What it does
This instrument, the Australian Federal Police (Approval of Screening Devices) Instrument 2021, is a delegated instrument made by the Minister for Home Affairs under section 40R of the Australian Federal Police Act 1979 (the Act). It performs a single operational function: it specifies which breath‑screening devices are "approved screening devices" for the purposes of subsection 40R(1) of the Act (s 4). The instrument is dated 3 March 2021 and signed by the Minister (covering text and signature block). It commences "on the day after it is registered" (s 2), and it expressly revokes a prior instrument captioned Australian Federal Police Act 1979 - Section 40R - Approval of Screening Device (09/06/2011) (s 3).
Mechanically, the instrument does three things. First, it names the instrument (s 1). Second, it sets its commencement rule (s 2). Third, and substantively, it lists approved devices (s 4). The list in s 4 contains two specifically named models and a broader, categorical approval that relies on approvals under state or territory law: (a) the Lion Alcolmeter SD‑400 breath screening device; (b) the Alcolizer LE breath screening device; and (c) any device "that is exhaled into and has been approved for the purpose of indicating whether alcohol is present in the blood of a person" either (i) under the law of a state or territory in which the breath screen is conducted, or (ii) in an external territory or a foreign country "under the law of a state or territory" (s 4).
The instrument does not itself set operational procedures, evidentiary rules, training requirements, calibration standards, maintenance obligations, penalties or enforcement mechanisms. It does not amend the AFP Act; it is a delegated approval instrument linked to subsection 40R(1) and functions by naming approved devices that AFP personnel may rely on where the Act requires an "approved screening device" (s 4; instrument header referencing s 40R). The practical effect is confined to device approval status; other legal or procedural consequences would flow from the Act and other instruments or policies, none of which are modified here by text within this instrument.
