23 Incapacity due to pre‑existing condition of invalid with not more than 2 years’ membership of the ADF

(1) Invalidity pension is not payable to an invalid who is medically discharged not more than 2 years after becoming a member of the ADF if CSC is satisfied that: (a) the discharge was caused, or substantially contributed to, by a physical or mental condition that existed when the invalid became a member of the ADF; and (b) the condition was not materially aggravated by service after becoming a member of the ADF. (2) If the invalid has been a member of the ADF for 2 or more periods, separated by one or more periods when he or she was not a member of the ADF, take account of only the most recent time he or she became a member of the ADF.
