51 Notice may direct person to provide assistance to access14

(1) Subsection (2) applies if:16
(a) a notice to produce requires a person to produce a thing in17
person (whether immediately upon service of the notice or18
otherwise); and19
(b) the examiner issuing the notice reasonably suspects20
assistance from the person will be required to enable an21
ACIC staff member to:22
(i) access or continue to access information or data held in23
or accessible from the thing while the thing is in the24
custody or possession of the ACIC; or25
(ii) examine the thing.26
(2) The notice may direct the person, when producing the thing, to27
provide an ACIC staff member any assistance that is reasonable28
and necessary to enable the ACIC staff member to:29
(a) access or continue to access information or data held in or30
accessible from the thing while the thing is in the custody or31
possession of the ACIC; or32
(b) examine the thing.33

(3) Without limiting subsection (2), the notice may direct the person to1
provide any reasonable and necessary assistance required to enable2
the ACIC staff member to access or continue to access information3
or data held in or accessible from an electronic device while the4
device is in the custody or possession of the ACIC.5
Examples: Assistance involving the application of a fingerprint or retina scan, as6
necessary to unlock a mobile phone, log into a computer, or access7
data on a data storage device.8
(4) The person must comply with the direction.9
