(d) the person has obtained the ACIC record by reason of the1
person being, or having been, an entrusted person.2

Penalty: Imprisonment for 3 years or 180 penalty units, or both.6
(2) Strict liability applies to paragraph (1)(a).7
Extended geographical jurisdiction9
(3) Section 15.4 of the Criminal Code (extended geographical10
jurisdiction—category D) applies to an offence against11
subsection (1).12
(4) Subsection (3) does not, by implication, affect the interpretation of13
any other provision of this Act.14
Alternative verdict15
(5) In a prosecution for an offence against subsection (1), the trier of16
fact may find the defendant not guilty of that offence but guilty of17
an offence against subsection 225(1) if:18
(a) the trier of fact:19
(i) is not satisfied that the defendant is guilty of the offence20
against subsection (1); but21
(ii) is satisfied beyond reasonable doubt that the defendant22
is guilty of the offence against subsection 225(1); and23
(b) the defendant has been accorded procedural fairness in24
relation to that finding of guilt.25
