70 Australian Criminal Intelligence Commission Bill 2026 No. , 2026 (3) The examiner must, as soon as possible after varying the summons,1 notify:2 (a) the person required to attend the examination; and3 (b) if the ACIC is aware that a particular legal practitioner is4 representing the person in relation to the examination and the5 legal practitioner is not the subject of a determination under6 subsection 71(2)—that legal practitioner.7 (4) To avoid doubt, if an examiner varies a summons so that the8 examination relates to another authorisation in force under9 Division 2 of this Part, the requirements in paragraph 59(2)(a) and10 subparagraph 60(1)(d)(iii) must be met in relation to that11 authorisation.12 (5) Subsections (1), (2) and (4) do not limit subsection 33(3) of the13 Acts Interpretation Act 1901.14 64 Conduct of proceedings15 (1) Subject to this Part, an examination may be conducted in such16 manner as an examiner conducting the examination thinks fit17 (including through the use of video link, audio link or other18 means).19 Note: Some examples of decisions that an examiner may make about the20 conduct of proceedings at an examination are decisions about whether21 a person is to appear or be present, give evidence, give information,22 produce a document or thing or take an oath or affirmation, by being23 physically present, or present by way of video link, audio link or other24 means, before the examiner at the examination.25 (2) The examination must be held in private.26 (3) An examiner conducting the examination may commence, adjourn,27 resume, or conclude the examination at the examiner’s discretion.28 (4) To avoid doubt, a reference in this Act to an event occurring during29 an examination includes where the event occurs while the30 examination is adjourned.31 No. , 2026 Australian Criminal Intelligence Commission Bill 2026 71
