#### 11 Definition of recoverable payment A payment is a recoverable payment if: (a) the Commonwealth purports to make the payment as a payment of financial assistance to a State or Territory under this Act; and (b) the Commonwealth does not have the power to make the payment (apart from under section 112); and (c) the payment is not an overpayment.
