before an examiner, in relation to an examination, has a meaning11
affected by subsection (2).12
Chair means the Chair of the Committee.13
charged: a person is charged with an offence if a process for14
prosecuting the person for the offence commences.15
Charges Act means the Australian Criminal Intelligence16
Commission (National Policing Information Charges) Act 2026.17
CIO authority means an authority to conduct a controlled18
intelligence operation granted under section 130 or 133.19
CIO entrusted person means any of the following persons:20
(a) the Director-General;21
(b) an examiner;22
(c) an ACIC staff member;23
(d) a person (other than an ACIC staff member) who has entered24
into a contract, agreement or arrangement with the ACIC;25
(e) a civilian participant in a controlled intelligence operation.26
civilian participant, in a controlled intelligence operation, means a27
person who:28
(a) is a participant in the controlled intelligence operation; and29
(b) is not:30

(i) an ACIC staff member; or1
(ii) an employee of a law enforcement agency or an2
intelligence or security agency.3
combat, in relation to serious and organised crime, includes4
identify, investigate, prevent, disrupt or prosecute.5
Committee means the National Policing Information Committee6
established under section 193.7
Committee member means a member of the Committee (including8
the Chair).9
Commonwealth agency means:10
(a) for a provision (other than a provision in Part 3 or Part 7) of11
this Act—an agency within the meaning of the Freedom of12
Information Act 1982 that is not an exempt agency; and13
(b) for a provision in Part 3 or Part 7 of this Act—an agency14
within the meaning of the Freedom of Information Act 198215
and includes an exempt agency.16
Commonwealth body means any of the following:17
(a) an Agency within the meaning of the Public Service Act18
1999;19
(b) a Department within the meaning of the Parliamentary20
Service Act 1999;21
(c) the Defence Force;22
(d) a body, whether incorporated or not, established, or23
continued in existence, for a public purpose by or under a law24
of the Commonwealth;25
(e) a body corporate in which the Commonwealth or a body26
referred to in paragraph (d) has a controlling interest;27
(f) a person who holds an office or appointment under a law of28
the Commonwealth.29
Commonwealth officer means:30
(a) a person who is a Commonwealth officer for the purposes of31
the Crimes Act 1914; or32
(b) an ACIC staff member who is not covered by paragraph (a).33
