#### 123 False or misleading information (1) This section applies if: (a) a decision is made under a provision of this Act; and (b) the decision was based on, or took account of, information that was false or misleading in a material particular. > Note: A reference to this Act includes the regulations (see section 6). (2) Despite anything in this Act: (a) the decision may be set aside and a new decision made under the provision; and (b) the new decision may take effect from any day determined by the person making the decision (including a day that is earlier than the day the original decision was made).
