26 Australian Criminal Intelligence Commission Bill 2026 No. , 2026
(2) The events are as follows:1
(a) a notice to produce is issued to the person;2
(b) a summons is issued for the person to attend an examination3
as a witness;4
(c) an examination commences at which the person is to appear5
as a witness;6
(d) a requirement is imposed under section 65 for the person to7
give information, or produce a document or thing;8
(e) a determination is made under section 66 to expand the9
purposes of an examination at which the person is a witness;10
(f) questioning of the person begins during an examination;11
(g) material that relates to the person becomes compelled12
material;13
(h) compelled material, or derivative material, that relates to the14
person is used or disclosed.15
14 When an offence is a relevant offence16
An offence is a relevant offence if:17
(a) in the case of compelled material, derivative material or a18
witness—the subject matter of the notice to produce or19
examination, as relevant, relates to the subject matter of the20
offence; or21
(b) in the case of a summons—the subject matter of the22
summons relates to the subject matter of the offence; or23
(c) in the case of a determination made under subsection 66(1)—24
the subject matter of the authorisation mentioned in that25
subsection relates to the subject matter of the offence.26
Note: The subject matter of an examination may expand during the27
examination if the purposes of the examination are expanded by a28
determination made under subsection 66(1).29
