249 Resignation21
(1) The Director-General may resign the Director-General’s22
appointment by giving the Governor-General a written resignation.23
(2) The resignation takes effect on the day it is received by the24
Governor-General or, if a later day is specified in the resignation,25
on that later day.26

250 Termination of appointment1
(1) The Governor-General may terminate the appointment of the2
Director-General:3
(a) for misbehaviour; or4
(b) if the Director-General is unable to perform the duties of the5
Director-General’s office because of physical or mental6
incapacity.7
(2) The Governor-General may terminate the appointment of the8
Director-General if:9
(a) the Director-General:10
(i) becomes bankrupt; or11
(ii) applies to take the benefit of any law for the relief of12
bankrupt or insolvent debtors; or13
(iii) compounds with the Director-General’s creditors; or14
(iv) makes an assignment of the Director-General’s15
remuneration for the benefit of the Director-General16
creditors; or17
(b) the Director-General is absent, except on leave of absence,18
for 14 consecutive days or for 28 days in any 12 months; or19
(c) the Director-General engages, except with the Minister’s20
approval, in paid work outside the duties of the21
Director-General’s office (see section 247); or22
(d) the Director-General fails, without reasonable excuse, to23
comply with section 29 of the Public Governance,24
Performance and Accountability Act 2013 (which deals with25
the duty to disclose interests) or rules made for the purposes26
of that section.27
