2001;14
(p) Part XAA of the Judiciary Act 1903;15
(q) sections 59, 59A and 60 of the My Health Records Act 2012;16
(r) section 135A of the National Health Act 1953;17
(s) sections 42 and 44 of the Office of National Intelligence Act18
2018;19
(t) section 35 of the Ombudsman Act 1976;20

(w) any other secrecy provision prescribed by the rules;24
(x) anything done under a provision referred to in paragraphs (a)25
to (w).26
(2) A secrecy provision is either of the following:27
(a) a provision of a law of the Commonwealth that purports to28
prohibit any of the following:29
(i) the use of information, or a document or thing;30
(ii) dealing with information, or a document or thing;31
(iii) making a record of information, or a copy of a32
document or thing;33
(iv) the disclosure or publication of information;34

(v) the production of, or the publication of the contents of, a1
document;2
(vi) the production of a thing;3
(vii) access to information, a document or a thing;4
(b) anything done, under a provision of a law of the5
Commonwealth, to prohibit an action referred to in any of6
subparagraphs (a)(i) to (vii).7
(3) Subsection (2) applies regardless of whether the provision of the8
law of the Commonwealth:9
(a) commenced before the commencement of this definition; or10
(b) is expressed to apply despite any other law.11
