6 Crown to be bound3
(1) This Act binds the Crown in right of the Commonwealth, of each4
of the States, of the Australian Capital Territory and of the5
Northern Territory.6
(2) This Act does not make the Crown liable to a pecuniary penalty or7
to be prosecuted for an offence.8

7 Definitions2
(1) In this Act:3
accredited body: see section 190.4
ACIC means the Australian Criminal Intelligence Commission5
continued in existence by section 23.6
ACIC employee means a person referred to in subsection 259(1).7
ACIC information:8
(a) means information:9
(i) that was acquired or prepared by or on behalf of the10
ACIC in connection with its functions; or11
(ii) that relates to the performance by the ACIC of its12
functions; but13
(b) does not include national policing information in relation to14
which the ACIC is neither the contributor nor a user.15
ACIC record:16
(a) means a record:17
(i) that was acquired or prepared by or on behalf of the18
ACIC in connection with its functions; or19
(ii) that relates to the performance by the ACIC of its20
functions; but21
(b) does not include a record that is national policing information22
in relation to which the ACIC is neither the contributor nor a23
user.24
ACIC staff member means:25
(a) an ACIC employee (see section 259); or26
(b) a consultant engaged under section 260; or27
(c) a person performing services for the ACIC under an28
agreement under section 262; or29
(d) a person assisting the ACIC under section 263.30

adjoining premises, in relation to particular premises, means1
premises adjoining, or providing access to, the premises.2
adverse criminal intelligence assessment: see section 209.3
AFP Commissioner means the Commissioner of Police within the4
meaning of the Australian Federal Police Act 1979.5
agency means:6
(a) a Commonwealth agency; or7
(b) a State agency; or8
(c) a Territory agency; or9
(d) a person or body prescribed by the rules.10
agency direction: see subsection 47(3).11
AGO means that part of the Defence Department known as the12
Australian Geospatial-Intelligence Organisation.13
ancillary offence, in relation to an offence (the primary offence),14
means:15
(a) an offence of conspiring to commit the primary offence; or16
(b) an offence of aiding, abetting, counselling or procuring, or17
being in any way knowingly concerned in, the commission of18
the primary offence; or19
(c) an offence of attempting to commit the primary offence.20
appear, at an examination or before an examiner, has a meaning21
affected by subsection (2).22
applicant, when used in a provision in Part 7, means a person who23
has applied to the Tribunal for a review of an adverse criminal24
intelligence assessment.25
ART Act means the Administrative Review Tribunal Act 2024.26
ASD means the Australian Signals Directorate.27
ASIO means the Australian Security Intelligence Organisation.28
ASIS means the Australian Secret Intelligence Service.29
