99 Protection of examiners and other persons16
(1) Subsection (2) applies to an examiner to the extent the examiner:17
(a) exercises the power to conduct an examination; and18
(b) in relation to the examination:19
(i) performs the examiner’s functions; and20
(ii) exercises the examiner’s powers.21
(2) The examiner has the same protection and immunity as a Justice of22
the High Court.23
(3) Subsection (4) applies to a legal practitioner:24
(a) assisting the ACIC or an examiner at an examination; or25
(b) representing a person at an examination.26
(4) The legal practitioner has the same protection and immunity as a27
barrister has in appearing for a party in proceedings in the High28
Court.29

(5) To avoid doubt, this section does not limit the powers of the1
Inspector-General of Intelligence and Security under the2
Inspector-General and Security Act 1986, or any other law of the3
Commonwealth that confers powers on the Inspector-General.4
Note: Section 127 provides for the protection of a person summoned to5
attend an examination, or who appears before an examiner as a6
witness.7
