235 Use of and sharing returnable items—search warrant items that1
present a danger to a person2
(1) This section applies to a returnable item that is a search warrant3
item mentioned in paragraph 158(1)(h) or 162(1)(e), which is about4
things that present a danger to a person.5
Use by constables and Commonwealth officers who are not ACIC6
staff members7
(2) The Director-General may make a returnable item available to a8
constable or Commonwealth officer (who is not an ACIC staff9
member) to use for a purpose referred to in subsection 3ZQU(1) of10
the Crimes Act 1914, if it is necessary to do so for that purpose.11
(3) A constable or Commonwealth officer (who is not an ACIC staff12
member) may use a returnable item for a purpose referred to in13
subsection (2) if it is necessary to do so for that purpose.14
Use for State or Territory purposes15
(4) The Director-General may make a returnable item available to a16
constable or Commonwealth officer (including an ACIC staff17
member) to use for any purpose for which the making available of18
the item is required or authorised by a law of a State or Territory.19
(5) A constable or Commonwealth officer may use a returnable item20
for any use that is required or authorised by or under a law of a21
State or a Territory.22
Use by State or Territory law enforcement agency23
(6) The Director-General may make a returnable item available to a24
State or Territory law enforcement agency to use for any of the25
following purposes, if it is necessary to do so for that purpose:26
(a) a purpose referred to in subsection (2), (4) or (5) of this27
section;28
(b) preventing, investigating or prosecuting an offence against a29
law of a State or Territory.30
