1A) goes further, expressly preventing the Corporation from imposing a condition of entry that limits a person’s ability to bring items into a public access area during a declared public access time. This means that the Corporation’s standard “condition of entry” power (reg 51(1)) cannot be used to curtail conduct in publicly declared access areas at the relevant times.

Authorisation dependence and the paperwork trap

Many exceptions require written authorisation from the Corporation (regs 14, 26, 29, 31(1), 36(1)-(2), 39-40). Practically, an attendee or vendor who believes they have an informal verbal permission may still be in breach unless they hold the required written authorisation. The requirement for a written authorisation to lawfully possess certain items or conduct commercial activities creates a compliance duty to obtain, retain and produce documentation on demand.

Identification of authorised persons and limits on authority

Reg 7(3) provides that if an authorised person fails to produce identification on demand, they are not authorised to exercise powers in relation to the person making the demand. This has two operational consequences: authorised persons must be trained and carry clear identification at all times; and members of the public who are subject to enforcement should request ID where lawful to do so, because a failure to produce valid ID limits the authorised person’s powers with respect to that individual.

Surrender, return and non‑returnable items

Reg 41(2) requires the return of surrendered items “if practicable” and within a reasonable time, but it carves out certain classes of items that must not be returned (firearms, dangerous articles, controlled weapons and dangerous goods). There is therefore a legal distinction between temporary confiscation and permanent seizure; enforcement teams must have procedures to classify surrendered items correctly and document retention/chain of custody.

Inspection and compelled screening

Reg 42 authorises bag searches, pocket turning out and screening (including x‑ray), with a power to direct a person not to enter if they refuse. Refusal to comply with a request under reg 42(1) can attract a direction not to enter and a 20 penalty unit offence for non‑compliance with the direction (reg 42(2)-(3)). Security operators must be prepared to run screening consistently to avoid selective enforcement claims and to have signage and process for refusals.

Progressive re‑entry bans during the specified period

Reg 49 sets escalating prohibitions on re‑entry for repeated directions to leave or expulsions during the specified period: 24 hours for the first occasion, seven days for the second, and the remainder of the specified period for third or subsequent occasions. Event operators and security must track incidents accurately and notify subjects of the duration of exclusion to avoid wrongful re‑entry incidents.

Recording and broadcasting limits

Reg 26 prohibits recording or transmitting images of the event except for private enjoyment without the Corporation’s written authorisation. This prohibition interacts with the prohibited item definition which specifically covers broadcast equipment that may interfere with Corporation broadcasts (reg 5(t)). Event photographers, media outlets and social media users must therefore check authorisation requirements in advance.

Advertising and commercial restrictions with narrow exemptions

Reg 39 prohibits unauthorised advertising and distribution of promotional material; reg 40 likewise prohibits sales without written authorisation. The industry convention of on‑site sponsors or vendors must therefore be formalised by written authorisations, and building owners/occupiers may be exempted in limited circumstances (reg 39(5)(a)). Failure to obtain written authorisation risks fines and removal of materials.

No smoking area signage technicality

Reg 36 requires designation of no smoking areas by displaying an “acceptable no smoking sign” in a manner ensuring persons are reasonably likely to see one upon entering or at reasonable intervals. Improper signage could render enforcement actions vulnerable if defendants argue lack of proper notice.

Sunset timing

The endnotes state that the Regulations will sunset on 18 October 2026 (10 years after making). The consolidated text provided includes amendments commencing 23 February 2026. Practitioners should be alert to the instrument’s prospective expiry date and any transitional arrangements. Absence of a renewed regulation would change the regulatory landscape.

Financial and payment mechanics

Reg 50 prescribes vehicle recovery fees in fee units and reg 52 prescribes a payment to the committee of management ($200,000 for 2026 and a formula thereafter). The endnotes set fee and penalty unit monetary values for the 2025-26 year. Users must check the current fee/penalty unit values under the Monetary Units Act 2004 and Sentencing Act 1991 for current dollar equivalents.

Interplay with other statutes

Several definitions expressly incorporate other Acts (see reg 5), so practitioners must consider those other statutes when assessing legal consequences, especially for weapons, dangerous goods, firearms and liquor. An item that violates these Regulations may also attract separate statutory criminal liability under other legislation.

Compliance requires a co‑ordinated programme addressing authorisations, signage, screening, personnel, documentation and coordination with police. The following actionable steps reference the specific Regulations:

Gatekeeping and ticketing systems (regs 5, 9, 13, 14)
- Ensure the Corporation’s ticketing records identify permitted entrants and reserved‑area/seat allocations consistent with reg 14(1)-(6).
- Operate entry only through designated entrances and exits and publish opening and closing times as required by reg 13(2) (website, newspaper and signage at each designated entrance).
- Make sure reserved areas and reserved seats are physically demarcated and that authorised persons can request ticket production (reg 14(7)-(8)).
Authorised persons, ID and private security licensing (regs 6-7)
- Appoint authorised persons consistent with reg 6: where private security is engaged, ensure staff hold the appropriate Private Security Act licences or that the Corporation documents belief in their competence.
- Provide and require display of clear identifications; train staff to produce ID on demand and to understand that failure to produce ID limits their authority as to the person making the demand (reg 7(2)-(3)).
Prohibited items, liquor and signage (regs 5, 17, 51)
- Publish and post clear lists of prohibited items at each designated entrance as required by reg 51(2).
- Make liquor sales and possession compliant with the Liquor Control Reform Act 1998; ensure point‑of‑sale controls to prevent removal of liquor in unsealed containers (reg 17).
- For public access area periods declared under reg 5A, ensure signage and public communications clearly identify those times and the effect on prohibitions.
Screening and inspection procedures (reg 42)
- Implement bag, pocket and screening procedures (including signage that visitors will be screened), and ensure equipment (x‑ray, hand‑held devices) meets safety and privacy standards. Train staff on the legal basis for requesting screening and on escalation procedures for refusal; non‑cooperation permits direction to leave and potential penalty exposure (reg 42(1)-(3)).
Surrender, storage and return processing (reg 41)
- Develop documented procedures for surrendering items, recording chain of custody, securely storing surrendered items and returning items where practicable. Flag and handle non‑returnable items (firearms, dangerous articles, controlled weapons, dangerous goods) per reg 41(2).
- Ensure authorisations for disposal where necessary and that staff can identify items fitting the exceptions.
Recording, broadcasting and commercial authorisations (regs 26, 27, 29, 39-40)
- Establish a written authorisation process and standard terms for filming, broadcasting, advertising, signage and vending. Ensure any third‑party media or sponsors hold written Corporation authorisations where required (reg 26, reg 39(1),(3),(4), reg 40(1)-(3)).
- Coordinate with broadcast partners to avoid conflicts with the prohibited item definition that covers devices interfering with Corporation broadcasts (reg 5(t)).
Works areas, safety and specified period protocol (regs 47-49)
- For build‑up and dismantling works, establish clearly marked works areas (reg 5 definition of works area) and communicate authorised access protocols. Train authorised persons to enforce exclusion from works areas and document directions and expulsions as re‑entry bans escalate in the specified period (reg 49(2)(a)-(c)).
Advertising and occupier exceptions (reg 39(5))
- Where owners/occupiers of buildings have commercial advertising arrangements, obtain documentary proof to rely on the exemption in reg 39(5)(a). Ensure that any signage placed by third parties on structures falls within the Corporation’s authorisation framework or is protected by the building occupier exemption.
No smoking and public health signage (reg 36)
- If designating no smoking areas, display “acceptable no smoking signs” that comply with the Tobacco Act definition and place them at entrances or at reasonable intervals (reg 36(2)). Train staff on enforcement and the procedure for directing persons to leave for refusal to comply (reg 36(3), reg 44(3)).
Documentation for authorisation decisions and refusal handling
- Maintain written records of all authorisations, refusals, inspections, surrender receipts, directions to leave, and incidents of expulsion. These records will be important for defence against allegations of improper exercise of authority and for managing reg 49 re‑entry consequences.
Fees, penalty awareness and payment mechanics (regs 50, 52; Endnotes)
- Implement systems to charge and collect the prescribed fee for vehicle recovery and storage (reg 50), expressed in fee units. Monitor updates to the Monetary Units Act 2004 and the Sentencing Act 1991 for current fee and penalty unit values (Endnotes).
- Plan for the prescribed payment to the committee of management under reg 52 ($200,000 for 2026 and 1·03^(Y-2026) escalation thereafter) when budgeting and accounting for the Corporation’s financial obligations.
Police coordination and use‑of‑force policy (regs 45, 46)
- Coordinate with local police about enforcement roles and training, especially the reasonable force standard for expulsions (reg 45). Establish joint operating procedures for handling refusals, crowd incidents and emergency responses.
Public communications and public access declarations
- Publish information on public access areas, their dates and the scope of permitted conduct to exploit reg 5A carve‑outs where appropriate. Where a public access area declaration is intended, ensure proper formal declaration consistent with the Act and timely notifications so that attendees and authorised persons understand when the carve‑outs operate.

Compliance is an administrative enterprise as much as a security one: written authorisations, signage, trained authorised persons with identity credentials, documented surrender and return processes, and pre‑event coordination with police and the committee of management will materially reduce legal exposure. The Regulations place recurring reliance on the Corporation’s written authorisations and signage duties; building those administrative controls is central to lawful operation.
