(e) the giving of the information or production of the document1
does not result in significant loss of, or serious damage to,2
property;3
the person or body is not subject to any civil liability for, or in4
relation to, the giving of the information or the production of the5
document.6
(2) A request under paragraph (1)(a) may be made orally if the7
Director-General is satisfied that the request should be made as a8
matter of urgency.9
(3) If subsection (2) does not apply to a request under paragraph (1)(a),10
the request must be made in writing.11
(4) If a request under paragraph (1)(a) is made orally, the12
Director-General must:13
(a) make a written record of the request; and14
(b) do so within 48 hours after the request was made.15
(5) If a request is made under paragraph (1)(a), the Director-General16
must, before the end of the period of 7 days beginning after the day17
the request is made, notify the Inspector-General of Intelligence18
and Security that the request has been made.19
(6) The Director-General may enter into a contract, agreement or20
arrangement with a person or body in relation to giving21
information or producing a document in accordance with a request22
under paragraph (1)(a).23
Unsolicited disclosure of information etc.24
(7) If:25
(a) a person or body:26
(i) gives information to the ACIC; or27
(ii) produces a document to the ACIC; and28
(b) the person reasonably believes that the giving of the29
information or the production of the document is likely to30
assist the ACIC in the performance of its functions; and31
(c) the giving of the information or production of the document32
does not involve the person or body committing an offence33

against a law of the Commonwealth, a State or a Territory;1
and2
(d) the giving of the information or production of the document3
does not result in significant loss of, or serious damage to,4
property; and5
(e) subsection (1) does not apply to the giving of the information6
or production of the document;7
the person or body is not subject to any civil liability for, or in8
relation to, the giving of the information or the production of the9
document.10
Copies of, or extracts from, documents11
(8) The ACIC may make and retain copies of, or take and retain12
extracts from, a document given or produced to the ACIC:13
(a) in accordance with a request under paragraph (1)(a); or14
(b) under paragraph (7)(a).15
Subsections (1) and (7) have effect despite other laws16
(9) Subsections (1) and (7) have effect despite anything in a law of the17
Commonwealth, a State or a Territory (whether passed or made18
before or after the commencement of this section) unless the law19
expressly provides otherwise.20
