65 Examiner may require information, documents and things1
Examiner may require witness to give information or produce2
documents or things3
(1) An examiner conducting an examination may require a witness at4
the examination to give information, or produce a document or5
thing, if the examiner reasonably suspects that the information,6
document or thing would assist the ACIC to obtain intelligence7
relevant to serious and organised crime identified in any8
authorisation to which the examination relates (including any9
authorisation subject to a determination made under subsection10
66(1)).11
(2) The requirement under subsection (1) may be:12
(a) either of the following:13
(i) a pre-charge requirement;14
(ii) a post-charge requirement; and15
(b) either of the following:16
(i) a pre-confiscation application requirement;17
(ii) a post-confiscation application requirement.18
(3) Subsection (1) applies whether or not the information, document or19
thing was specified in the summons for the witness to attend the20
examination.21
(4) For the purposes of subsection (1), the examiner may direct that the22
information is to be given, or the document or thing is to be23
produced:24
(a) before a particular time, which must be before the time the25
examination is concluded; and26
(b) to a particular person or a person in a particular class of27
persons; and28
(c) in a particular manner; and29
(d) at a particular place.30
