57 Offence—giving false or misleading information etc. in response14
to notice to produce15
(1) A person commits an offence if:16
(a) the person is served with a notice to produce; and17
(b) the person gives information or produces a document as18
required by the notice; and19
(c) the person does so knowing that the information or20
document:21
(i) is false or misleading; or22
(ii) omits any matter or thing without which the information23
or document is false or misleading.24
Penalty: Imprisonment for 5 years or 300 penalty units, or both.25
(2) Subsection (1) does not apply if the information or document is not26
false or misleading in a material particular.27
Note: A defendant bears an evidential burden in relation to the matter in this28
subsection: see subsection 13.3(3) of the Criminal Code.29
