Australian Education (Consequential and Transitional Provisions) Act 2013

The Australian Education (Consequential and Transitional Provisions) Act 2013 is a machinery Act that supports the replacement of two earlier funding regimes with the Australian Education Act 2013. It does three mechanical things. First, it repeals section 11 of the Federal Financial Relations Act 2009 (the National Schools Specific Purpose Payment provision) and removes associated notes in sections 12, 13, and 14 of that Act. Second, it amends the Schools Assistance Act 2008 to shorten its program year definitions so that Act ceases to apply to the 2014 year, effectively terminating its operation a year earlier than originally scheduled. Third, it contains transitional provisions in Schedule 2 that carry forward approvals, determinations, and definitions from the old Schools Assistance Act into the new Australian Education Act so that schools, approved authorities, and block grant authorities do not face a gap in legal coverage when the new Act commences on 1 January 2014. Critically, the transitional provisions are not merely saving clauses; they deem approvals to be in force under the new Act, specify the locations and levels of education taken to be covered, and give the Minister power to vary or revoke those deemed approvals. The Act also includes a temporary regulation-making power that allows the new Act’s operation to be modified for transitional purposes, including the amount of financial assistance payable, and waives the usual requirement to consult the Ministerial Council for regulations made before 1 January 2014. For the 2013-14 financial year, the total financial assistance payable under the old section 11 of the Federal Financial Relations Act is halved, except for amounts payable under subsection 65(6) of the new Act (non-participating schools). This reduction in funding for the transitional year represents a direct fiscal adjustment, locking in a lower base for state grants.

The Act introduces several transitional concepts that are tightly tied to the definitions in the old and new Acts. “Approved authority” under the old Act means a body approved to receive Commonwealth funding for a non-government school or school system; under Schedule 2, such bodies are automatically deemed approved under the new Act from 1 January 2014. The deemed approval carries with it the schools, locations, and levels of education that were approved as at 31 December 2013, as taken to be specified in the approval under section 79 of the new Act (limitation on approval). For government schools, each State or Territory is taken to be the approved authority, with locations and levels of education defined by what the State or Territory had approved on that date, rather than by Commonwealth approval. “Block grant authority” means a body corporate that administered capital grants under the old Act; these are similarly deemed approved under the new Act for each school they covered on 31 December 2013. The concept of “SES score” (socio-economic status score) is carried forward: any determination made under the old Act that was in force on 31 December 2013 is taken to have been made under section 52 of the new Act, and importantly that determination is not a reviewable decision, removing any avenue for contesting the score in the transitional period. “Majority Aboriginal and Torres Strait Islander school” relies on the old Act’s census day for 2013 being used for the definition in section 8 of the new Act. The concept of “non-body corporate” is significant: an approved authority that was not a body corporate on 31 December 2013 is given until 1 January 2015 to become one, and if it does so earlier, the body corporate is taken to be the same approved authority, preserving continuity of funding categories (such as transitional recurrent funding under sections 59, 61, or 62 of the new Act). Finally, “pending applications” for approval that were not decided by 31 December 2013 are treated as applications made under the new Act, but the effective date cannot be earlier than 1 January 2014, preventing backdating into the old regime.

The Act directly affects State and Territory governments as the approved authorities for all government schools within their jurisdiction. They are deemed approved without any application process, but they inherit the specific locations and levels of education that they themselves had approved by 31 December 2013. For non-government schools, the affected entities are approved authorities under the old Schools Assistance Act: these include bodies that operated approved school systems and those that operated single non-systemic schools. They are automatically deemed approved for the new Act, but the scope of that approval is fixed to the schools and locations that existed on 31 December 2013, which may create issues if a school was in the process of adding a new campus or level. Block grant authorities (bodies corporate that administered capital grants) are similarly deemed approved, affecting their ability to continue grant administration without interruption. Schools that had pending applications for approval as at 31 December 2013 will have their applications redirected to the new Act, with the Minister obliged to consider them under the new criteria but with a floor on the effective date. The Australian Education Minister and the Department are affected in that they must recognise these deemed approvals and may need to give notice of decisions (though item 7 exempts them from the section 119 notice requirement for deemed approvals). The Ministerial Council is affected because the usual consultation requirement for regulations is waived until 1 January 2014, reducing their input into transitional rule-making. Finally, the Act affects the Commonwealth budget by halving the financial assistance payable under the old section 11 for the 2013-14 year (except for non-participating schools), directly impacting state education budgets.

The Act imposes few new duties but preserves several rights and creates some limited obligations. Approved authorities under the deemed approvals have the right to continue operating as approved authorities under the new Act without reapplication, but they must comply with the new Act’s ongoing requirements (such as reporting and accountability provisions) from 1 January 2014. They also have the right to have their deemed approval specify the schools, locations, and levels of education that were in place on 31 December 2013, which provides certainty but also locks in that scope. A key duty for non-body corporate approved authorities: they must become a body corporate by 1 January 2015, otherwise they will lose approval under section 75(2) of the new Act. If they incorporate earlier, the new body corporate is treated as the same approved authority for continuity of funding, which is a statutory right. Block grant authorities are deemed approved and can continue administering grants without interruption; they do not need to reapply. The Minister has a right to vary or revoke deemed approvals under item 8, but that right is subject to the new Act’s procedures (not specified in this Act, but presumably under Part 5 of the new Act). The Minister also has a duty to treat pending applications as applications under the new Act (item 4), but is exempted from giving notice of decision for deemed approvals (item 7). States and Territories have the right to have their government school approvals deemed, but the locations and levels are defined by what the State or Territory itself approved, which may differ from what the Commonwealth would have approved. The Minister has a limited regulation-making power under item 12: before 1 January 2015, regulations may modify the operation of the new Act for transitional matters, including varying amounts of financial assistance, and the usual duty to consult the Ministerial Council is suspended for regulations made before 1 January 2014. This creates a wide executive discretion that can alter entitlements without stakeholder input. Schools that had an SES score determined under the old Act have the right to have that score continue, but they have no right to review that determination (item 11(2)), which is a significant limitation on procedural fairness.

This Act itself does not create any new offences or civil penalties. Enforcement relies entirely on the Australian Education Act 2013, which contains its own penalty and recovery provisions for non-compliance, such as overpayments of financial assistance, false statements, or breaches of conditions. The transitional Act merely carries forward approvals and determinations, so any enforcement action for conduct after 1 January 2014 will be under the new Act. However, there is an important enforcement nuance in the transitional provisions: the Minister’s power to vary or revoke deemed approvals (item 8) could be used as a de facto enforcement tool if an approved authority fails to comply with the new Act’s obligations, but the Act does not specify grounds or provide a right to a hearing. Additionally, the regulation-making power under item 12 can modify the operation of the new Act and even change the amount of financial assistance payable. If regulations reduce funding, that could operate as a financial penalty on schools or authorities that do not meet transitional conditions. Half of the financial assistance payable under section 11 of the Federal Financial Relations Act for 2013-14 is effectively cut (item 1(3)), which operates as a fiscal adjustment, not a penalty, but is enforceable through the Commonwealth’s refusal to pay. For approved authorities that fail to become a body corporate by 1 January 2015, the sanction is loss of approval, which is automatic under section 75(2) of the new Act; this Act does not provide an extension power. There are no criminal penalties, civil pecuniary penalties, or infringement notices in this Act. The absence of a notice-of-decision requirement for deemed approvals means there is no trigger for administrative review under the new Act, reducing accountability for the Minister’s actions in recognising or not recognising a deemed approval. Enforcement of the half-payment rule is effectively automatic: the formula in item 1(3) binds the Commonwealth, and a State cannot challenge it under this Act as there is no review provision.

This Act is explicitly consequential to the Australian Education Act 2013, and its operation is tied to that Act’s commencement. It amends the Federal Financial Relations Act 2009 by repealing section 11 (National Schools Specific Purpose Payment) and removing notes in sections 12, 13, and 14. That repeal is not immediate: section 11 continues to apply for the 2013-14 financial year but with a halved total amount. The interaction with the Schools Assistance Act 2008 is direct: by amending paragraph 3(3)(b) and the definition of “program year”, the 2008 Act ceases to apply to the 2014 program year, effectively making 2013 its last full year. The transitional provisions in Schedule 2 expressly borrow definitions from both the old Act and the new Act (item 1(2) and (3)), creating a hybrid interpretation framework for the period straddling the two regimes. The Act also interacts with the Australian Education Act’s provisions on approval: for example, section 73(1) of the new Act (Ministerial approval of authorities) is deemed to have been exercised; section 79 (limitation on approval) is deemed to specify certain schools and locations; section 75(2) (requirement for body corporate) is suspended until 2015 for existing non-corporate authorities; and section 119 (notice of decision) is excluded for deemed approvals. The regulation-making power under section 130 of the new Act is expanded by item 12 of this Schedule: regulations may modify the new Act for transitional matters, and the requirement to consult the Ministerial Council under subsection 130(5) is waived for regulations made before 1 January 2014. This means the new Act can be amended by delegated legislation without the usual procedural safeguard. The Act does not directly interact with state legislation, but by deeming state-approved locations and levels of education for government schools, it effectively incorporates state administrative decisions into Commonwealth funding law. There is no interaction with the Administrative Appeals Tribunal Act or the Ombudsman Act explicitly, but the exclusion of review for SES score determinations (item 11(2)) may limit the operation of the Administrative Decisions (Judicial Review) Act 1977, though the source does not specify that.

The Act as originally enacted has no amendment history recorded in the provided text. The commencement table contains a note that the table relates only to the provisions as originally enacted and will not be amended to deal with later amendments, indicating that the text we have is the base enactment. The Act received Royal Assent on 27 June 2013. Sections 1 to 3 commenced on that date. Schedules 1 and 2 were to commence at the same time as the Australian Education Act 2013, which commenced on 1 January 2014. No subsequent amending Acts or legislative instruments are referenced in the source material. However, the transitional regulation-making power in item 12 could have been used to modify the new Act before 1 January 2015, so the practical amendment history may include such regulations, but the source does not list them. The Act itself could have been amended later by another Act (for example, to extend the body-corporate deadline or to adjust the half-payment formula), but no such history is provided. For a deep dive grounded solely in the source, the amendment history is therefore limited to the original enactment and the dates of commencement for its parts. The lack of recorded amendments may also suggest that the transitional provisions achieved their purpose without needing legislative adjustment, but that is speculation not grounded in the source.

The source text of the Australian Education (Consequential and Transitional Provisions) Act 2013 does not cite any judicial decisions or mention any litigation. The Act itself does not create a right of review for the deemed approvals (item 7 excludes the notice requirement) and specifically provides that an SES score determination carried over is not a reviewable decision (item 11(2)). This suggests that the drafters intended to minimise litigation by precluding administrative review of certain transitional decisions. The exclusion of the Ministerial Council consultation requirement for early regulations also reduces a possible basis for procedural challenge. However, the Act does not oust judicial review entirely; the Minister’s power to vary or revoke deemed approvals under item 8, or the regulation-making power under item 12, could theoretically be challenged on administrative law grounds (e.g., jurisdictional error, unreasonableness) but such challenges would be under general principles, not under any provision of this Act. Because no cases are named in the source, we cannot report any litigation history. It is possible that disputes arose about the half-payment rule (item 1(3)) or about the scope of deemed approvals for schools that changed their location after 31 December 2013, but the source provides no evidence. Any mention of litigation would be invention. Therefore, the litigation history is confined to noting that the Act contains provisions designed to reduce the scope for litigation and that no case law is referenced in the text.

Several provisions in this Act are easy to overlook and could create unexpected legal or financial consequences. Item 1(3) halves the total financial assistance payable under section 11 of the Federal Financial Relations Act for the 2013-14 financial year, but subitem (4) carves out subsection 65(6) of the new Act (amount payable for non-participating schools). This means that if a school is not participating in the new Act’s funding model, the half-payment cut does not apply to that component, but for all other schools the state grant is slashed. Practitioners handling state funding should verify that the half-payment rule is correctly applied and that the exclusion is not accidentally extended. Item 3 gives non-body corporate approved authorities until 1 January 2015 to incorporate, but if they incorporate earlier, the new body corporate is taken to be the same approved authority. This is beneficial for continuity, but it also means that the pre-incorporation entity’s obligations and funding history are imputed to the new entity; any previous overpayments could be recovered from the new body corporate. Item 11(2) expressly provides that an SES score carried over is not a reviewable decision. A school that believes its SES score was incorrectly calculated has no right to seek merits review; it must wait for a new determination under section 52 of the new Act, which may not happen quickly. Item 7 exempts the Minister from giving notice of decision for deemed approvals. This means an approved authority may not receive formal notification that its approval has been deemed; it is expected to know from the Act itself. If the Minister later varies or revokes the deemed approval (item 8), the Minister may not be required to give notice under section 119 either, depending on the interpretation of item 7. Item 12(1) allows regulations to modify the operation of the new Act for transitional matters, including changing the amount of financial assistance payable (item 12(2)), and item 12(3) waives the requirement to consult the Ministerial Council for regulations made before 1 January 2014. This creates a risk that transitional rules could be made without consultation, affecting funding unexpectedly. Finally, the definition of “majority Aboriginal and Torres Strait Islander school” for the new Act depends on the 2013 census day under the old Act. If a school’s census day in 2013 was different from what the new Act would have used, the school may inadvertently qualify or lose that status without a chance to adjust.

Compliance with this Act is largely passive because most approvals are automatic, but there are several proactive steps that affected entities should take. Approved authorities for non-government schools should identify whether they were approved under the old Act as at 31 December 2013. If they were, their approval is deemed under the new Act, but they should verify that the schools, locations, and levels of education taken to be specified in that deemed approval (item 2(5)) match their current operations. If a school had a campus approved only after 31 December 2013, that campus will not be covered by the deemed approval, and the authority must apply for a variation or new approval under the new Act. Similarly, block grant authorities should confirm that the schools listed in their deemed approval are correct. Non-body corporate approved authorities must ensure they become a body corporate by 1 January 2015. If they incorporate earlier, they should notify the Department so that the continuity provision in item 3(2) is properly recorded; otherwise there may be confusion about the entity’s identity for funding purposes. States and Territories need to document the locations and levels of education they had approved for each government school by 31 December 2013, because those will be deemed to be specified. Any changes after that date will not be recognised unless a new approval is obtained. Schools with pending applications for approval as at 31 December 2013 should confirm that those applications have been transferred to the new Act (item 4). They should also ensure that any requested effective date is not before 1 January 2014. Schools that had an SES score determined under the old Act should note that the score is carried over and is not reviewable; if they believe the score is incorrect, they need to apply for a new determination under section 52 of the new Act. Entities that receive financial assistance under the new Act should be aware that the transitional regulation-making power (item 12) could change the amount payable; they should monitor the Federal Register of Legislation for any regulations made before 1 January 2015. Finally, approved authorities and states should keep records of their pre-2014 status and any correspondence with the Department, as deemed approvals may not be formally notified. The absence of a notice requirement (item 7) means that reliance on oral or informal advice could be risky.
