258 Termination of appointment13
(1) The Governor-General may terminate the appointment of an14
examiner:15
(a) for misbehaviour; or16
(b) if the examiner is unable to perform the duties of the17
examiner’s office because of physical or mental incapacity.18
(2) The Governor-General may terminate the appointment of an19
examiner if:20
(a) the examiner:21
(i) becomes bankrupt; or22
(ii) applies to take the benefit of any law for the relief of23
bankrupt or insolvent debtors; or24
(iii) compounds with the examiner’s creditors; or25
(iv) makes an assignment of the examiner’s remuneration26
for the benefit of the examiner’s creditors; or27
(b) the examiner fails, without reasonable excuse, to comply28
with section 29 of the Public Governance, Performance and29
Accountability Act 2013 (which deals with the duty to30
disclose interests) or rules made for the purposes of that31
section; or32
