93 Offence—leaving Australia in contravention of order12 (1) A person commits an offence if:13 (a) an order under subsection 91(1) has been made in respect of a14 person; and15 (b) a copy of that order has been served on the person; and16 (c) the person leaves Australia.17 Penalty: Imprisonment for 5 years or 300 penalty units.18 Strict liability19 (2) Strict liability applies to paragraph (1)(a).20 Note: For strict liability, see section 6.1 of the Criminal Code.21 Exception—compliance with order to appear where person not22 required to deliver travel documents23 (3) Subsection (1) does not apply to a person if:24 (a) the person has appeared before the Federal Court as required25 by the order referred to in paragraph (1)(a); and26 (b) the Court has not made an order in respect of the person27 under subsection 91(2) requiring the person to deliver travel28 documents to the Director-General.29
