239 Issuing officer function conferred in personal capacity14 (1) A function of making an order under section 238 is conferred on an15 issuing officer in a personal capacity and not as a court or a16 member of a court.17 (2) An issuing officer performing a function of, or connected with,18 making an order under section 238 has the same protection and19 immunity as if the issuing officer were performing that function as,20 or as a member of, a court (being the court of which the issuing21 officer is a member).22
