(3) The circumstances are that delay in the giving of the information,1
or the production of the document or thing (as the case may be)2
could reasonably be expected to:3
(a) seriously prejudice the ACIC’s ability to obtain intelligence4
relevant to serious and organised crime referred to in5
paragraph 50(1)(a); or6
(b) result in the concealment, loss, mutilation or destruction of:7
(i) information or a document or thing specified in the8
notice; or9
(ii) information or a document held in, or accessible from, a10
thing specified in the notice.11
Person may apply for extension12
(4) Subsection (5) applies if:13
(a) a notice is served on a person; and14
(b) the notice does not require information to be given, or a15
document or thing to be produced, immediately upon service16
of the notice; and17
(c) either:18
(i) if, for the purposes of paragraph 50(6)(e), the notice19
specifies a time—the time has not elapsed; or20
(ii) if, for the purposes of paragraph 50(6)(e), the notice21
specifies a period—the period has not ended.22
(5) The person may apply to an examiner, in writing, to vary the notice23
to extend the time or period for complying with the notice.24
(6) An examiner may, in accordance with subsection 54(1), vary the25
notice to extend, or further extend, the time or period specified in26
the notice (whether or not an application is made under27
subsection (5)).28
Record of compliance to be kept29
(7) If the person gives the information, document or thing, as required30
by the notice, the Director-General must:31
(a) cause a written record of that fact to be kept; and32

(b) if requested, cause a copy of the record to be given to the1
person.2
