(1) The Tribunal may order that costs reasonably incurred by an9
applicant under section 217 in connection with the application, or10
any part of those costs that is determined by the Tribunal, be paid11
by the Commonwealth if:12
(a) the applicant was, in the opinion of the Tribunal, successful,13
or substantially successful, in the application for review; and14
(b) the Tribunal is satisfied that it is appropriate to make the15
order in all the circumstances of the case.16
Interaction with ART Act17
(2) For the purposes of section 115 of the ART Act (about taxing18
costs), the Commonwealth is taken to be a party to the proceeding19
referred to in subsection (1) of this section.20

The Director-General, ACIC staff members and examiners are4
authorised to communicate or make a record of ACIC information,5
or deal with ACIC records, in certain circumstances.6
The Director-General may make directions relating to such7
communications, recordings and dealings by the ACIC.8
There are offences for the unauthorised communication or9
recording of ACIC information, or dealing with ACIC records, by10
entrusted persons.11
ACIC may use or make available returnable items, which are items12
obtained by the ACIC through the exercise of compulsory powers.13
Limits apply on the use of returnable items shared by the ACIC.14
Returnable items must generally be returned to the person who15
produced the item, or from whom the item was seized, when they16
are no longer required for a purpose authorised by this Part.17
This Part also deals with the non-compellability of the18
Director-General, ACIC staff members and examiners, and19
protection from civil liability for giving information to the ACIC in20
certain circumstances.21
