What it does
This instrument, titled the Australian Education (Commonwealth Share for Government Schools) Regulations 2024, sets numeric Commonwealth shares for government schools by reference to year and State or Territory. It is made under the Australian Education Act 2013 (the Act), explicitly for the purpose of subsection 35A(1) of that Act and subject to section 35B of the Act (regs 3 and 4). The operative provision is reg 4, which contains a single table that maps each year (items 1-10, covering 2025 through 2034 or a later year) to a percentage for each State and Territory (columns for NSW, Vic, Qld, WA, SA, Tas, ACT and NT). The regulation therefore functions as a schedule of input values: for a government school "located in a State or Territory", the "Commonwealth share" for the year specified in the table is the percentage shown in the appropriate cell (reg 4).
Mechanically, the regulation does not set a new method of calculating funding, nor does it change the legal text of the Act; it supplies fixed percentages to be used "for the purposes of subsection 35A(1) of the Act", and it does so subject to s 35B of the Act (reg 4). The table provides two-decimal percentages for each State and Territory for each year 2025-2033 and a stand‑alone row for "2034 or a later year" (item 10). Examples from the table: for 2025 the listed Commonwealth share is 20.00% for NSW, Vic and Qld, 21.25% for WA, 20.00% for SA, 21.25% for Tas and ACT, and 24.92% for NT (reg 4 table). By 2034 or a later year the table lists 25.00% for NSW, Qld, WA, SA, Tas, ACT, and 40.00% for NT, whereas Victoria remains at 20.00% across every row (reg 4 table).
The regulation contains only three numbered provisions: the name (reg 1), the authority under which it is made (reg 3), and the operative schedule (reg 4). It does not itself specify timing rules (for example, whether the year entries are calendar years, financial years or school years), nor does it state mechanisms for enforcement, review, or adjustment; those matters remain within the Act and any subordinate funding instruments or agreements referred to by the Act. The instrument therefore operates as a technical input schedule to the Act’s funding machinery: it fixes percentages with direct application under s 35A(1) of the Act, while leaving operationalisation and any exceptions to the Act (including s 35B) and to other documents.
